Well, besides punishing obviously flawed behavior, the law also aims to be a 
deterrent to things we want people to stop doing.
In my biased opinion, I feel that men do have a choice in these situations. To 
be banished from home is a choice, mind you, which is harder to make than 
spoiling a woman's life. But we tend to take the easier out of the 2 routes. If 
a parent threatens suicide (one of my friends mom did this to get him married), 
he took her to a psychiatrist, and had her admitted in the hospital till she 
understood and came to peace with the fact that this wasnt gonna change with 
emotional blackmail.

As seen in Renuka Shahane's show too, he admitted to WANTING to get married, to 
prove a point to someone. Often times we tend to do that, and thats definitely 
reflective of the society we live in, and maybe even the laws of the land. But 
the man still does not deserve to get off the hook, simply for the effect he 
has on the woman's life. Cheating is cheating, even if its done by a helpless 
man.

Alimony and fine is absolutely legit - the family and the man ought to owe up 
to what they did. Yes, I agree humiliation should not be a part, and counseling 
for both families and the man should be made available (i dont know how much it 
would help though).

if the law becomes so permissive, every gay man stuck in that situation will 
think - well, its not like there is any consequence. Let me marry now, baad ka 
baad mein dekhenge. Thats not what you want to promote.

Finally, Prashant, having read all your emails to this list, and to replies 
that people post to you, I feel some of your opinions and observations, even 
expressions are very extreme owing simply to the fact that your gay existence 
is small and hidden. I think once one comes out, faces life and people and sees 
that the world does not change overnight or turn on its head when you're out, 
these reactions will mellow down. Also, you will gain a better understanding of 
what the reality is of being gay in India. In parts, it is worse than what you 
express and imagine, and in parts its way way better. I just feel you're 
removed from what really moves us, and maybe this will help you put all our 
comments in perspective. I dont think Aditya hates you, I think he, like most 
of us, is exasperated at your lack of connect with our normal gay lives.

And, most importantly, you will not get any lawyer. There is no case on this 
earth which does not have a lawyer. Even Ajmal Kasab has a lawyer. Even the 
killers of Indira Gandhi, Satwant Singh and Beant Singh, had a lawyer (Ram 
Jethmalani) but you will not get any lawyer unless, of course, you are ready to 
tell a lie and say that you are not a homosexual which all lawyers will suggest 
you to do. But if you do not want to lie in the court or if it is not possible 
for you to tell this lie (e.g. if your wife has concrete evidence of your 
homosexuality) , then no lawyer in the world will take your case.

Given that no gay man marries on his own accord, given that they have been 
forced to marry by this heterosexual society, and given that their own life is 
ruined due to marriage; this is double victimization of gay men. Many Indian 
gay men have faced such double victimization. It is also a forced ‘coming out’ 
which ruins their reputation. The media gives great publicity to such 
occurrences with magazines publishing stories giving name and whereabouts of 
such gay men and TV channels telecasting full-length programmes with not only 
stills and photos of such gay men, but also videos. Their right to privacy is 
blatantly violated, but nobody objects. The man is so terrified that he does 
not have courage to sue the media on such invasion of his privacy.

I have found new English subtitles for one of the most wonderful films of the 
gay icon who is celebrated as such in German-speaking countries and 
Scandinavia, so I thought I would re-post it to the groups for those who felt 
unable to download it before because of a lack of German. This is the film in 
which the producers, unable to find enough women to match Zarah's broad 
shoulders and statuesque bearing, appealed to Goebbels for help and he provided 
a contingent of Hitler's own guard to "drag up" for the big production numbers. 
Here is a view from a Mr Crumpacker, who watched the "History Channel programme 
on the star:--


The History Channel is running a series titled "Hitler's Women". One episode 
features Zarah Leander, clips from this movie, behind the scenes information, 
and its historical context. The high point for me came when the ... film studio 
UFA dressed Hitler's personal guard in drag, complete with FAIRY WINGS and 
heavy eye make-up, to stand behind Zarah in an ornate, Flo Ziegfeld style 
production number. They had to do this because Zarah was very tall, and UFA 
couldn't find enough tall, pretty women. Blow ups of stills from this scene 
clearly show the rather grim faced "chorus girls" were really men.

