* Bahamas: Suisse Security Bank and Trust Claims New Bank And 
Trust Companies Act Is 'Unconstitutional' 

Following a failed bid by the Suisse Security Bank and Trust 
(SSBT) to challenge in court the Bahamas Central Bank's decision 
to suspend its licence, the beleaguered SSBT is still insisting 
that it will not go down without a fight as it has now decided to 
attempt to undermine the authority of the Central Bank Governor, 
which was awarded to him by the recently enacted Bank and Trust 
Companies Regulations Act. 

According to a report in the Nassau Guardian the SSBT has 
addressed the Supreme Court with a plea to find the Act 
unconstitutional thus removing the Governor's new powers. It was 
under these new powers that the Governor, Julian Francis, 
suspended SSBT's licence on March 5, and on Monday April 2 
formally revoked it. 

This is the first time the Act has been brought into question and 
reflects the determination of the SSBT to retrieve its banking 
licence. Litigation was filed by SSBT on March 29 against the 
Central Bank, the Attorney-General and the bank's Receiver, 
accountant Raymond Winder. 

Representing the bank in court was Raynard Rigby, who told the 
Nassau Guardian: 'The case is the first to be filed challenging 
the constitutionality of the Banks  Trust Companies Regulations 
Act ... The action raises several fundamental and constitutional 
issues and is a case of first impression ... Suisse Security is 
also hoping that the Court finds that the actions of the receiver 
amounted to a trespass, an unlawful search and seizure of its 
property, and that its fundamental rights were breached by the 
Governor of the Central Bank.' 

When the Central Bank suspended SSTB's licence on March 5, and 
seized physical control of the bank, it did so, it said, because 
of the 'inability of said bank, at this time, to normally fulfill 
certain prudential requirements and satisfy the Central Bank of 
the Bahamas as to its affairs.'

COMMENT: In other words, they tried to keep their clients' 
affairs private, and the "new and improved" Big Brother Bahamas 
no longer likes that kind of attitude. 

We doubt this court challenge will be successful because the deck 
is already stacked against SSBT.  At least they are fighting all 
the way, and there's an outside chance they can swing at least a 
partial victory in the overwhelming campaign against banking 
secrecy in this former tax haven.

Examination of the bogus "e-qold" site reveals that stolen passwords then 
sent to: [EMAIL PROTECTED]

(This is revealed in the www.e-Qold.com html, so I'm ccing the Altavista 
abuse address, along with our new friend's altavista address.)

Perhaps we should all send this entity our thoughts on e-gold passphrase 
theft? Folks might also want to enter their own account numbers and then 
a "creative" non-password, too, right on the scammer's site! These are just 
educational suggestions, meant to assist this person in assessing the morality 
of his/her actions. Some of you might even want to send this person large 
quantities of information about e-gold, your personal ruminations on morality 
and/or theology and/or ethics, and all manner of other useful e-mail things,
 I don't know! Just a thought.

I wish  to report abuse of the altavista email service.

The site www.e-qold.com is, by cloning the site www.e-gold.com attempting to
retrieve passphases  and have them sent to [EMAIL PROTECTED]

This is an abuse of the system and deceptive and possibly criminal in that
these passphases give unauthorised access to real time funds in the form of
gold available.

I am bringing this to your attention for action.

I dare say, under the circumstances with over 100,000 accounts at risk, you
will be getting many more reports of this activity

Just a quick suggestion though - for those of you who offer a small (or
no) minimum, then I suggest you make more song and dance over it. It's
scary to someone poking around e-gold, to see phrases like "$250
minimum" seemingly everywhere when checking out sites listed in e-gold's
own directory. That kind of entry barrier makes "lets give this a try"
much more of a Big Decision.

[e-gold-list] different value of gold?

I tried a metal to metal exchange using Omnipay.  They used a value of
$259.60 per oz of e-gold.  However, at the time, the value of gold at
http://www.goldcentral.com/ was $260.30.

Does anyone know the reason for the difference?  Is it a difference
between buying and selling?  Is it a difference in the value of their oz?

Just wondering...

Regarding the thoughts of putting in your account and a "creative" password -
WHY? I used a 16 digit bogus account number and some very "creative:
password combinations about 200 times today. I was not busy at the office
and had some time on my hands :)
I would not recommend using your real egold number - could lead to lockouts
from the criminal trying to get in.
Just a thought.

It's just the fluctuation. E-Gold doesn't have a 'live' update. They do it
manually, every few hours -- more often during periods of volatility.

Notice that the difference in those two prices is 2/10ths of 1 percent.
