Media is to be blamed for the damage of Dubai's real estate, says Real
Estate Regulatory Agency (Rera) chief.

The real estate sector in Dubai has been hurt by the journalists and media
publishing incorrect data on the market. The media is blamed for rising real
estate prices... as correct data has never been published, Marwan bin
Ghalita told a conference on Sunday.

They did not check the accuracy... did not get the correct information
which is one of the prime foundations for making any decision. Journalists
did not approach official sources to get the right picture.

In 2007 and 2008, projects were being announced on a daily basis with listed
and private developers announcing billion-dollar worth projects at press
conferences. At the peak of the real estate boom, Dubai had over 850
registered developers, which now have declined to 500.

According to the Government of Dubai's update on bond prospectus, filed at
the London Stock Exchange, around 307 property projects of the 980
registered projects in Dubai are expected to get completed in due course.
The number of registered projects which have either been cancelled, or are
in process of being cancelled, or on which work has otherwise stopped,
equals 495. The agency has not officially announced cancellation of any
project.

The only time Rera came out with official supply statistics was in February
2009. It then said 29,319 residential units were delivered in 2008, with
31,003 and 43,880 units set to enter the market in 2009 and 2010,
respectively

Ghalita called on journalists to educate themselves on the current affairs
of the real estate sector and urged transparency in the media sector.

Everyone was making profit from buying and selling in 2007-2008. But now
the situation has changed... three years after Rera's establishment, the
market has now become more transparent, he added.

Dubai: Every project that Dubai has started, Dubai will finish.

That is the strong message sent out Friday by His Highness Shaikh Mohammad
Bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and
Ruler of Dubai.

Shaikh Mohammad's comments come as Dubai prepares to open the first phase of
Dubai World Central-Al Maktoum International Airport on Sunday.

The airport, once complete, will be the world's largest aerospace cluster
and will demonstrate the Dubai government's determination to deliver on its
promises.

*Achievements*

Over the past 12 months, Dubai also delivered the region's largest shopping
mall, the first urban mass rail project and the world's tallest man-made
structure, among many other projects.

Everything we started, we are going to finish. Maybe some projects that we
are thinking of or are in the books might [see a] delay of six months, eight
months, one year. But the rest is going forward, Shaikh Mohammad said in an
interview with CNN that aired yesterday.

The worst is past and now we are looking for the next growth. We have to be
ready for it and take the opportunity and get in before the rest of the
world, he said.

Projects worth $75 billion (Dh275.4 billion) in the UAE were reported by
HSBC to be on hold or cancelled at one point. They included some that were
part of Meydan, Dubailand, as well as the whole of Jumeirah Gardens by
Meraas and Nakheel's Waterfront.

Ironically, however, HSBC's own chairman, Stephen Green, told CNN that Dubai
is dealing effectively with the issues created by the global economic
downturn, and has successfully positioned itself to become the fourth global
hub of business after the United States, Europe and Asia.

Dubai has, meanwhile, continued to invest in infrastructure. The $33 billion
Al Maktoum International at Jebel Ali will begin cargo operations tomorrow.
The current airport's anchor airline, Emirates, will move to the new airport
at a later stage to accommodate its long-term growth plans.

*Capacity expansion*

Emirates continues to increase its capacity. After a record order of 32
Airbus A380s this month, Shaikh Mohammad told CNN the airline will have to
place even more orders, probably at next month's Farnborough air show.

I think they will have to because of the growth. I see the growth in Dubai
Airport is very… big, he said.

With the country's infrastructure needs fulfilled, Dubai is now ready to
move forward, Shaikh Mohammad said.

We're already moving forward. The structure is ready — bridges, roads,
tunnels, everything. We don't have to build, so we are ready now to move
forward with the country, he said.

 When a forest fire burns down the bush woods, tall trees are left standing.
This is the metaphor venture capitalists’ used in the Silicon Valley to
explain why start-ups that were founded post-bubble, during the tech crash
of 2001-2003 outperformed even the most established technology companies in
the years that followed.

Google and Facebook both reached critical mass during technology downturns.
Paypal and Skype both had sizable exits in a recession.