An old German actor in this episode recalls wearing a lieutenant's uniform as 
he walked backstage past the half dressed guards. He couldn't resist, and 
shouted "Achtung!" The guards instinctively snapped to attention, as their wigs 
went askew and their dresses fell off. Ah, Nazis in drag. Somebody oughta make 
a movie. BC

Synopsis

The attractive Oberleutnant Paul Wendlandt is stationed in North Africa as a 
fighter pilot. While in Berlin to deliver a report he is given a day's leave, 
and on the stage of the cabaret theatre "Skala" sees the popular Danish singer 
Hanna Holberg. For Paul it is love at first sight. When Hanna visits friends 
after the end of the performance, he follows her, and speaks to her in the 
U-Bahn. After the party in her friends' flat he accompanies her home, and 
chance throws them further together when an air raid warning forces them to 
take cover in the air raid shelter. Hanna reciprocates Paul's feelings, but 
after a night spent together Paul has to return immediately to the front.
There now follows a whole series of misunderstandings, and one missed 
opportunity after another. While Hanna waits in vain for some sign of life from 
Paul, he is flying on missions in North Africa. When he tries to visit her in 
her Berlin flat, she is giving a Christmas concert in Paris. Nevertheless their 
bond grows in strength and arouses the jealousy of the composer Rudnitzky, who 
is also in love with the singer. Paul asks Hanna in a letter to marry him. 
However, when he is finally able to visit her, he is called away again on the 
night before the wedding. Hanna, disappointed, leaves for Rome, where she has 
to make a guest appearance. Even when Paul manages to get three weeks' leave 
and follows Hanna to Rome, the wedding has still to be postponed: Paul feels so 
strongly that he is needed at the front that he goes back even though he has 
not been ordered to do so. Hanna does not understand this, and there is an 
argument, after which Paul thinks he has
 lost her for ever.
The war against the Soviet Union breaks out (1941) and Paul and his friend 
Etzdorf are set to the Eastern Front. When Etzdorf is killed, Paul writes a 
farewell letter to Hanna, to make the dangers of his missions easier to bear. 
Only when he himself has been shot down and wounded and is sent to a military 
hospital in the mountains does he see Hanna again, who is still prepared to 
marry him. The last shots of the film show the happy couple, confident in the 
future, looking skywards where squadrons of German bombers fly past.

Well I am a lawyer and I will not take on the case for the married gay man,
but for very different reasons, which I have expressed on this list many
times over the years, so I shall not repeat them. But just small point of
law that comes to mind about the list prashant provided:
A divorce proceeding is not a criminal case so the question of aquital does
not arise. In fact all the declarations that Prashant asks for are beyond
the purview of a divorce proceeding and no court will do any such thing. But
then that is the kind of blooper to be expected when a non-lawyer provided
legal help I suppose..

Intersex Association, Brussels).

The question of access for transsexual individuals to different-sex civil or
legal marriage (with a person of the sex opposite to their post-operative
sex) went to the Court in Rees v. United Kingdom (1986), Cossey v. UK
(1990), Sheffield & Horsham v. UK (1998), and Christine Goodwin v. UK
(2002).  Success came only after the 4th hearing, and 16 years of struggle.
The vote in the Court switched from 2 to 18 in 1998, to 17 to 0 in 2002.

Let's hope for some "beginner's luck" on Thursday!

Schalk and Kopf v. Austria (application no. 30141/04)

The applicants, Horst Michael Schalk and Johann Franz Kopf, are Austrian
nationals who were born in 1962 and 1960 respectively and live in Vienna.
They are a same-sex couple and live together.

