I too admire Fred for doing what he had to do to get his fjords back to him 
safely.


I guess I don't quite understand what had/has happened.  Were your fjords at 
this "trainers" facility?  And she wouldn't let you take them so you had to 
hire a lawyer, to fight to get them back?  And she'd bred her stallion, a 
reg. fjord, to your reg. fjord mare, without your permission.  And then 
decided that she should have the foal?
Well, I'd think even if it were an accident, if anyone has something to 
complain about is Fred.  If he'd not wanted his mare bred and she did it on 
purpose, she should be held responsible for all vet care for mare and foal. 
And even though accidents happen, this was her facility, her responsibility 
to insure the stallion had no way to get to Freds mare, and even with 
accidents one has to assume responsibility.   Sounds as if she was either 
doing it to get a foal, get money for breeding and when neither worked, she 
decided to complain to the registry.  Is this the case?


I remember having my guys at a boarding facility one time.  I only had them 
there as the owner was going to "help" me with two of my horses.  But one 
ended up with an ulcer that we had to treat and not work for 30 days and the 
other was my younger one, getting her started.  But she had problems working 
with a fjord I could see, so I told her I'd work her until I got her a bit 
further on in her training.  She got miffed at me and although I had 5 
horses at her place, we were having a barn built and it was half finished, 
she'd given me a good price to board 5 at her place.  She'd talked me into 
moving mine from another barn to her place.  So when I didn't have her 
working any of my guys, she left me a bill for boarding for 5 horses, which 
was double what I was paying.  I was also supplying my own hay as she did 
not have enough for 5 extra horses, that was the deal when I moved them 
there and I was fine with that as I'm picky about my hay anyway.  So when I 
approached her about the bill, she told me either pay it or she's locking 
the gate.  Scared the bajeebies out of me.  Of course I paid it and once my 
stalls were done even though the barn was not, not even water to the barn 
yet, I went over there and without letting her know, loaded my horses and 
hauled them home.  She was at Church.  I was paid up, but I was afraid.  If 
she'd do that, what else might she do.
Anyway, hope I get a better understanding of what actually happened with 
Freds horses.  Guess I must have missed the first postings, the original 
ones.

Horses are more important than money to some..

I think it's commendable that Fred and Lois cared
so much that they went the second mile to retrieve
what was rightfully theirs; that they cared to
such a great extent for their Fjord's welfare.

"Bygones be bygones" is easy if it's not your injustice..
but something wrong can never be made right by
indifference. The age old question, "am I my brother's
keeper?" is as relevant today as it was many years
ago.

Our common Fjord bond should be strong enough that we
care about one another, care about one another's
Fjords, care enough to extend some interest and energy
when it is called for.

All that is necessary is to do the right thing.

Sorry for your frustration Fred, but it appears you should probably have 
retained a different attorney. If it were me, I would have stopped a long 
time before the costs reached $30K, and said "lesson learned" and walked 
away from the mess and gone on with my life.  There are a lot of 
unregistered Fjords out there that are pure bred and doing just fine. Taking 
sides usually leads to more conflict - just like starting a war.




It cost us over $30,000 in legal fees to recover our horses.  We
agreed to drop any further claims against her for "missing equipment"
and "neglect of our horses".
She, supposedly agreed to drop any and all further claims against
us...THAT INCLUDED THE HORSES.

Today is the 2nd birthday of our yet unregistered filly, Tova Tu.

It was noted in the NFHR BOD minutes that the BOD didn't want to take
sides regarding registering our baby.

Somehow, I thought the purpose of the NFHR was to promote the Fjord
and protect the breed.

How does doing nothing, I.E. not taking sides promote the well being
of a beautiful little girl?

I suggest you re-read the post by our former trainer, posted on this
list on Tue 3/6/2012 11:00 AM and my un-answered rebuttal posted Tue
3/6/2012 1:03 PM.

In the mediation, the first question asked of us was: "Are any horses
involved in any settlement?" Answer was "Absolutely NOT!"  Subject
closed.

Apparently our former trainer had no inkling what an option in an
agreement is.  Maybe someone should educate her.
The only reason we signed an agreement containing that option clause
was to get rid of her as we had no intention of paying another dime.
What we did pay, as part of the agreement went to HER attorney.

I would like to restate something: Lois and I would be willing to take
a lie detector test to allay any doubts that what we have written and
said IS true.
Our mare was bred against our expressed denial of permission.  No
signed breeding agreement, or oral agreement or permission, ever
existed. PERIOD!

It cost us over $30,000 in legal fees to recover our horses.  We
agreed to drop any further claims against her for "missing equipment"
and "neglect of our horses".
She, supposedly agreed to drop any and all further claims against
us...THAT INCLUDED THE HORSES.

We have attempted to honor the agreement.  She has not. She had
disparaged us publicly.
She claims in a letter to the registrar (in attempting to register our
foal herself) that an agreement exists.  That is a lie.
She claimed that she is in the process of claiming our foal.  Another
lie?  Our baby is still here, eating treats our of my hand and giving
me warm nuzzles.

We spent my retirement money to "rescue" our horses.  We made a
commitment to our horses, and lived up to that commitment.

It is time for the NFHR BOD to grant a waiver of the Certificate of
Breeding Requirement and take a side for the sake of an innocent
horse.

I ask each reader to write to each board member and demand their
reasons for not allowing such an exemption.

The exemption is JUSTIFIED.

When our former trainer was trying to raise money to buy her white
stallion, we were offered breeding's to that stallion for $500.00.  We
never signed one or paid her in advance for a breeding.   We discarded
the forms.

In the event that the NFHR BOD still lacks the will power to do
something right:

I offer her, NOW, $500.00 to sign a Certificate of Breeding.  For the
sake of our baby!  She can NOT become sausage.

Ms. Morris, you have ONE WEEK and this OPTION will expire.  It will
die, midnight PDT June 11th, 2012.  The money is NOT negotiable.
I can put a check in the hands of President Pedersen, to be released
when a COB is received by the NFHR.

Tova Tu says: "Don't forget me. I am a pure bred Norwegian Fjord!"