Silicon Valley’s vibrant ecosystem of intellectual property, venture capital
and talent pool helped spawn these start-ups like no other region could.
Good business plans found early-stage capital, albeit at modest valuations,
while frivolous business plans died a slow, painful death. Brainy,
engineering graduates joined unknown start-ups for stock options in lieu of
staple career choices like banking and consulting. Some worked. Many failed.
The net effect was extremely positive for the region and the entire United
States.

Kip Knight, the VP of Marketing at eBay, has been quoted in
Arabianbusiness.com saying that Dubai has the potential to become the next
Silicon Valley. He felt that Dubai could also become a ‘seat of innovation’
and stressed the importance of effective market research in identifying
target consumers. This was at a time when Dubai could do no
wrong—discretionary income flowed into leisure, real estate and luxury
accoutrements as expats poured their freshly minted pay packets into the
burgeoning economy.

The days of fast cars, fast talk and fast money in Dubai seem to have
abruptly given way to a more subtle, refined environment. Many aggressive
collegiate joint ventures with UAE and North American colleges like New York
University and Duke University got stalled and are only now taking shape.
Dubai has long been the nerve center for trading in the region. However,
what Dubai has clearly lacked has been an ecosystem to promote
entrepreneurship until now. Since Dubai’s real-estate bubble burst, it has
seemingly emerged as a stronger hub for tech start-ups in the region. This
wasn’t an outcome that many could have predicted but more a by-product of a
vastly improved regulatory environment, a bearish hiring climate and
investors looking beyond real estate to diversify. Free zones have become
more reasonable to operate within. Commercial rents have dropped
significantly. Salaries have become realistic. Minimum capitalisation
requirements for start-ups have eased.

However, Dubai has a tall order to fill if it wants to become a regional hub
of entrepreneurship and technology innovation. The missing pieces still
revolve around a lack of early-stage capital and a slowing trickle of
engineering graduates. Sustainable start-up ecosystems take years to build
and require a core of strong, engineering talent, service providers who are
willing to accept non-cash compensation and early financiers who are willing
to take the risk on intellectual property rather than 
tangible assets.

TECOM’s success with Dubai Media City and Internet City saw many media and
technology entrepreneurs’ shine in everything from tech PR to Internet
television and telecom services. Maktoob was one such example of a
well-defined tech start-up that grew its base by being relevant and capital
efficient. Its recent sale to Yahoo comes as no surprise to many analysts
who see the MENA region as an important venue for Silicon Valley-like
growth. Bayt.com, Dubizzle and Flip Media have all demonstrated market
leadership in their ability to generate attention from large audiences.

An interesting benchmark for Dubai in taking its tech entrepreneurial
ecosystem to the next level could well be Abu Dhabi’s media cluster,
TwoFour54. This government-backed cluster of cutting-edge facilities target
media entrepreneurs and content producers alongside those aspiring to gain a
world class, digital media education. TwoFour54 goes many steps beyond other
free zones in providing seed capital, incubation space and access to
potential customers for start-up entrepreneurs. Dubai’s business-friendly
climate would get rocket propelled if it opened its doors to world-class
innovators, providing them access to capital and superior infrastructure. In
my opinion, Dubai has a formidable advantage in promoting a Silicon
Valley-esque ecosystem with a few of these missing elements in place. The
bottom line is that Dubai has a lot going for it. To keep it moving forward
as a thought leadership driven, innovative meritocracy, an entrepreneurial
ecosystem needs to be built and nurtured.

  *Executive Council hands power to Land Department to cancel developments
and offer mediation.*

Dubai Executive Council's decree No6 of 2010 has formally empowered the Land
Department of Dubai to cancel projects on the basis of a technical report
and offer mediation service for disputes, according to Hadef and Partners.

The law firm, in a legal update that claimed it has reviewed a copy of the
regulation, said yesterday the decree dealing with the executive regulations
of Law No13 of 2008 (regulations) has now been signed and is awaiting
formal publication in the official gazette.

As per the legal update, the Land Department can cancel a project in
different cases, some of which include where the developer does not initiate
construction without justifiable reasons after obtaining required approvals;
the developer breaches the Escrow law; the developer fails to commence the
project due to gross negligence or the developer declares bankruptcy.

The regulations, while providing some much-needed clarity over many issues,
also throw up some interesting characteristics such as reinforcing the wide
degree of power and discretion the department holds in respect of projects,
the law firm said.

