  ALL expatriates in Bahrain, except children, must be enrolled and listed with 
the Labour Market Regulatory Authority (LMRA) before June 30. Those who fail to 
do so will be considered illegal residents, said LMRA inspection manager Ahmed 
Al Khabbas.
  A second LMRA festival will be held from June 4 to 30 to give a last chance 
to expats who have not yet registered, he told the GDN in New Delhi.
  Mr Al Khabbas was in India as part of the official delegation accompanying 
Labour Minister Dr Majeed Al Alawi.
  The festival will be held at Bahrain International Exhibition Centre (BIEC) 
from 7am to 11pm daily on the given dates.
  More than 210,000 expats have already registered with LMRA, out of an 
estimated population of 500,000.
  These include 52,000 who registered during the first LMRA Festival held at 
BIEC in October last year, said Mr Al Khabbas.
  Others have been registering at various enrolment centres opened by LMRA.
  These include the Sanabis Cultural Hall, which is open from Saturdays to 
Thursdays; Saar Club, from Sundays to Thursdays; the North Sitra Industrial 
Area, from Saturdays to Thursdays; and the Hidd Industrial Area, from Sundays 
to Thursdays.
  The centre at the Marina Mall has been closed.
  The opening hours at all centres are from 7.30am to 3.30pm.
  LMRA officials have already visited more than 300 companies, including all 
major national companies, and enrolled their employees.
  "Our staff have already covered 80 per cent of the companies, each employing 
200 workers or more," said Mr Al Khabbas.
  "We shall stop visiting companies on May 25."
  The LMRA takes over the responsibility of issuing work visas for all 
expatriates, from the Labour Ministry, on July 1.
  "We want to know the accurate data of all expatriates and their spouses 
before we officially take over the job of processing their papers," said Mr Al 
Khabbas.
  "Enrolment with LMRA is mandatory for all expatriates, and without 
registration, they cannot do any official transaction with the government. 
These include the renewal of their work and residence permits.
  "We, therefore, appeal to all expats to do it either at one of the enrolment 
centres or at the festival venue.
  "The registration of children will be done by the Central Informatics 
Organisation while issuing or renewing their CPR cards."

Dempo takes on Al Ansar 

New Delhi: Dempo would look to continue the good work when it takes on
Lebanese powerhouse Al Ansar in its penultimate AFC Cup group match in
Beirut on Wednesday. 

Dempo had revived its fortunes by beating Bahrain league champion Al
Muharraq 2-1 in its last outing away from home after being thrashed 0-4
by the same opponent in Margao. Muharraq and Ansar are on seven points
each while Dempo is a point behind. 

Mauricio Afonso's boys know the importance of the Group 'A' game as a
win would put them in an advantageous position to qualify for the
knock-out stage with the last game to be played at home against
bottom-placed Sur Club of Oman on May 14. 

Dempo will be without its injured defender Mahesh Gawli and Veleriano

repeat, must live by  'the law of the people of Goa', 'by the people of 
Goa', 'for the people of Goa' and not the 'mining laws' for Goa conjured by 
the self-seeking political prostitutes in collusion with the vested 
interests in mining , IRRESPECTIVE  of the directives of the state or 
central governments, High Courts or the Supreme Court ,

that:-

" The rich mineral deposits of Goa is the God given providence for Goa,  for 
the people of Goa. If these resources have to be mined, so be it. But the 
benefits from such mining  must come back a plentiful to the people of Goa 
without mindless depletion of  their other vital God given resources like 
'forest cover', wild-life, agricultural lands and most importantly the 
ground water resources, without piling layers upon layers of mining dust and 
mining rejects to affect their very livelyhood and their priceless health. 
If these requirement are not met forthwith, let the God given resources lie 
where they are, undisturbed and untouched, no matter who says otherwise."


A time has come for the people of Goa to stand up-right on their feet and 
refuse to be anything else but selfless and committed  CONSCIENTIOUS 
OBJECTORS  so that we live something for our posterity as it was left to us 
likewise by our forefathers.

Govt feels the heat, to cut AG’s fees

PANJIM, APRIL 28 — It appears the Government has finally realised its mistake 
over the fees of Advocate General.  
Law Minister Dayanand Narvekar told Herald that the fee of Rs 8000 per case per 
day being paid to the Advocate General for appearance in the High Court would 
be reduced as the fee is “exorbitant.”
The reduced fee structure will be made applicable from April 1, 2008.
He said the law department is working out to cut down the current fee and to 
come out with a new fee structure. 
On Sunday, the Herald highlighted how the AG’s fee for appearance in the High 
Court for civil and criminal matters, was raised from Rs 3000 per case per day 
to Rs 8000 per case per day. The proposal moved in August 2004 during the BJP 
regime, received financial approval in December-end 2004 when Manohar Parrikar 
was the chief minister as well as the finance minister. 
The file was reactivated a year later after Rane government came back to power 
and the same proposal was approved by the Congress-led Cabinet in September 
2006 with Narvekar as the law minister. The only difference was that it was 
made with retrospective effect from 1 April 2005 instead of 1 April 2004 as 
proposed by Parrikar. Interestingly, Finance Secretary Dharmendra Sharma in 
early December 2004 has in his noting had suggested that notifications of 
neighbouring states on AG’s fee structure should be sought by the law 
department.
Meanwhile, government’s investigations into the allegations of double billing 
against the Advocate General Subodh Kantak have almost reached the last stage. 
The matter is being probed by the law department.  
“Investigation has been initiated as assured in the assembly and it is likely 
to be completed in the next fifteen days,” Narvekar said.
With several cases in the High Court, Adv Kantak’s bill for less than two and a 
half year, which was paid by the government, was as high as Rs 2.25 crore. 
Adv Kantak is accused of submitting a bill for 103 cases in the Saleli uprising 
matter in a single hearing, going by the number of accused in the case.
As per the laid down procedure, the AG submits a statement of his appearance to 
the High Court whose registry then issues a certificate of appearance after 
checking with its record. The bills are then forwarded to the law department 
for scrutiny before the Accounts Department is intimated.
Adv Aires Rodrigues who is facing a civil suit as well as criminal case filed 
by Adv Kantak, has stated that even Maharshtra AG’s fee is Rs 5,000 per case to 
a maximum of Rs 7,000 per day.

hold an interesting conversation for long, as I discovered during his
couple of visits to my home.

