Without any surprise, here are my views on points raised:  

It appears that the writer of the below appended message is too sound in
Indian Constitution and in how Presidential Powers of Pardon works!! It also
appears that the writer is the only brainy person in Goanet using his brain
while responding to Goanet messages. I must consult him on these topics and
many other topics when I will answer my final LL. B.!!

The writer of the message has not even grasped my message (appended herein
below) and preferred to jump in haste giving his unwanted, unsolicited
judgment trying to: divert the attention from main issue in question; trying
to prove the world round him that other than him no one knows Indian
Constitution and how Presidential Pardon works; and that he is 'the best' at
interpreting messages posted at Goanet. 

He should have realized that in my message (appended herein below) I've not
challenged the authority granted to President under Article 72 of Indian
Constitution nor did I equate Presidential Powers to State Chief Minister's
powers. 

If one goes through my post (appended here below) very carefully one would
come to know that I have sighted presidential pardons as an eye opener
example to bring forth that President Pratibha Patil as scored a new record
of over 200 % disposal rates. She has commuted the death sentence of as many
as 35 convicts to life - among them are those convicted of mass murder,
kidnapping, rape and killing of children. On June 2, Patil gave her pardon
to four more! Almost all the convicts pardoned are guilty of the most
barbaric blood-curdling crimes. 

All print media and TV media in India has reported that 'the speed with
which Patil has granted pardons indicates haste and that Presidential
Pardons indicated mercy to mass killers and rapists and killers of children.
A question that is boldly asked by all of them is: Were these pardons
diluting the legal provisions through the backdoor?'

Importantly, it appears that writer is not at all aware of how State Powers
works (which is the main issue of my post)

Does the writer through his comments (appended here below) want to indicate
that Kongress ruling party in Goa withdrew pending cases on netas and their
party men on two occasions, first after defeat of MGP party and later after
defeat of BJP party, WAS AN LEGAL ACT and that what is initiated by MP of
BJP is ILLEGAL? 

Is the writer trying to say that Goa State Government has no right to
withdrew cases filed by the State government?  And this is my main point of
contention in my posting. 

Now the write is free to repost his initial comment (appended below) or send
in more responses unstopped - the choice is left to him!

Caros Amigos,

Cá estamos de novo preparados para um novo ano letivo! As primeiras
semanas do início de junho serviram para planificar e programar os
novos cursos que se iniciam hoje, dia 25 no Centro de Língua
Portuguesa/Instituto Camões em Panjim. Como é habitual é muita a
procura para aprender a Magna Língua Portuguesa, uma língua especial
que cada vez mais está na moda!

Dada as limitações de espaço só podemos oferecer dois cursos até
outubro, os cursos intensivos de Língua e Cultura Portuguesa, nível
básico (A2) e nível pré-intermédio (B1).

Na Universidade de Goa, também se iniciam esta semana as aulas do
Master of Arts em Português. O ligeiro atraso deveu-se ao alargamento
do prazo para admissão concedido pelo Registrar. Dos 9 novos
candidatos, 7 passaram no “change of faculty test”. Mais uma vez, é
notória uma certa viragem, relativamente ao passado recente, no que
diz respeito ao perfil dos candidatos. Há cada vez mais jovens na
Índia, e em Goa em particular, a procurarem uma formação académica na
área dos Estudos Portugueses. Desde a reabertura do Departamento de
Português na Universidade de Goa em 2005-2006, e a reintrodução do MA
em 2006, foram já 36 os alunos que se inscreveram no mais avançado
programa de Estudos Portugueses que existe em todo o subcontinente
indiano, quase tantos como desde a criação do Departamento em 1987 até
2001, ano em que foram provisoriamente suspensas as atividades! Em
apenas 6 anos saíram da Universidade de Goa 26 Mestres em Língua e
Cultura Portuguesa!

Vamos continuar a apoiar, no âmbito dos protocolos e acordos que temos
com outras instituições em Goa, os cursos e atividades de promoção e
divulgação da Língua Portuguesa e da Cultura dos Países Lusófonos,
designadamente com o Smt. Parvatibai Chowgule College em Margão e o
Goa Institute of Managment em Sanquelim.