Experts now believe the regulations will allow the Real Estate Regulatory
Agency to classify projects that have been cancelled or put on hold.

The government of Dubai has announced that Dubai World will repay its $3.5
billion Islamic sukuk bonds due today plus interest after receiving support
from the government of Abu Dhabi and the Central Bank of the United Arab
Emirates.

Here is the full statement from the government of Dubai:

“The Government of Dubai, acting through the Supreme Fiscal Committee
(“SFC”), today announces a set of actions in relation to Dubai World: Sheikh
Ahmad Bin Saeed Al Maktoum, Chairman of the Dubai Supreme Fiscal Committee
said:

Like other global financial centres, Dubai has faced recent market
challenges driven by global economic slowdown and severe real estate market
correction. Recently, Dubai World announced that it might not be able to
commercially support its obligations. Since that time, the Government of
Dubai has worked closely with the Abu Dhabi Government and the UAE Central
Bank addressing and assessing the impact of Dubai World on the UAE economy,
banking system and investor confidence.

The following provides a comprehensive set of actions:

First, the Government of Abu Dhabi and the UAE Central Bank have agreed to
provide important support. Specifically, the Government of Abu Dhabi has
agreed to fund $10 billion to the Dubai Financial Support Fund that will be
used to satisfy a series of upcoming obligations on Dubai World. As a first
action for the new fund, the Government of Dubai has authorised $4.1 billion
to be used to pay the sukuk obligations that are due today.

The remaining funds would also provide for interest expenses and company
working capital through April 30, 2010 - conditioned on the company being
successful in negotiating a standstill as previously announced.

In addition, the Government of Dubai is particularly focused on addressing
the concerns of Dubai World trade creditors within the Emirate of Dubai. To
help address these concerns, today the Government of Dubai is announcing
that the remainder of the funds provided will be used for the satisfaction
of obligations to existing trade creditors and contractors. Discussions with
affected contractors will begin in short order.

Next, the central bank is also prepared to provide support to local UAE
banks.

Finally, today the Government of Dubai will announce a comprehensive
reorganisation law, a framework that is based upon internationally accepted
standards for transparency and creditor protection. This law will be
available should Dubai World and its subsidiaries be unable to achieve an
acceptable restructuring of its remaining obligations.

Today’s actions, taken together, demonstrate our strong commitment as a
global financial leader to transparency, good governance, and market
principles.

There will certainly be challenges periodically, just as there are
challenges in other major financial centers around the globe. We believe
today’s actions will best serve the interests of all stakeholders.

We are here today to reassure investors, financial and trade creditors,
employees, and our citizens that our government will act at all times in
accordance with market principles and internationally accepted business
practices.

Dubai is, and will continue to be, a strong and vibrant global financial
center. Our best days are yet to come. The Government of Dubai remains

Dubai 2020, a new initiative that will explore the emirate's potential to
host the World Expo and the Olympic and Paralympic Games in 2020, was
launched yesterday by His Highness Sheikh Mohammed bin Rashid Al Maktoum,
Vice-President and Prime Minister of the UAE and Ruler of Dubai.

Dubai 2020 will focus on a number of sectors within Dubai and the wider UAE
around the common goal of furthering social and economic progress for the
region.

Central to this project, a Working Group of government and private sector
representatives will explore the potential and possibility of Dubai hosting
the global events in 2020. The Games take place every four years. The World
Expo takes place every five years. The two events coincide in the same year
every 20 years.

Bringing together these two world events in one place – each for the first
time in the Middle East – would be a unique proposition, uniting business,
science and technology with sport, education and culture.

Speaking about Dubai 2020, Sheikh Mohammed said: We need to engage our
community here in Dubai and the UAE in a discussion about our vision and
everyone's role in our future. For this we need a clear, common goal that
highlights shared universal human values. The Dubai 2020 initiative will
look at how we can shape our environment and society for future generations.
It will address, in an integrated way, the building blocks that underpin
social and economic progress – sport, education, culture, business, science,
technology, health and the environment.

These two global events – the Olympic Games and World Expo – give us a
sense of common purpose and play to our strengths. Dubai is already home to
people from different nationalities and cultures who live in friendship and
peace. And I believe we can deepen this respect and mutual understanding if
we work together to achieve something spectacular and meaningful, said
Sheikh Mohammed.