Edgar was blunt in his views, quick to take offence, and quick to
patch up. May we remember the man through some of the pleasant

That people are vigilant is a good thing that is happening in Goa, according 
to Goa's former chief secretary J C Almeida.


It is time to take a closer look at the definition of development. It is not 
construction of high-rise buildings and concrete jungles that can be deemed 
as development. It is providing basic facilities like good roads, reliable 
water and power supply etc, he said.


"Let villages continue to be there the way they have always been." The TCP 
should also do a survey of all villages for ascertaining their composition 
and development, he suggested.


The entire fault in Goa's planning process is the interference of money that 
is destroying Goan land, Almeida said.


It is also extremely important to protect agricultural lands and introduce 
agriculture reforms. The Task Force should also demarcate agriculture land 
that should not be changed for non-agriculture purpose.


Former president of All Goa Panchayat Parishad Tomazinho Cardozo said the 
people's protest is that panchayats are keeping the people in the dark about 
mega projects coming up in their jurisdiction and the fear of demographic 
changes.


There is lack of transparency in the functioning of local bodies and 
government. With the current rate of influx, Goans will be a minority after 
a few years. The gram sabha is an instrument to stop this menace. He however 
cautioned that gram sabhas should not be misused by brute majority by vested 
interests. About sale of land, Cardozo who was the sarpanch of Candolim for 
18 years before becoming the Speaker of Goa Assembly, said it's a misfortune 
that some landowners are selling land to outsiders just for the lure of 
money.


Spokesman of Goa Hith-Rakhand Manch Prashant Naik said if the government 
doesn't put any restrictions on sale of land to non-Goans, Goans will be a 
minority by 2020 if not before. "I fear that there will be Assam-like 
situation after a few years," the former student leader said.


Goa cannot take any more mega projects, he said asserting that the so-called 
developments taking place in the State are detrimental to Goans and Goa at 
large. "If this is not stopped, Goa's identity will be totally wiped out."


He however cautioned that under the pretext of stopping mega projects, some 
hoodlums try to extort money from small project promoters.


Advocate Amrut Kansar feels that the present struggle in the State is on 
account of non-adherence to legislative process. Neither the MLAs nor the 
panchayat members are functioning in the manner they should.


People have realized that the elected representatives are not concerned 
about the people and are failing to work for the people at the grass root 
level, the former MP said.


Agreeing that people have woken up to the need of the hour, Kansar opined 
that people should insist on implementation in the true spirit of the 73rd 
constitutional amendment.


Dr Claude Alvares of Goa Foundation said that the recent uprisings in the 
State draws back memories of agitations against the Thappar Du Pont plant at 
Keri-Ponda in 1994 where for the first time a gram sabha forced its 
panchayat to decide against the plant.


Fourteen years later, Dr Claude Alvares believes that gram sabhas alone can 
bring about transparency and accountability in alleged incompetent 
panchayats.


The TCP treats panchayats like dirt and panchayats in turn operate on old 
habits of being allowed to succumb to corrupt practices. If educated people 
take charge of panchayats there would be a far different situation.


The present uprisings were long overdue as people are upset over mass scale 
projects invading their areas. In Siridao, wells are dry and people have a 
right to be angry as they have an equal right to get supply of water, power 
and other facilities first.


Dr Alvares also said that people are also upset over mass scale hill cutting 
over which the TCP is not taking any serious punitive action against the 
offenders.


Tulio De Souza past chairman of the Indian Institute of Architects - Goa 
Chapter and practicing architect said the State has to follow a hierarchy in 
planning with an overall Regional Plan with a provision and flexibility for 
the local self bodies to engage in micro planning within their respective 
areas. This in turn can be done with the involvement of the people at the 
grass root level.


Once the urban own level map is formulated, the infrastructure work should 
immediately follow for proper implementation of such a plan. This 
infrastructure should precede the secondary development work being 
undertaken by the publicprivate sector.


It is good that there is a lot of awareness among local people, but it 
should not lead to confusion, Tulio said pointing out that a legally 
approved project cannot be stopped unless found ultra virus to the law.


People are probably expressing their sentiments in such a forceful manner 
because the government is not

 After the achievement of the KIDCHAMP 2008, the Ballerines has proved
it again that they are born winners. 25th April 2008 was marked as another
memorable day in the history of Ballerine's. The students of Ballerines won
accolades for their hard work and efforts at the *WOOGIE WOOGIE* dance
competition held at Shaab Leisure Park. All the students who participated
exhibited the true spirit of competition, inspite of the tough fight and
excelled.

The competition was divided into two rounds first being the prop round for
all categories followed by the Main round. The competition was organized by
Karma Entertainment headed by the president Mrs.Chanda Sharma and Miss
Melissa Fernandes.

In the age category 9 – 11 years Janet D'souza, Simran Vohra,
Sinatra Dias, & Natasha D'souza gave superb performances both in the Prop
Round as well as the Main Round. Many of them received words of wisdom and
appreciation from the honourable judges.



The age group 12 - 14 yrs witnessed some fabulous performers. Both Melinda
Fernandes & Sharen D'souza rocked the audience with their mind-blowing
performance. Both of them were declared the winners (first place) in this
category.

Melissa Fernandes has once again revealed her true passion for dance and
emerged winner (first place) in the 15yrs & above category consecutively for
the 2nd week. The judges were impressed with her performance and said that
she is born to dance.