São agora duas as institutições em Goa a oferecerem o B.A. em
Português. Para além do St. Xavier College em Mapuça, regista-se neste
ano letivo 2012-2013, com imenso agrado, a abertura do B.A. em
Português no Chowgule College que contará com o apoio de uma docente
formada na Faculdade de Letras da Universidade do Porto. A chegada da
Dra. Gilda Machado, Mestre em Português Língua Estrangeira e bolseira
Fernão Mendes Pinto do Instituto Camões, irá certamente realizar um
excecional trabalho em Goa.

Aproveito esta oportunidade para desejar a todos um fantástico ano
académico e as maiores alegrias no recomeço dos afazeres

*PANAJI: Hippies first descended on Goa mostly in South Goa beaches like
Benaulim beach bringing drug culture with them. But they started thronging
North Goa beaches at Vazarem, Vagator, Dando  and Anjuna in Bardez taluka.
Nowadays they are mostly seen on Morjim and Ashvem beaches in Pernem taluka.

Narrating the journey of the hippie movement into Goa – the movement was
most popular in the 1960s in the US and Europe -- authoritative sources
said hippies were  foreigners who used come  from European countries like
Spain, Germany, France, United Kingdoms, beside Israel and other nations.
In 1970s they used to frolic on Goan beaches, and state authorities of that
period could not rein in them.
Hippie is a person who rejects the way that most people live mostly in
western society, often having long hair, wearing brightly coloured clothes
and taking illegal drugs.
As arrival of monsoon came closer they would throng to northern states of
India like Himachal Pradesh and Ladakh region of Jammu and Kashmir. Hippies
would go even to Tibet and Nepal. They used to live there for three-four
months and come back to Goa  with lots of narcotics.
This trend is still seen among the hippies who sojourn in Goa.
These hippies were music lovers and used to dance for long hours. Drugs and
liquor would induce them into a trance state.
The sources said that Afghan refugees also started coming to Goa who used
to live  at Vagator, Chapora, Anjuna, Arpora and Calangute in Bardez
taluka. But when anti-narcotics cell was established they all ran away from
the state.
It is believed that some Bollywood blockbusters like Hare Rama Hare Krishna
(1971)  also gave a boost to drug  culture  in the state.
In an attempt to curb this rising menace the state government brought in
the Narcotic Drugs and Psychotropic Substances Act, 1985. The NDPS Act was
notified on September 18, 1986.
Armed with the NDPS Act, the police rolled up their sleeves to wipe out
narcotic culture from Goa.  If a person was caught with drugs there was no
bail for him. He was made to cough up `1 lakh as fine and undergo 10-year
imprisonment, the sources said.
By early 1990s narcotic culture caught on with many children of affluent
Goans, and  many of them died of drug addiction.
When flea markets took roots in Bardez beaches some school managements
found that their students were bunking classes. Later the schools found
that parents were using the students to run their trade in flea markets.
Full-moon parties, where drugs are sold and consumed rampantly, ensnared
hippies and locals as well. But these full-moon parties took a backseat
after few years.  Thereafter beach  and  rave parties raised their ugly
heads. Now, these parties have become a crazy for locals.
Drug addicts took hold of synthetic drugs like Mandrax, LSD, Speed and
Ecstasy. Nowadays Catamine and velium are  used as intoxication which are
sold in  pharmacies along the coastal belt, the sources informed.

An interesting subject and one which has still to be researched further. Some 
of the adoptees were also illegitimate children of the adopter and this 
adoption may have been a cover up for a guilty conscience. Others may have 
other views and examples. Some adoptees were treated just as well as their 
legitimate siblings and were not begrudged educational opportunities either. 
There were also others who were mistreated and abused by the adoptors and this 
is a tragedy. Some adopted children achieved such eminent positions and did so 
well in life that they even were able to rescue the family property when it 
fell to foreclosure or was rescued from decay and collapse by the adoptees just 
to preservce the family name.

Let us therefore look more deeply into this phemoninon. Is it trait unique to 
Goa or are similar circumstances common in India.

Don't you worry about my foot or any other Goanet members' foot, instead
always make sure that you don't put your foot into your mouth!

You wrote saying withdrawing cases in state amounts to interference with
process of law! Does this mean that when Kongress was ruling in Goa and when
they withdrew pending cases on their netas and their party men on two
occasions, first after defeat of MGP party and later after defeat of BJP
party was not an act of interference! And that that ACT of Kongress was
LEGAL!! Is it? OR are you trying to say that only Kongress party chief
ministers are given license to interfere with process of law and not any
other party's chief ministers?

You asked me, 'do you Barad think that M Parrikar has that power invested in
the Chief Minister's Job?' 