In September 2002 the applicants asked the competent authorities to allow
them to contract marriage. Their request was refused by the Vienna Municipal
Office on the grounds that marriage could only be contracted between two
persons of opposite sex. The applicants appealed before the Vienna Regional
Governor and the Constitutional Court arguing that the notion of marriage
had evolved over time thus having to be understood nowadays as a permanent
union encompassing all aspects of life, and that the procreation and
education of children were no longer a determinative factor in it. Their
appeals were not successful. Both the Governor and the Constitutional Court,
referring to Article 12 (right to marry) of the European Convention on Human
Rights and also to Articles 8 (right to respect for private and family life)
and 14 (prohibition of discrimination), held that to limit the notion of
marriage to the traditional concept of marriage reserved to persons of a
different sex was objectively justified.

The applicants lodged their application before the European Court of Human
Rights on 5 August 2004.

Relying on Article 12, they complain of the authorities’ refusal to allow
them to contract marriage. Relying further on Article 14 in conjunction with
Article 8 they complain that they were discriminated against on account of
their sexual orientation since they were denied the right to marry and have
no other possibility to have their relationship recognised by law. Finally,
under Article 1 of Protocol 1 (protection of property), they allege that
they suffer financial disadvantages compared to married couples

Dear sir/madam,
I have written and directed a Marathi/English play which was staged in
Pune. (3 performances.)
This play is about two gay youths, one who has accepted his sexuality,
and the other one who is confused and troubled. Finally they come
together, and a relation is formed but there are many
questions. whose answers are not found. The title of the play
is "Na Yetee Uttare..."

Few of my gay friends in Pune have seen the play and have liked it. It
is a serious, soft type of play with some fun points but in no way
hilarious.

How can I reach more and more people to promote my play ? Can you help
in this matter ? My group is Maharashtra Cultural Center, which is a
non profit making public charitable trust in Pune engaged in cultural

Manay po 2: Overload
 The movie follows the continuing saga of Luzviminda Dimagiba and her three gay 
sons Oscar, Orson , and Orwell . The family is doing much better now, and all 
is well until Oscar and his lover, Adrianne decide to start a family of their 
own and take out an ad for a “babymaker.” While the couple busy themselves 
interviewing potential surrogate mothers, the more flamboyant Orson and the 
adolescent Orwell get into their own misadventures. Orson is desperate to find 
the right man-- as in right now. While riding in a taxi cab, he and his friend 
Cher spy a good-looking guy. Unfortunately the mystery guy is held up and 
knocked down by a thug, prompting Orson to bring the guy to the hospital. The 
guy develops amnesia, which fits in perfectly with the lovelorn Orson's plans, 
and he makes an elaborate ruse to make “Marky” his perfect lover. Meanwhile, 
the youngest Orwell is struggling to fit in, and although being gay doesn't 
bother him, his deference to
 dressing in drag and his attraction to a girl friend confuses him. On top of 
that, he wants to join the Ms. Gay Universe beauty pageant, but it coincides 
with his beloved swim team meet!

Holding their hands through all of it is Luzviminda their irrepressible mother, 
who has problems of her own as well. Luz is threatened of the idea of being a 
grandmother, no matter how much she adores having young kids around. Also, her 
hunky younger husband Gerry is starting in the movie business and is always 
hanging out with the flirty Summer Rain. But the shenanigans don't stop there. 
The overload comes in the form of Betty, the ditzy, con-artist with a heart of 
gold. She schemes with her thug boyfriend to become the baby mama of Orson and 
Adrianne's child, so that they can run away with their money and jewels.

Clash over gay rights in SC set to snowball 

Using fresh arguments that range from imperiling India's defence to making
its people delusional, 14 new organisations have joined the final legal battle
against the decriminalisation of homosexuality. 

On Saturday, the number of petitioners in the Supreme Court - challenging
the July 2009 decision of the Delhi High Court to strike down an anti-sodomy
law - stood at 16 from the original two. 