In the group dance category, Ballerines Twinkle's – Janet D'souza, Simran
Vohra, Upasana Vohra, Tanya Fernandes & Kris Arshad danced to every beat
with perfection and Ballerines Kittens – Rovita D'souza, Melinda Fernandes,
Sharen D'souza, Sharon Lewis, Natasha D'souza, Sinatra Dias & Nikitha
Fernando set the stage on fire with their performance.

The Ballerines Kittens were declared winners (first place). The judges gave
them a standing ovation and said they were too perfect to loose a point and
they got 100% from all the judges.

It was a day indeed to be marked for all the members of the Ballerines
Family.

I have been following with interest a discussion thread going on Goanet, 
about direct flights to the Gulf countries.  A lot of opinions and comments 
have been thrown into the discussion by quite a lot of people, which I think 
is just a little wrong.


Let us begin by asking ourselves the question:  What is the prime motive of 
any business, as compared to the function of a Government?  The answer is 
quite simple and not hard to comprehend.  A business house is set up to make 
profits for its shareholders, while the function of a Government is to 
provide service to its people.


If at all Air India, Indian Airlines or any other airline initiated a direct 
Gulf Goa flight, it was done at the time because it was commercially viable 
for them.  Today the business equation must have changed, and as a result, 
they may have made a decision to withdraw the concerned service.  Our good 
friends in the Gulf countries seem to think that just because they are there 
in large numbers, they have a right to pester the Government and other 
agencies to provide them with transportation of their convenience and 
choice.  There is need for a change in mindset.  To me it appears that they 
think of airlines as a service similar to Kadamba provided by the 
Government.


Air India was started by Tata's and the Government decided to nationalize 
the airline company.  That was a wrong decision right from the start.  As a 
Government owned airline, it had no choice but to provide service as 
explained in para #2 above.  Service, which could have been at a loss of 
profit.  Today Air India is no longer in the same predicament as it was 
then, so the management must have decided in the best interest of its 
shareholders to withdraw the service.  I see nothing wrong with that 
decision.  The shareholders always come first.


So what do our Gulfies do?  Maybe they could pool their resources and start

[Goanet] Commuters want ferry wharf shifted

BICHOLIM, APRIL 30 - Expressing displeasure over the Government's
apathy in solving the ferry problem, commuters of Sarmanas-Tonk ferry
have demanded the shifting of the ferry wharf for smooth and
interrupted ferry service.
Yogendra Narvekar informed Herald, that a memorandum signed by 150
commuters has been submitted to the Minister for River Navigation
Sudin Dhavlikar.
In a memorandum, commuters from Marcel, Sarmanas, Bicholim and other
areas have demanded immediate solving of the long pending problem at
the jetty.
"The Sarmanas-Tonk ferry is the only shortest route between Bicholim
and Ponda for most people from the mining companies, government
offices, industrial estates and students of schools and colleges from
Bicholim and Marcel and as such is a busiest route," informed Mr
Narvekar.
The route along the Tonk side is narrow and rocky, making it
inconvenient for ferries to cross during the low tide. The locals
highlighted the problem several times and the desilting work was
carried out, but it did not solve the problem.
Due to the problem, the commuters face difficulty, as the ferry
remains anchored for more than two hours during the low tide.
"At times, due to some technical faults only one ferry operates which
worsens the situation and also puts extra burden on the vessel," said
Mr Narvekar.
The memorandum has asked the Government to remove the rocks submerged
near the Tonk for the smooth functioning of the ferry during the low
tide on priority basis.
Other demands like deployment of extra ferry for meeting the
emergencies and to shift the wharf to new location at Tonk where the
problem of low tide would not exist are also made.
A copy of the memorandum has been also sent to Chief Minister Digambar
Kamat.

Margao, April 29 The government has imposed Section 4 of the Land Acquisition 
Act in Navelim, Benaulim and Assolna for the proposed bridges between 
Varca-Telaulim, Assolna-Cavelossim and Benaulim-Sinquetim over River Sal.
As per the notification, 69,584 sq mt of land has been notified for acquisition 
for the Assolna-Cavelossim bridge, while for the Varca-Telaulim bridge, 9,825 
sq mt have been notified. Only 1,015 sq mt of land will be acquired for the 
bridge in Varca, while the rest will be acquired from Telaulim. The 4,875 sq mt 
of land has been notified for acquisition for the Sinquetim-Benaulim bridge.
Sources in the land acquisition department informed that the notification was 
issued on April 18 and the people whose land has been notified for the said 
bridges can have a look at the rough plan of the projects within 30 days from 
the imposition of Section 4 of the Act at the land acquisition department of 
the deputy collector. The last date for viewing the rough plan is May 18.
Meanwhile, Section 4 of the Land Acquisition Act states that if land in any 
locality is needed or is likely to be needed for any public purpose (or for a 
company), a notification to that effect shall be published in the official 
gazette and in two daily newspapers circulating in that locality, of which at 
least one shall be in the regional language, and the collector shall cause 
public notice of the substance of such notification to be given at convenient 
places in the said locality.
It also states that thereupon it shall be lawful for any officer, either 
generally or specially authorised by such government on this, and workmen to 
enter upon and survey and take levels of any land in such locality; to dig or 
bore into the sub-soil; to do all other acts necessary to ascertain whether the 
land is adapted for such purpose; to set out the boundaries of the land 
proposed to be taken and the intended line of the work (if any), proposed to be 
made thereon.
The provision of the Act also states that no person shall enter into any 
building or upon any enclosed court or garden attached to a dwelling (unless 
with the consent of the occupier thereof) without previously giving such 
occupier at least seven days’ notice in writing of his intention to do so

When Lorna ended her own self-imposed two-decade self-exile from
singing (was in 1994 or 1992?) and returned to Miramar or Campal
(can't recall which), the crowds in Goa were estatic. I recall guys on
their scooters, screaming out the numbers she was well know for,
thanks to All India Radio playing them very often over the years of
Lorna's silence.

