There is a list of the official languages in the Commission Guide to the

sole reason for rejection.

1.   To the best of my knowledge there is no definition as to which 
specific languages are required.  My company has taken the position to provide 
the DoC in English plus four European languages (German, French, Italian, & 
Spanish).  If more languages become required, we will deal with it then. 
Practically, the DoC text must be translated.  The list of Directives and 
Standards largely unchanged product to product and do not require much effort 
to translate.  In other words, we have DoC templates in each language.

2.   We have accepted that the implied position of the Directive is that 
English only is not sufficient for DoCs.

3.   Will your approach be sufficient?  I think it is unknown, but clearly 
the intent of the Directive is to provide the DoC in European languages.

P.S.: Our products are not consumer products, so user expectations may be 
different than for consumer products.

Some good questions there:

What language is 'required' is up to each member state to decide. Some may well 
accept English (as they have done for many years) but the new wording does 
offer them some additional flexibility. There are precedents for certain 
countries requesting localised DoCs.

The wording does say "shall be translated" rather than "shall be provided" or 
made available.

The timing of the "translation" or how it should be presented is not specified. 
These aspects may be dealt with in future guidance documents. E.g an updated 
Blue Guide or directive specific guide.

Unfortunately we cannot expect to see a revised Blue Guide before the new RoHS 
directive comes into force and I don't think the RoHS FAQ deals with these 
matters either.

Charlie,current mandatory version is 1.7.1. Future (2015) is 1.8.1. Both 
harmonized. 
There is an application note in question which describes additional 
requirements. Only as of last month this Note became mandatory. Note in OJ from 
2009 was simply stating what actual tests been developed in draft 1.8.1. 
Should the "note" be treated as any other new version of the standard, allowing 
grace period? 
Better question: how does one challenge or ask for "official" clarification on 
the matter?

Agreed; this seems like an erosion of the protection of manufacturers against 
instant changes. Like other Directives, the RTTE Directive contains no 
mandatory requirement to apply harmonized standards and carry out tests (except 
in the
 case of Full Quality Control).

Must strive to remove lawyers from this process. What is the INTENDED
purpose of the REACH directive? To prevent bad stuff from entering your
common market? To control concentrations of bad stuff in equipment that will
eventually go to a landfill? To control exposure to bad stuff outside of a
controlled environ? The technical answers to these questions will determine
definition of article.

For at least Germany, the IC is an article only to the end-item mfr as
received. Upon assembly, all that is soldered into the PCB cannot be
considered 'reversibly' removed, so the 'article' is the PCB assembly minus
all of the stuff that can be disconnect by manual means. And the German FAQ
seems to rely on the principle of attachment and containment.

So it seems to be dependent on the equipment's construction, per when it is
placed on the market. And it also seems to depend on the whims and
interpretations of each individual member state.

Just saw an apparent German REACH CLP helpdesk position from September on
the "Once an Article Always an Article" (1O5A) interpretation of articles,
particularly as it relates to REACH article 33. ( link

Does anyone have experience with this German position being enforced?

 

Note that the position qualifies the 1O5A a bit by introducing the idea of
"removed reversibly". It seems that under this methodology an IC soldered to
a PCB would not be a separate article any more, but one that is plugged in
would be a separate article.

No. You only have presumption of conformity to the issues covered by EN
50581. It's annex ZZ says it only covers the criteria of Article 7 in
the directive. There are many other Articles/obligations to consider.

The use of standards to demonstrate compliance is voluntary, not
mandatory, but if it conformance to the standard is the basis for your
compliance that you want to 'advertise' then yes, mention it in the DoC.

EN 50581:2012, Technical documentation for the assessment of electrical and

UNLIKE many other Directives, the R&TTE Directive REQUIRES the use of a 
Notified Body where Radio Spectrum Standards are NOT applied in full.

Harmonised Standards are, in effect, mandatory unless you use a NB - and even 
then, you can't choose not to apply them because you don't like them