To this my counter question is: Do you mean to say only Kongress Chief
ministers have the powers to withdraw pending cases and no other party's
chief minister has such powers? 

My counter question to your second followed question: is it only M.
Parrikar's job to 'uphold the rule of law' and Kongress party chief
ministers are free to play with rule of law? 

Lastly, you are asking me: 'So why do you not tell Parrikar to let these
cases have their final conclusion? Is it not 'dadagiri'??' 

My answer to this is: You claim yourself to be Goan and therefore you show
your concern to Goa and Goans. So, as a responsible Goan, why don't you
directly tell Manohar parrikar to let all pending cases go to logical
conclusions? Why you are showing your reluctance to do so? Talk to Parrikar
directly to get the answer whether it is Dadagiri or other '*giri'! 

About Presidential Pardon & clemency petitions read my message written in
reply to JC's response. Here I will only say, don't jump to conclusion like
JC did in haste.

Towards the end of the Second World War, the Jewish community ,although

a part and parcel of the societies in countries they had settled in.
 However,they managed to preserve their
Mid Eastern culture, their headquarters being their religious places called
synagogues where they revered
the sacred writings collectively known as the Torah. Like the Parsees and
Muslims  they are not idol worshipers.
They did not completely merge with the local population of Europe, somehow
maintained their separate identity
and were very much proud of their race. Today one thinks they were innocent
victims of racialism but they
themselves were racialists towards the indigenous European population.  One
has to see the film '' Fiddler on the
roof '' to understand the nuances of their exclusiveness within European
societies. Then came an Austrian
corporal who served in the German Army during WW 1 .  The same corporal
made them pay a heavy price
during the WW 2. That is history.

The brahmins of India are very much like the Jews in Europe, having
migrated tothe  Indian sub-continent  with their
religious writings called the Vedas, from Central Asia about 3 millennia
ago and behaved towards indigenous
population of India in an obnoxious manner much worse than what the Jews
did in Europe..  The indigenous
Indian giant is yet to wake up but when he does , will there be scores to
be settled ? It is only a matter of time.

  the position of Portuguese in higher education in
  today's Goa...

Here we are once again, ready for a new academic year! The
first weeks of June were spent to plan and schedule new
courses that begin today, June 25, at the Centro de Língua
Portuguesa/Instituto Camões in Panjim.

Given space limitations we can only offer two courses till
October, the intensive courses in Portuguese language and
culture, level basic (A2) and pre-intermediate level (B1).

  Also beginning this week at the University of Goa
  is the M.A.  (Master of Arts) in Portuguese.  The
  slight delay was due to extending the deadline for
  admissions granted by the Registrar.  Of the nine
  new candidates, seven passed the "change of faculty
  test." Again, this is a positive turn in relation
  to the recent past over the profile of candidates.
  There are more young people in India, and specially
  in Goa, who seek an education at the area of
  Portuguese Studies.

Since the reopening of the Department of Portuguese at the
Goa University in 2005-2006, and the reintroducing of the MA
programme in 2006, there have been already 36 students who
enrolled in this advanced Portuguese Studies program that
exists in the subcontinent of India.  This makes for almost
as many between the creation of the Department in 1987 and
2001, the year that activities were provisionally suspended!
In only six years, some 26 Masters in the Portuguese Language
and Culture left the University of Goa.

We will continue to support, under the protocols and
agreements that have been set up with other institutions in
Goa, courses and activities to promote and dissemination of
the Portuguese Language and Culture of Lusophone Countries,
particularly with Smt. Parvatibai Chowgule College, Margao
and the Goa Institute of Management in Sanquelim.

  Are of now, two Institutions in Goa offer a BA in
  Portuguese.  In addition to St.  Xavier College in
  Mapuça, from the 2012-2013 academic year, the
  Chowgule College opens a BA in Portuguese course,
  and will have the support of a teacher formed at
  the Faculty of Arts, University of Porto.  The
  arrival of the Dr.  Gilda Machado, with a Master's
  degree in the Portuguese Language and a Fernao
  Mendes Pinto-Instituto Camões scholarship, will
  certainly takes things forward in Goa on this front.

