An excellent article by Utica, NY resident and Goanetter Dr Gilbert Lawrence,

Interesting, informative and useful for understanding the behaviours of our

There are actual snake repellents available. Need to be connected to power. Its
long rod which goes deep in the ground and it gives out certain sounds which
are repulsive to snakes. I intend ordering it shortly.

[Goanet-News] Taxman hopes to hit a jackpot in Goa casinos

2018-06-10 Thread Goanet News
Taxman hopes to hit a jackpot in Goa casinos
By
Sachin Dave
, ET Bureau|
Updated: Jun 08, 2018, 07.49 AM IST

The intelligence arm of the indirect tax department has served notices to
10 of the biggest casinos in Goa for evading service tax and has
simultaneously initiated an investigation. The tax notices claim the
casinos must pay service tax on their licence fees.

Directorate of Revenue Intelligence (DRI) issued 10 notices to the biggest
casinos asking them to pay tax on licence fees for three years from 2014 to
2016. Casinos are required to pay licence fees to the state government to
be in business.

Some casino owners have challenged the tax demands and taken the matter to
court arguing licence fees they pay to the government is equivalent to
permission and that there is no legal ground for this tax demand.

“Demanding tax on statutory licence fees is absurd. It’s like demanding tax
on passport fees paid to the government. Based on a circular, the DRI has
initiated investigation for applicability of service tax,” said Abhishek A
Rastogi, partner, Khaitan & Co who filed a writ petition in this regard
with the Goa bench of the Bombay High Court.

The tax notices demanded about 15% tax is applicable on the licence fees.
As per the tax department’s rationale, services provided by the casinos can
be categorised as goods as they “reserve the right to enter” for customers.

People in the know pointed out that one or two of the casinos have paid the
service tax, while others are looking to challenge the tax demand.

“Many casinos have paid service tax on reverse charge basis and hence
should not be expected to pay any other indirect tax. Further, since
entertainment tax has been subsumed in GST, similar issues may not arise in
future,” said M S Mani, partner, Deloitte India.

“There needs to be an element of service and quid pro quo for an activity
to be taxable,” said Rastogi.

Tax experts say no such tax demand has ever been made all these years.
Currently, in India only Goa, Union Territory Daman and Sikkim have casinos.

There are 10 casinos in Goa of which about 6 are land based and the rest
are floating casinos and their licence fees ranged anywhere between Rs. 4
crore and Rs. 15 crore per annum. Most of the onshore casinos are located
in five star hotels in Goa where only visitors from other states are
allowed to enter.

A TOI report on March 28 said licence fee for casinos has been increased by
nearly four times in 2018. Casinos would be required to pay anywhere
between Rs. 25 crore and Rs. 50 crore as licence fees annually.

Some tax experts point out that this could mean the issue of licence fees
could even crop up under the GST regime and the tax demand is only set to
go up tremendously say tax experts.

Re: [Goanet] (no subject)

2018-06-10 Thread Bernice Pereira
If that is so, why are we Goans allowing our arable land (fields) to be
landfilled to give way to ugly monstrosities. At the rate at which this is
going on, there will be no fields left at all. There should be a strict law
against this conversion of agricultural land.

I guess one's perspective depends on how far one is from Goa, what other
mistresses (lands) we have got accustomed to in the meanwhile, the
complexities of the life we expect and Goa's ability to sustain that, our
understanding of the process of social change after 1961 (whatever we
choose to call it), whether we think we've gained or lost over time, how
factors like corruption or tenancy or local politics affect us...especially
if nom-residents.

All this goes into shaping our perspectives. Which , in turn, then goes on
to shape and fix our perspective.

Would you agree?