Roland is right. Chris had genius in him when it came to compositions.
Guess he belonged to a generation of Goan musicians that was exposed
to the best of world music, and he picked up the subtle influences
from there. Goans are great adapators. Like the Japanese, we could
reverse-engineer almost better-than-the-original. Specially when it
comes to music.  I remember Colin D'Cruz and his group practising
Latino numbers at Calangute, in a language that Donna didn't even have
a nodding acquaintaince with...

(If I recall right, Remo has written in the Herald his memories of how
Chris surcharged Konkani music, without warning, all of a sudden in
the late 'sixties, when Konkani music used to be played in the
evenings at Miramar beach).

Lorna, for all her years in Bombay, and the fact English influences in
her life (I'm assuming here) has the perfect pronounciation and
intonation when it comes to Konkani. I guess she needs some excellent
composer who can add the zing to the numbers, so that she can belt
them out with the power, range and emotion she still summons in a
trice. Or am I wrong? FN

Mumbai, April 29 : Iron ore exporter Sesa Goa Ltd, a subsidiary of
Vedanta Resources, has announced a net profit of $385.37 million
(Rs.15.41 billion) during 2007-08 compared to $161.52 million of the
previous fiscal.

The total income increased to $974.2 million for the fiscal from
$565.7 million of 2006-07.

For the fourth quarter (January-March) of the year under review, the
company posted a profit after tax (PAT) of $373 million compared to
$151.6 million of the year-ago period.

Considering the robust growth, the board of directors recommended a
dividend of Rs.30 per share on the existing capital.

Could you let us know the reason for discontinuing the direct Sharjah –Goa
flights & also update whether you have any immediate plans to restart the
same?

 

I am sure you are aware of the huge inconvenience caused to thousands of
Goan expats traveling to & fro Goa from Shj/ Dxb, especially travelling
families , elderly people & children who are currently forced to transit
though Mumbai or other cities after breaking their journey & undergo the
Herculean task of collecting their baggage, undergoing customs &
immigration, transferring the luggage to domestic terminal & reversing the
whole process all over again for no fault of theirs. 

 

I am sure other budget airlines like Air Arabia & Jazeera airways are
looking at this opportunity to capture this lucrative sector.

 

I would appreciate your early response to circulate the same amongst fellow
goans for their information.

The Goa Environmental Action Group, jointly with the Goa Su-Raj Party has 
welcomed the news reports that the government has filed an affidavit in the 
honourable High Court of Bombay at Goa that it will recover Rs. 10.60 lacs from 
the three top officials of GSUDA (Goa State Urban Development Authority) namely 
the Member Secretary, Mr. Daulatrao Havaldar, Chief Project  Officer, Mr. J.N. 
Chimulkar and the Asst. Project Officer, Mr. Amit Shirodkar,   within a month 
for the demolition of the controversial project built at the Baina beach  in 
violation of the CRZ norms, and are happy that a precedent is being set in this 
ever so lawless a State to correct the general malaise that has  taken root in 
the government administration that its irresponsible acts of commission and 
omission on the part of its officials will go unchallenged. The norms that 
violators/polluters and people responsible for acts of careless misdemeanor,  
resulting in damages and/or losses to the public exchequer, pay. Only and only 
then the sense of responsibility and accountability will be respected through  
fear,  with the prevailing 'whose father what goes" attitude going out of the 
window for once. There is no justice better than to 'pay from one's own pocket' 
for one's mistakes.

It is sad to note that this prevailing attitude in the government 
administration has deprived a sincere and devoted government servant who held 
the post of  ' Health and Nutrition officer' in the 'Health Department, 
Government of Goa' and who retired as such some over 10 years ago has been 
willfully denied his retirement benefits, in the carelessness with which our 
government administration is habituated to work. In this particular case, which 
has been amply documented with the appropriate 'administrative' as well as 
'vigilance' authorities, such norms will not only see that justice is done but 
is seen to be done. Such speedy justice is the need of the hour, especially,  
when the person concerned may not live forever to see it entering his front 
door. This person is none other than Dr. N.S. Dumo,  the President of the Goa 
Su-Raj Party. If the doors of the honourable High Court needs to be knocked to 
get this much delayed justice, then it will be so.

It is a welcome move by some forward thinking eco-friendly Goans that have come 
together this year to save the 'Jumping Chincken'...the field frog...this 
monsoon.
   
  Almost all the restaurants in Goa serve the delicacy, but unfortunately for 
the poor amphibian...it is now pushed to be a near-extinct species.
   
  Thanks to the government's laid back attitude towards hunting of the banned 
species.
   
  One must not forget that if the citizens can be a bit more pro-active, even a 
salman khan can be sent behind bars for hunting illegal species.
   
  Since the jumping chicken issue is fresh, and the nature lovers and 
ecologists in Goa are up in arms, i would also call on the citizens of Goa to 
bring to the notice of the sleeping authorities and specially the minister for 
animal husbandary and forests about the sorry state of affairs of the Bondla 
zoo and the animals housed in it.
   
  The Bondla zoo, once a huge tourist attraction has been a sad story of 
neglect and loot by the concerned government officials.
   
  successful ministers have done very little to promote and upgrade the 
once-beautiful zoo.
   
  It is strange that in a state where the ban on the bull fights is so 
seriously implemented... other animals are given a raw deal...specially all the 
endangered species, and those housed at the Bondla zoo,,,

[Goanet] 2nd Protest Demonstration against IT Park Dona Paula

*Taleigao Residents demand scrapping of Dona Paula 'IT Park'*


Following the national landmark scrapping of SEZs in Goa, the Taleigao
Residents for Appropriate Development (TRAD) took its demand that the Dona
Paula IT Park also be scrapped to a national meeting of IT Ministers and
Hi-Tech companies from around country. A large group of Dona Paula residents
demonstrated outside the Hotel Marriot in Panjim during the inauguration of
the two day Wisitex [EMAIL PROTECTED] 2008.