I take this opportunity to wish everyone a great academic
year and meaningful professional matters, and for those who
will still enjoy their well deserved summer holidays, best

Na Universidade de Goa, também se iniciam esta semana as
aulas do Master of Arts em Português.  O ligeiro atraso
deveu-se ao alargamento do prazo para admissão concedido pelo
Registrar.  Dos 9 novos candidatos, 7 passaram no “change of
faculty test”.  Mais uma vez, é notória uma certa viragem,
relativamente ao passado recente, no que diz respeito ao
perfil dos candidatos.  Há cada vez mais jovens na Índia, e
em Goa em particular, a procurarem uma formação académica na
área dos Estudos Portugueses.  Desde a reabertura do
Departamento de Português na Universidade de Goa em
2005-2006, e a reintrodução do MA em 2006, foram já 36 os
alunos que se inscreveram no mais avançado programa de
Estudos Portugueses que existe em todo o subcontinente
indiano, quase tantos como desde a criação do Departamento em
1987 até 2001, ano em que foram provisoriamente suspensas as
atividades!  Em apenas 6 anos saíram da Universidade de Goa
26 Mestres em Língua e Cultura Portuguesa!

Vamos continuar a apoiar, no âmbito dos protocolos e acordos
que temos com outras instituições em Goa, os cursos e
atividades de promoção e divulgação da Língua Portuguesa e da
Cultura dos Países Lusófonos, designadamente com o Smt.

It was really good to see Manohar Parrikar recently unveil a host of
measures to boost agriculture in Goa. I hope these will be properly
utilised by us Goans. We need self sufficiency in agricultural and
other produce rather than depend on neighbouring states. Every family
should be encouraged to grow something. Those living in apartments can
even grow a few vegetables or herbs for self-consumption.

We do not need to invite polluting industries from outside the state
(where the major number of employees are inevitably non-Goans) to set
up shop in Goa. Instead, with a little boost in the right direction,
Goa is quite capable of becoming a major exporter of vegetables,
fruits, flowers and dairy products. This will also encourage ancillary
units like manufacturing, packaging, preserving, canning, etc. where
local Goans can be employed. In the past, some villages in Goa
produced unique, delectable, high quality cheeses as the people of
Divar, Narvem and Chorao will attest. Sadly, these are not seen
anymore. Can any Goanetters shed more light on this and the processes
involved?

It was also good to hear the new Minister for Forests and Environment,
Alina Saldanha, endorse Manohar Parrikar's policy of a plastic-free
and garbage-free Goa. Rather than only plastic drives and clean-up
operations undertaken by well-meaning citizens and groups (including
Alina Saldanha) we need to STOP littering, spitting, etc. with stiff
fines to the offenders. This will initially bring revenue to the
Government and in the long term, we will have environmentally-concious
citizens, and a CLEAN GOA.

Wonder if there are any means of preventing such drownings...Many of the 
participants are too drunk, to comprehend the dangers of jumping into these 
wells, which are at very high levels at this time of the year...It might be a 
tall task for the likes of the Police and Fire Brigade to cover, but presence 
of lifeguards at such events, could be considered...I don't know if each Goan 
village organizes this event, but a collective effort at the village level with 
all necessary precautions, might help...

Should they not be doing better and upholding the Law? BJP promised and mislead 
people to uphold the Law and curtail corruption; and this 'withdrawal of cases' 
is aiding Corruption!  And now the dirty 'saffronisation' has started. Put on 
your glasses and U may see better; not saffron tinted glasses, never do that! 
It makes one BLIND!
 
BJP wallahs the fascist, casteist, apartheid and segregation liking party, 
should do the right thing and re-instate all those withdrawn cases, and 
facilitate their quick resolution in the courts. Stop adjournments and let the 
courts function! Who is Afraid of the Law? Only the Law breakers!

My answer to this is: You claim yourself to be Goan and therefore you show
your concern to Goa and Goans. So, as a responsible Goan, why don't you
directly tell Manohar parrikar to let all pending cases go to logical
conclusions? Why you are showing your reluctance to do so? Talk to Parrikar
directly to get the answer whether it is Dadagiri or other '*giri'! 

About Presidential Pardon & clemency petitions read my message written in

including derogatory comments against women, I wish he would write in English 
which made sense. 

Furthermore, I'd suggest that he tries to understand WHAT is written and NOT 
try put words in the mouths of others.

IF he had done so, I am almost sure that he would have noticed that I made NO 
mention of what was LEGAL or ILLEGAL, or for that matter, Congress or BJP.

Right is Right, and Legal is Legal. Ditto wrt the converse.

My submission clearly implied that his attempted link between Presidential 
Pardons and a State's decision to drop prosecution, smacked of ignorance. The 
submission also made note of Sycophants and 'Talking Points'.