As per a decree issued by Sheikh Mohammed, the Working Group will be chaired
by Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai,
while Sheikh Ahmad bin Mohammed bin Rashid Al Maktoum will be the
Vice-Chairman. Members of the Working Group are Sheikh Ahmed bin Saeed Al
Maktoum, Mohammed Ibrahim Al Shaibani, Abdulrahman Mohammed Al Owais,
Lt-General Dhahi Khalfan Tamim, Hussain Nasser Lootah, Matar Mohammed Al
Tayer, Qadhi Saeed Al Murooshid, Ahmad Abdullah Al Shaikh, Yousuf Yacob Al
Serkal, John Ferguson and Giselle Davies.

A feasibility study will be undertaken before further decisions are taken
regarding making any formal bids to the International Olympic Committee and
the Bureau of International Expositions.

Sheikh Mohammed has mandated Falcon and Associates to lead the Dubai 2020
project and Working Group. Falcon and Associates, a firm under Falcon
Holding, established in conjunction with the Dubai Media Office, will
initiate and review a range of strategies to secure Dubai's position as an
attractive location for inward investment.

DUBAI - Dubai is expected to release a new set of regulations governing the
property industry within weeks, in a move to increase confidence in a sector
hit by falling prices and a growing number of disputes between investors and
developers.

The Government recently published Law 9 of 2009, an amendment that
introduced a sliding scale of refunds for buyers who defaulted on their
purchase plans for property in off-plan developments.


But the bigger changes are likely to come with the introduction of
regulations this summer, possibly as soon as next month, which provide
details on how Law 9 and other property laws are to be interpreted and
administered going forward.

Law 9 provided the clearest guidelines yet about the issue of defaults and
significantly increased the power of the Real Estate Regulatory Agency
(RERARERA) and Dubai Land DepartmentDubai Land DepartmentDubai Land

 by making them the final judges on every default, and giving RERARERA the
authority to cancel projects.


The whole purpose is to put the purchaser in a situation of security, said
Mohammed Kamal, the head of the property practice at Lovells. Currently
there are some very bad situations where purchasers have no certainty on
what is going to happen.

Emad Farouq, a senior legal counsel at the Dubai Land DepartmentDubai Land

DLD  , said recently that the new regulations would mostly focus on the
procedure for terminating a purchase agreement, the payment of damages, and
the rights and obligations of a developer when reselling a unit after a
contract was terminated.


One problem with the law by itself is that many cases fall outside of the
situations described in its wording. One example is a purchaser who has paid
80 per cent on a home, but defaults on the remaining amount after completion
of the unit. Law 9 says in this case, the buyer loses all their money, which
would be clearly unfair, said Michael Lunjevich, the head of the property
practice at Hadef and Partners.


In this case, the regulations should spell out a situation where the buyer
could still receive the unit and owe the developer the remaining 20 per
cent, Mr Lunjevich said.

The broader regulations being discussed will take into account the totality
of the property laws and the overall purposes of the changes, he said.

The regulations are expected to deal with how RERARERA will assess a
project's viability before making a decision on how to cancel it. For
instance, RERARERA might work with third-party experts to determine the
viability of projects, Mr Farouq said.


One of the most pressing issues, according to lawyers, is what happens in
cases where RERARERA cancels a project but there is no money left in the
escrow account. According to the law, the investors are supposed to receive
a complete refund.

Investors are calling me every week with situations like this, said
Ludmila Yamalova, a lawyer with Al Sayyah Legal Consultants and Advocates in
Dubai. There needs to be some kind of mechanism besides just going to
court.


Lawyers said possibilities would include a RERARERA-sanctioned auction of
assets such as land or, if the project is further along in development, the
sale of an unfinished building to a distressed asset fund.

But not all cases will be resolved to investors' satisfaction. The economy
was entering a painful cycle that would see the end of some developers and
many investors losing money, said Mr Lunjevich.


People got caught up in the euphoria of the never-ending boom, he said.
Some people jumped on the boom wagon too late and it is devastating their
financial position ... we need to get down to the cold, hard reality of
ambitious projects not being built and people losing a lot of money.

In 12 to 18 months, Dubai will get rid of the bad investors and the bad
projects.