Two Christian church coalitions, three Muslim NGOs, two Hindu astrologers, a
disciple of yoga guru Baba Ramdev, an NGO run by a former Delhi police officer,
and an environmentalist, will be among those in the Supreme Court when it hears
an appeal next month against the overturning of the Indian Penal Code' section
377. 

Only one person, film director and Rajya Sabha MP Shyam Benegal, has quietly
joined the original petitioner, Delhi NGO Naz Foundation, in support of gay rights
in the Supreme Court. 

With the government saying it will not oppose the Delhi High Court
judgement, which experts consider legally strong, the new opponents are
readying a range of fresh arguments: 

· "Medical opinion" that only the vagina has the muscles
required for sex, not the anus (Utkal Christian Foundation, Cuttack)

· Expanding the constitutional right to non-discrimination to include
sexual orientation could lead to demands for job reservations (Apostolic
Churches Alliance, Thiruvananthapuram)

· Indian cultural morality maybe ready for homosexuality in "50 or
100 years", not today (Raza Academy, Mumbai) 
Chairman of the Jammu and Kashmir Panthers Party, Prof Bhim Singh, said in his
petition that the Delhi High Court ruling would be "a disaster for the
Indian defence forces and the security of the country… in deserted
areas". 

"Seedlings of homosexuality developed among the (European and US)
soldiers during the first and the second world war when they had to stay back
in the forests and the hills for years without having any access to meet their
sexual desires," said Singh, whose party otherwise fights for the

"My challenge of the (Delhi) high court judgement is that it should not
have relied on foreign judgements," said Mushtaq Ahmed, counsel for
Mumbai's Raza Academy, a 32-year-old Islamic advocacy group. "We can't
impose a foreign cultural morality today." 

From Cuttack, B D Das, counsel for the Utkal Christian Foundation, a
coalition of Orissa churches, said the decriminalisation of homosexuality had
already led gay couples to request church marriages.
"Of course we have not given permission," said Das, referring to
homosexuality as a "biblical sin".  

"Earlier, it (gay marriage) was criminal, so they would not dare to
ask." 
Recognising these widespread sensitivities, normally vocal gay, lesbian and
transgender activists are staying under the radar. They will stick to the high
court's stress on constitutional rights of an individual over public morality
and not expand arguments to subjects like marriage and employment.

"Our energies are focused on safeguarding the decision in the Supreme
Court," said Gautam Bhan, spokesperson of "Voices against 377",
a coalition of gay rights organisations.  

The old arguments, made by former right-wing Member of Parliament B.P.
Singhal and an NGO called the Joint Action Council, Kannur (in Kerala), have
been reformulated as well. These focus on the religious opposition to
homosexuality, threat to "public morality" and what opponents argue
is its "unnatural" nature. 

"(The) High Court decision will protect consensual unnatural sexual
acts even when they are obtained by fraud, deceit, misrepresentation, causing
fear, intoxication or due to unsoundness of mind," argued S K Gupta, a
disciple of yoga guru Ramdev, and representative of Delhi's Patanjali Yogpeeth. 

The Delhi Commission for Protection of Child Rights (DCPCR), run by former
police officer Amod Kanth, said the high court had not considered adoption of
children by homosexual couples and the concept of family and parenthood. 

"The judgement will cause 'value disorientation' and torment
children," said DCPCR secretary R C Gupta, "leading to identity
crisis, social physical and psychological maladaptation in society." 
 

g_b Legal help to married gay men facing divorce cases

If you are a married gay man and you have told your wife about your 
homosexuality or she has come to know about it for some other reason and she 
files a divorce case against you, then the situation will be totally out of 
your control. The law is strictly against you and the judge will be furious on 
you. He will not only grant divorce to your wife, but also pass seriously 
adverse strictures on you while giving his verdict. During the full course of 
court proceedings, you will be put to extreme shame by everybody; the judge, 
your wife, the lawyer of your wife, the visitors attending the court and 
everybody else; and you will not be able to see eye-to-eye towards anyone. All 
the time you will be looking towards the ground in great embarrassment which 
not even hardcore criminals need to do. Needless to say, the judge will also 
grant a high alimony to your wife while disposing off the case.