Now, allow me to further submit that it is quite boring to carry on a debate

[Goanet] Food items served in Goa

I do not know how many people viewed the "Juicy Juice" clip that was
aired on the 'In Goa' Marathi News channel last week. It looks like
even JoeGoaUK missed it. The story was later blanked out by the media
after pressure was brought to do so.

The disgusting, unhygenic practice caught on camera at a juice shop in
Ponda only highlights the need to educate all those who handle food,
about health and hygiene. I have myself seen people at reputed places
picking their noses and then handling food items without washing their
hands. Even if some locals have now become insensitive to such dirty
practices, the Government can at least consider the Tourism industry
and how such incidents can adversely affect that.

The Home Science College can be requested to conduct short-term
courses in Health and Hygiene at a reasonable fee. The Health Services
and the Food and Drug Administration should then insist that anyone
handling any kind of food should have undergone such a course.

It is a known fact that during the Portuguese regime Goa was governed by 
bhattkars or landlords.


Most poskim (female adopted girls) or poske (male adopted boys) were adopted 
by these classes.


While poskim were required to work indoors, poske were assigned outdoor jobs 
such as manning of properties i.e., looking after coconut trees, providing 
fertilizer to coconut trees and fruit bearing trees, plucking and storing 
coconuts in a narlanchem loz (storeroom for storing coconuts), plucking of 
mangoes and other fruits, breaking the wood, repairing thatched roofs, etc.


The landlord and their families did not mingle with the outside world; even 
their neighbors did not know whenever they fell ill or died; everything was 
kept a secret, like the Russians during the same period. Whenever a bhattkar 
or a bhattkarn died, poskim cried for them; they also hired women to cry at 
their funeral.


The poskem was taken into confidence. She was not allowed to talk to 
neighbors; thus, their secrets remained within the four walls. A poskem was 
the only person who could touch or massage the landlady or put ventoz 
(fomentation with cups) on her back - nobody else had that privilege except 
their own kin who did not have that knowledge. A posko also enjoyed the same 
privilege.


In general, both poskim and poske were ill-treated - even food was cooked 
separately for them. But some bhattkars and bhattkarnis treated them well.


Until the 1950s, neither was allowed to make friends with the outside world, 
get married and settle in life. They served their masters and died spinsters 
or bachelors.


Many poskim were sexually used by bhattkars and/or their sons. As a result, 
they gave birth to illegitimate children. Poskim lived in an isolated room. 
Therefore, whenever their masters approached them, they couldn't raise an 
alarm or say 'no' to them; they just gave in and got pregnant - keep in mind 
in those days abortion was not common as is today; it was a very difficult 
task, if not impossible. Therefore, in order to safeguard the name of the 
family, they were allowed to keep the child and brought it up as another 
poskem or posko.


The secret of pregnancy was kept within the family and four walls of the 
house; hence, addition of another poskem or poskem in the family was not 
doubted (by the public). There were some insiders who knew the secret but 
they could not go public with it for fear of being punished - remember most 
immediate neighbors were tenants. These are the poskim and poske who 
inherited a portion of bhattkar's properties, bank accounts and even a small 
dwelling was built for them. Thank God, many of them had a soft corner for 
their illegitimate children.


Post-liberation, with the introduction of a new policy to provide education 
to all, poskim and poske were allowed to attend school and some even 
graduated from colleges, fell in love and got married. Most importantly, 
they received an equal status in the society.


Today, the situation has changed. If you want to adopt a child, you have to 
officially accept it as a child of your own and give her/him all the rights 
of a child. In some cases, adopted children have proved to be better than 
biologically born children. However, the stigma Tem/to umkealo poskem or 
posko (she or he is an adopted child from a family) continues in our 
society!

An interesting subject and one which has still to be researched further. 
Some of the adoptees were also illegitimate children of the adopter and this 
adoption may have been a cover up for a guilty conscience. Others may have 
other views and examples. Some adoptees were treated just as well as their 
legitimate siblings and were not begrudged educational opportunities either. 
There were also others who were mistreated and abused by the adoptors and 
this is a tragedy. Some adopted children achieved such eminent positions and 
did so well in life that they even were able to rescue the family property 
when it fell to foreclosure or was rescued from decay and collapse by the 
adoptees just to preservce the family name.


Let us therefore look more deeply into this phemoninon. Is it trait unique 
to Goa or are similar circumstances common in India.