The spokesperson for TRAD, Jason Keith Fernandes pointed out that it was
imperative that the various participants from the IT industry nationally,
and high-ranking Government employees attending the networking event be made
aware of Goa State's incompetent and shady track record in promoting IT.


Protestors informed participants that the Resolution of the Gram Sabha of
Taleigao Panchayat, passed on 19th December 2007, demanded that the 'IT
Habitat being set up in Dona Paula be scrapped forthwith".

"Our intention is to embarrass the Government which claims to be a
government of the *aam aadmi*, but seems to ignore such democratic decisions
and persistently push anti-people projects" said Fernandes.


Stressing that TRAD was not against IT, Annand Madgavkar, resident of Dona
Paula and a key organizer of the opposition to the IT Park in Dona Paula,
said that the group was opposed to the IT Park in any form. He pointed out,
that the project area sustained more than 80 tribal families who would be
displaced from the land and lose their source of livelihood. "We want to
remind the Chief Minister and the IT Minister of our Prime Minister's
promise that there would be no conversion of agricultural land for
industrial development."


TRAD has pointed out that the nature of the IT industry is such that it does
not require the huge amounts of land that are being given away, practically
for free, by the Government of Goa. TRAD has promised the State that it will
continue to monitor its position on the 'IT Park' and draw attention to its
misdemeanors should it fail to respect the voice of the people.

56 Colamb villagers were served thick notices weighing 4 kilos each restraining 
them from entering mining lease land of Hiralal Khodidas. Villagers have been 
involved in blocking of transportation of the iron ore as the operation of this 
mine is causing various livelihood problems such as threat to the agriculture, 
drying up of water sources and siltation of waterways, besides colossal threat 
to Kushavati river.

Mining lease operated by Fomentos however has been using entire state machinery 
such deputy collector Quepem, Police, South Goa collector Forest departments as 
well as department of mines and geology to bulldoze villagers opposition.

Civil Judge of senior division at Quepem Sayonara Telles Laad passed the 
following order in favour of the mining company in this case that is known as 
Uday H. Gosalia & anr V/s Rama Ladu Velip and anrs on 25th April 2008:

"Perused records filed alongwith the present application for temporary 
injuction and main suit. Heard Ld. Adv. Shri H. Bhangui who minutely took me to 
the documents to show that the plaintiffs are carrying on with their business 
after complying with all the statutory provisions required for the purpose of 
mining. On perusal of the documents produced, I am satisfied that if ex-parte 
relief is not granted in the aforesaid circumstances which has led to filing 
the present application and suit, then the plaintiffs who have shown a 
primafacie case shall be put to hardships. Therefore, the application in terms 
of prayer (a) and (b) is granted till further orders. Plaintiffs to comply with 
Order 39 R 3 CPC. Issue notice to defts r/0 2/5/2008 at 10.00 am."

Mining company's first prayer (a) that has been granted is as follows:

"or a Judgement and Decree of Permanent Injunction restraining the Defendant, 
their agents, servants, family members, friends, relatives etc or any other 
person or persons acting or purporting to act on behalf of the Defendants from 
interfering with the smooth operation of the said mine by plaintiff No. 1 and 
his family and from creating any problem with the free ingress or egress of the 
Plaintiffs vehicle and from in any manner interfering with the transportation 
of ore by Plaintiff No. 2 or interfering with Plaintiff's staff, transport 
operators and/or other employees and/or servants of the Plaintiffs."

Mining company's second prayer (b) that has been granted is as follows:

"ending the herein and final disposal of the suit, for temporary injunction 
restraining the Defendants, their agents, servants, family member, friends, 
relatives etc. or any other person or persons acting or purporting to act on 
behalf of the Defendants from interfering with the smooth operation of the said 
mine by plaintiff No. 1 and his family and from creating any problem with the 
free ingress or egress of the Plaintiff's vehicle and from in any manner 
interfering with the transportation activities of the transportation activities 
of the transportation of ore by Plaintiff No. 2 or interfering with Plaintiff's 
staff, transport operators and/or other employees and/or servants of the 
Plaintiffs."

So here is the case wherein the mining company has used judiciary to further 
its interest. Mining company has been granted both the temporary as well as 
permanent injunction restraining villagers even before the first hearing fixed 
for May 02 2008. This order reflects open collusion of Judiciary and the mining 
company. We can only imagine the fate of Goa if mining companies begin using 
judiciary in this fashion. The trend is indeed disturbing.

I am in transit in Bombay on my way back to New York after spending 4 days in 
Goa.

I must say, I relished the frogs they delivered to my home. And I might want to 
add, that I am NOT going to stop eating them - regardless of a ban to serve 
them or not !!!

Banning Goans from killing the frogs is not going to solve the problem. Those 
who eat frogs, will continue to do so anyway. However, what may save the frog 
in Goa, is the change in policy by the Goa government on this issue. 

What I would suggest, is to create "Frog Farms" where they raise frogs in 
artificial environments on a large scale, so that they can be supplied to 
restaurants and the Goan markets at reasonable prices. This in turn would 
provide an incentive to the villagers in Goa to avoid going frog catching, as 
these would be easily available in the markets or restaurants - thereby, saving 
the wild frogs from Goan fields.

Whatever the stories about the "EVIL USA", the crowds of people waiting to 
get into the USA are not diminishing, but increasing.  Infact, even citizens 
of countries who burn the US flag in anti-USA demonstrations, are the same 
people who are fighting to get into the USA, at all costs, because everyone

DEGRADING  EDUCATION

There is cause for grave concern  among all educators (or
educationists?)  as "Big Business" enterprises are preparing  to suborn the
entire educational system to make it subservient to  their own commercial
interests.