And, most importantly, you will not get any lawyer. There is no case on this 
earth which does not have a lawyer. Even Ajmal Kasab has a lawyer. Even the 
killers of Indira Gandhi, Satwant Singh and Beant Singh, had a lawyer (Ram 
Jethmalani) but you will not get any lawyer unless, of course, you are ready to 
tell a lie and say that you are not a homosexual which all lawyers will suggest 
you to do. But if you do not want to lie in the court or if it is not possible 
for you to tell this lie (e.g. if your wife has concrete evidence of your 
homosexuality), then no lawyer in the world will take your case.

Given that no gay man marries on his own accord, given that they have been 
forced to marry by this heterosexual society, and given that their own life is 
ruined due to marriage; this is double victimization of gay men. Many Indian 
gay men have faced such double victimization. It is also a forced ‘coming out’ 
which ruins their reputation. The media gives great publicity to such 
occurrences with magazines publishing stories giving name and whereabouts of 
such gay men and TV channels telecasting full-length programmes with not only 
stills and photos of such gay men, but also videos. Their right to privacy is 
blatantly violated, but nobody objects. The man is so terrified that he does 
not have courage to sue the media on such invasion of his privacy.

I want to prepare a write up for giving legal help to such unfortunate gay men. 
Legal help from a person who is not a lawyer appears laughable, but there is 
nothing wrong in taking good advice from anybody, especially if you are not 
getting it from valid sources. My attempt is to achieve the following 
objectives:

1.  The court acquits the gay man with great respect and honour.

2.  The court declares that he is not a culprit. On the contrary, he is a 
victim himself just like his wife.

3.  The court declares that the actual victim is the system, our laws, the 
Indian government, and the Indian society.

4.  The court expresses deep sympathy with the gay man and orders the 
government to rehabilitate him which includes taking special care so that the 
man does not take any untoward steps like committing suicide, leaving his job, 
his city etc. The court also orders the government to give him free counselling 
so that he does not feel depressed, lonely, alienated, or embarrassed and is 
able to lead his normal life.

5.  The court orders the government to counsel the relatives, friends, 
colleagues, and employers of the man to tell them that there is nothing wrong 
in being a homosexual and the man is a normal person who should not be 
discriminated against and should be treated with respect.

6.  The court also orders the local police that if the man wants to live 
with a same-sex partner after divorce, the police should give him protection 
and cover so that their neighbours do not trouble them.

7.  The court does not fix any alimony for the wife and asks the government 
to provide relief to her from its own sources since the marriage took place due 
to the wrong laws of the government. However, if the man wants to give 
something, a one-time help or a recurring amount, to his wife at his own wish, 
the court should allow. 

8.  If there are any children out of such marriage, the court should offer 
mediation so that the husband and wife can mutually decide about their custody.

9.  Finally, the court orders the Government of India to take all possible 
measures so that such marriages do not take place in future.

I request our members to offer help to me in this respect. I am basically 
looking for ideas, logic, reasoning, any other helpful material, any published 
reports, related news items etc. 

I am expecting special help from lawyers on these forums. Aditya Bandopadhyay 
hates me, but I hope that he will forget his personal difference with me for a 
common cause. I make a similar request to Shri A. R. Kawi who has a personal 
enmity towards me. I hope he will offer some case studies from his long field 
work,

This little snowflake found her way to our centre & into our hearts sometime
this afternoon she's' a gentle and happy little being, totally aware of
her surroundings & makes no bones about wanting to cuddle up and stay snug
in your lap... She has deep blue eyes and a stare that sees right through
you and tells you in no unclear terms what her little heart is feeling

However much we want her to stay forever, she won't be safe here & needs a
loving and safe home... do let me know if you can help find her one.
