The unpleasant fact is that the OFA has not been deeply involved, as an 
organization, in the development and distribution of OFED.
That may seem counter-intuitive, and it is certainly not appropriate, but it is 
the raw truth.
The EWG manages, tests, and releases OFED versions.
Until recently, that was all done without official review or approval from the 
larger OFA constituency.

There are many issues the OFA needs to get straight if it is to continue to 
contribute to the community in a positive way.
( and I fully acccept some folks would posit that the OFA has never contributed 
in a positive way )
This is one of them.

I think you are splitting hairs, from the start alliance members
focused their efforts upstream (eg Roland getting Linus to accept
drivers/infiniband).

If the board votes to approve all future releases at the April 20 Board meeting 
- is that sufficient ?

It is possible the Board may want to approve each release individually until 
the by-laws are fully approved.
( releasing non-dual-licensed OFED is in violation of the existing by-laws )

Below is the final language from the OFA Board motion to approve release of 
v3.18-3, and the text to be put in the LICENSE file.
This motion passed unanimously via an email vote.

Unfortunately we do not yet have a complete answer.

Below is the email from the RH lawyer, which was displayed during the XWG 
meeting, and briefly discussed.

We will be clarifying:
- his comments about GPLv2 (that being - he means GPL only, not dual 
license)
- his reference to GPL (that being - he means GPLv2, as clarified above)
- since the GPL files are all in the kernel, does user space remain 
un-tainted and therefore dual license
- understand what more detail he needs to answer completely

Once we feel comfortable with the full response, we will ask the OFA lawyer to 
confer/confirm since he is paid to represent us, and Richard is not.

I think I would need to know more about what OFED consists of to
answer this fully. But I would conclude that any kernelspace parts of
OFED have to be licensed under GPLv2.

No, I would not make a distinction along those lines.

Probably not, unless there is any other reason why what you're
building is subject to the GPL (for example, suppose in clean-rooming

I think I'd need more information to answer this (in particular I'd