 

We woke up (on Sunday, April 27th.) to screaming headlines that
"Goa Agenda looks to bridge academic-industry gap."   Looking closely at the
very badly written and sketchy report of the  meeting, which was convened
and hosted by the Goa Chamber of Commerce and Industry, we found, to our
horror, that the entire educational establishment was sought to be converted
into a massive production factory by the very large business establishments
to provide industry with what is euphemistically being described as
"knowledge workers."   It is reported that the Information Technology
industry is projecting  a shortfall of approximately 500,000 "knowledge
workers" by the year 2010  which is a serious problem for the industry.  To
overcome this serious shortfall, the big guns of the Information Technology
industry descended upon Goa to participate in what was termed "The Goa
Agenda."   The President of the Goa Chamber of Commerce and Industry
welcomed the participants, who included the Regional Director of Oracle, the
Vice President of Persistent India Ltd.,  a Professor of the Indian
Institute of Technology, Delhi,  the Head of 'Corporate Learning Centre' of
the Tata Consultancy Services, (apparently the kingpin of the meeting),  a
member of the faculty of the Indian Institute of Management, Ahmedabad and
the co-founder and Chief Executive Officer of Merit Trac.   The meeting was
also attended and addressed by representatives of the Goa University, and
top bureaucrats of the Government of Goa, notably the Finance Secretary of
the Government of Goa.

From the amateurish report, we gathered that the I;T. industry
is seriously worried about the "divide" which exists between the needs of
the industry and the number of capable 'knowledge workers' being 'produced'
by the academic institutions, including the Universities.The meeting was
ostensibly intended  to discuss ways and means to bridge this gap.   It was
as clear as can be, that industry expects the educational institutions of
higher learning to produce the  kind of people who are needed to  fill the
positions in  the industry.

The Vice Chancellor of the Goa  University was reported to have
made a vacuous comment   that the word "divide" should be substituted by the
word "distance" in the theme: "Bridging the Divide - Academic to Industry."
What was even more disturbing (and frightening), is that he reportedly told
the meeting:  "do not worry about whether the education system can deliver -
because it can.  Only tell us what you want."   Wow, wow and wow!  He can
modify the entire production process to suit the requirements of the I.T.
industry,  just as a car manufacturer can modify the production line to
produce a new model of a car.He went on (irrelevantly) to point out the
many limitations in the syllabi of the University, which force students to
study subjects which are not of interest to them.He also aired his
dissatisfaction at the fact that corporate salaries are huge as compared to
what is offered to academicians.   However he did not give any indication of
how  these internal anomalies  within the University system will be removed.


What is extremely disconcerting about a meeting such as this is
the apparent alacrity of the academic institutions, including the
University,  to allow their professional programmes to be dictated by
industry.   The vital question, which was NOT asked at this meeting is:  Are
our educational institutions, and specially our institutions of higher
learning simply factories which are expected to produce the "human
resources" to promote industry?  Is it the intention of our Vice
Chancellors and Heads of institutions of Higher Learning that they will
modify their educational processes merely to produce the grist for the
industrial machine?  

An eminent Statesman once remarked that war is too important a
matter to be left to the Generals.   It appears that the time has come to
apply the same principle to the educational establishment.  Education is too
important a matter to be left in the hands of our "educationists!"   Over
the years the educational system has been subverted  by the politicians -
some of whom are, themselves, the products of a degraded education.We
have had Education Ministers who firmly believed that the quality of
education imparted at the Primary and Secondary levels of the School system
could be improved merely by providing midday meals to the students.   It was

Panjim (Goa): Illegal shacks and beach beds on Goa's beaches are quietly
being put to rest. The state's Tourism Department have demolished around
30 illegal shacks and over a 100 beach beds. 

A High Court order triggered this crackdown on 'unauthorised' shanties,
but the move has drawn angry reactions from shack owners who refuse to
take it lying down.

"They are not illegal. If they have then why has the state been
collecting fees? If these shacks have not been allotted then shouldn't
they have returned the money? We want 30 beds for each beach shack. What
they are doing is political targeting, not following the High Court
order. If it is a HC court order then is it only applicable to shack
owners and what about hoteliers?" Convener of the Shack Owners
Association Cruz Menezes asked.

Meanwhile, the Tourism Department denied the allegations. 

"The Department has been dealing with the shack owners with an iron hand
because there have been complaints in the past that beach stretches are
too crowded. Whether it is shacks, beds or umbrellas, they shouldn't
cause an obstruction to beach goers," Officer on Special Duty, Tourism
Dept, Lyndon Monteiro said.

The demolition drive has resulted in a face-off between shack owners and
the state government and if this issue is not sorted out before the
beginning of the next tourist season it could create big problems for
the tourism industry in Goa.

PANJIM, April 25: Feni -- Goa's unique and traditional alcohol
beverage distilled from the cashew apple -- is showing a sharp decline
in production.

Compared to 1.089 million litres of cashew Feni produced in 1971,
there was just 0.875 million litres produced in 2004.

In contrast, the Indian-made foreign liquor production climed from
0.202 million litres to a phenomenal 18.99 million litres in the same
period.

"IMFL is outgrowing feni," says a baseline study of Goa's feni
industry, undertaken by Pranab Mukhopadhyay of Goa University and the
South Asian Network for Development and Environmental Economics, with
the aid of other researchers.

Significantly, Feni is classified as a country liquor and therefore
not able to be sold outside the State.

It is among the best known country liquors in India. Earlier Feni was
considered a "poor man's drink", but is now in demand with tourists
and higher income considers as an "identity drink", says the study.

For the most part, the bulk of Feni's production is semi-traditional.

Feni production has a complex chain. It has 19 bottlers and 94
wholesellers in Goa. On the other hand, there are as many as 2656
licensed stills in Goa, and 6589 retailers. There are also some 1532
cashew zones in Goa.

Incidentally, the north-eastern sub-district of Sattari is the Feni
capital of Goa. It has the largest number of zone/bids (561 out of
1532 all over Goa), as many as 853 stills (Goa's total is 2565) and
accounts for nearly 20% of Goa's total cashew area.

Pernem taluka is another large cashew area, followed by Bicholim and
Sanguem. Bicholim has the second-largest number of feni stills,
followed by Bardez and Ponda.

Mukhopadhyay et al found that Feni is "not a homogenous product". It
comes with differences in its production technique, and product
quality (specially concentration levels).

"There is a lack of uniform product-testing mechanism. Feni is largely
sold unbranded, but some brands have emerged due to private
initiatives," said the study by Mukhopadhyay and the team.

Bottlers in the field are usually educated (85% graduates), while
distillers are mostly poorly educated (nearly 50% are below Class 8).

Nearly 30% of distillers had their businesses started by their
fathers, and for 12% of those surveyed, it was their grandfathers who
ventured into the traditional trade.

On the other hand, over 81% of wholesalers were first generation
businessmen in the field.

For distillers, it was mostly a form of 'barefoot capitalism', and
small players dominated the field. Some 73% of distillers surveyed had
just one still running.

"Most of the people involved in the Feni industry said they are first
generation producers. Large majority claimed to have only one still,"
said Mukhopadhyay.

Some 77.5% of stills surveyed were founded to be semi-traditional --
copper pots, with a barrel filled with water for condensation. Modern
stills (steel or copper stills with cooling done by large water tanks
of concrete or cement) accounted for just 2.6 percent of those
surveyed.

Unbranded sales dominate the Feni market in Goa. But some bottlers are
now reporting that even Urak -- the lighter grade of cashew liquor --
is being bottled now.

"75% of the distillers sell to bars directly, while bottlers route
their sales through wholesellers," says the study. Quality is tested
on the basis of the 'grao', taste-based methods, traditional ways (by
pouring in a glass and stirring to see if bubbles are formed) and
other means.

"This is largely an unorganised industry. There was no group found
among distillers, retailers or wholesellers," found the study. "Only
the majority of bottlers claimed to be part of an association."

[Goanet] TCP the culprit

The TCP is clearly a big culprit when it comes to dumping big
irrational development projects on top of the people. They approve
land conversions and various other lunacies, and then forward
the file to the panchayat.

At which stage the panchayat CAN refuse to grant permission. But
this seems to have missed the attention of the panchayat members,
we had them telling us recently that "the file came from the TCP
already approved". If that is how they perceive their role, maybe
we can just make rubber stamps of all panchayats for Rs 30 or so
each and hand them over to the TCP, and save on the costs of
running a panchayat, and do away with out fond illusions of local
self-governance.

Below are two items from today's Herald with info. on the
shenanigans of the TCP and the court's observations in the matter.
For some unknown reason, the court seems very generous in
repeatedly giving three/four weeks time to the TCP to explain
itself, I just wish my teachers in school had been so generous
when I hadn't done my homework, it would have saved me much misery :-)

Chief Town Planner gets 3 weeks to file affidavit

PANJIM, APRIL 28 — Chief Justice Swatanter Kumar has granted Chief
Town Planner (CTP) Morad Ahmad three weeks to file fresh affidavit
with respect to deviations in the construction of mega
housing-cum-hotel project  coming up at Bambolim.
The hearing was adjourned till June 25.  The petitioners were
represented by Adv Norma Alvares.
The CTP was literally taken to task twice on Monday when the Court
discovered that its directives were not adhered  to.
Chief Justice Swatanter Kumar directed Ahmad against playing with
its orders.
It may be recalled that the Court in its last order had directed
the CTP to conduct   survey of the mega housing-cum-hotel project
 to determine the deviations  in  constructions  vis-à-vis  the plans.
As reported earlier, all original files pertaining to this
controversial project are missing from the government departments.
The petitioners — the Goa Foundation and the People’s Movement for
Civic Action (PMCA)   has challenged this project on the grounds
that it is in gross violation of CRZ Rules.
The Court was not satisfied with the affidavit filed then by the
CTP.  The Chief  Justice  warned that the Court would  not take
lightly  any non-adherence of  its orders, in future.
Allowing a last opportunity to the CTP,   the Court  directed him
to  file  an accurate   affidavit,  listing  out  inch-to-inch
deviations  in  construction  in relation to the  plans available.
The court was also not happy with the investigation conducted so
far in tracing missing files. When  questioned  on this,  the
Advocate General  Subodh  Kantak  appearing on behalf of the
Government,   submitted  that  the State Government   will  not
have   any serious  objection  in handing  over  the investigation
to CBI.  However,he added that investigation is going on in
the right direction.

TCP dept finds this PIL hard to digest!

PANJIM, APRIL 28 – In the last two years, a couple of instances of
hill cutting have come to light, yet the department concerned has
hardly seen acting against the violators.
But, at least in future, they will not able to go on with their
“care a damn” attitude.
Reprimanding the Chief Town Planner (CTP), the  Division  Bench of
 the Chief  Justice Swatanter  Kumar and  Justice N A Britto
directed  the Secretary TCP to file an affidavit,  within two
weeks,  stating what measures will be initiated to prevent overall
hill cutting in the State.
The Division Bench was hearing a Public Interest Litigation (PIL)
filed by one Satish Benaulikar  who  complained  of  hill cutting
 in  Siolim.
While  the  Department  of  Town and Country Planning had earlier
taken  a stand  that  there was   no  hill  cutting,  it  changed
 its stand  after   the  commissioners appointed  by  the  Court
confirmed  that allegations  made  by the  petitioners were true.
When  the matter  came  up for hearing today,  the  Court  felt
that efforts  of the  TCP  were  half-hearted  and in no uncertain
 words  pointed  out that the  chief  town planner has  failed in
 his  duty.
“Why shouldn’t he be prosecuted?” asked Justice Swatanter Kumar.
The court further issued direction to take action against the TCP
officials concerned as well as the violators.
In its affidavit which  was presented to the Court, the CTP  Morad
Ahmad   stated that show cause  notice  was issued to the
developer while  a  formal  complaint was  lodged  with  the
police seeking  action as envisaged  under Section 17-A of the
Town  & Country  Planning Act.
The Police has completed the investigation and sought sanction of
the government to prosecute the accused.  A memorandum was issued
to the Town Planner, North Goa to the planning assistant, seeking
explanation for misreporting on the site condition.
He further adds he too issued memorandum to the   said planning
assistant.

 PANAJI: Two Goa youths, who are accused in the death of British
 teenaged girl Scarlett Eden on a beach, may file a defamation suit
 against her mother Fiona Mackeown.

 "My clients are exploring the possibility of filing a defamation suit
 against Fiona along with Goa Police and the media," a lawyer
 representing accused Placido Carvalho and Julio Lobo said.

 "There are sufficient grounds for defamation and malicious
 prosecution," the lawyer said.

 He said he would file a case against Fiona for defaming her clients,
 Goa Police for malicious prosecution and also the media for
 defamation.

 He said while Carvalho was being mentioned in connection with drug
 peddling, a defamation suit would be filed against allowing Scarlett's
 diary, which speaks of Lobo's alleged illicit relations, to be made
 public.

 "Publishing of Scarlett's diary was an act of defamation. Lobo's name
 was published in it, which was a part of police investigation. We need
 to know how the diary was made public either by Scarlett's mother or
 police," the lawyer said.

 Scarlett Eden Keeling was allegedly drugged, raped and left to die on
 Anjuna beach on February 18.

 The mother of teenage murder victim Scarlett Keening has split from
 the boyfriend who took her and eight of her kids on their tragic trip
 to Goa.

 Scarlett, 15, was found drugged, raped and murdered in the Goan resort
 of Anjuna in February while her family were in another part of India.

 Former shopkeeper Mr Clarke, who has now returned to Launceston in
 Cornwall, said: "It all went wrong in India before and after her
 death. Too many mouths and not enough money coming in."

 Earlier this month Fiona flew back to England with Scarlett's body.
 She is living with her children in a series of caravans at a field
 near Bradworthy, Devon.

 She had forced police to reinvestigate Scarlett's death after they had
 ruled that she had drowned. A subsequent murder probe has led to
 several arrests.

 The investigation into the murder of the British teenager Scarlett
 seems to have been consigned to the limbo, at least for  now. No one
 knows who is handling it!


 Ever since the body of the 15-year-old British teenager Scarlett Eden
 Keeling was found on the Anjuna Beach in Goa on Feb.18, an
 international tourist destination, all kinds of murky stories have
 been swirling around, many versions charging that the police are doing
 a hatchet job and trying to protect the culprits.

 Following a relentless campaign by the dead girl's mother Fiona
 MacKeown,  the Goan government announced it was handing over the
 investigation to the Central Bureau of Investigations (CBI).

 That was on April 2. But 25 days later, India's premier investigating
 body says it is yet to receive any instruction on the issue.

 "We have not taken over the Scarlett Keeling case nor have we received
 any instruction regarding it," said G Mohanty, CBI spokesman. The Goa
 police would only say, "The case is no longer with us…"

 "The Goa Government should have issued an official notification
 demanding the CBI immediately take over the case, but all they did was
 send a request letter," said Keeling family lawyer Vikram Varma. "It
 has been over three weeks and we are still waiting."

 Chief Minister Digambar Kamat was not available to comment.

 One man badly affected in the process is Michael Mannion, a British
 national, who has been forced to cool his heels in India. He has been
 virtually barred from leaving the country.

IT has been noticed for some time now that any Naga group on a tour of
Goa seems to feel the visit is incomplete without paying former
Nagaland chief minister SC Jamir a courtesy call. He is now governor
of that state and is also officiating for Maharashtra. While meeting
some Mumbai Naga students recently, he reportedly told them that a
Biblical Tower of Babel was being enacted in Nagaland where people
talked in many "political languages" whereas in the past the Nagas had
exercised only one voice — that of the Naga National Council under the
leadership of Angami Zapu Phizo. On the Naga people's identity, he was
quoted as saying that "it has been distorted and misrepresented" and
he cautioned the students that "it would be destroyed not by anyone
but by the Nagas themselves".
Comparing the situation in Nagaland today, he said it reminded him of
"the broken walls of Jerusalem in the days of Nehemiah when thousands
of Jews living in that city did not care for the many ills prevailing
even though they were directly affected and the Lord had to ask
Nehemiah to reform the people of Jerusalem". He said Nagaland needed
no less than a Nehemiah who cared for Naga society. Though safely
ensconced in Raj Bhavan, Jamir confessed he had no peace of mind since
"my home is burning".
His Biblical references are not difficult to interpret. What he means
by the Tower of Babel is the recent emergence of the NSCN
(Unification). And what with all the warring factions indulging in
fratricidal killings, the situation in Nagaland is becoming more
explosive than ever before. Jamir did not spell out who this modern
Nehemiah was or would be, but it would seem that "shepherd of Naga
society" is yet to be born.
His remark on Naga identity being "distorted and misrepresented" seems
directed at those Nagas from outside Nagaland who are involved in Naga
politics. Little wonder then that the NSCN(IM) has already passed an
"edict" banning Jamir's entry into Nagaland.
The tragedy of Nagaland is that not all are protagonists of peace at
heart. Some have openly cultivated rebels for their own narrow ends
and some are keen on keeping the conflict alive to ensure a continuous
and generous flow of Central funds. This is the main reason why the
more-than-decade-old peace process has not moved a step forward.
