How come nobody's mentioned NoisePop yet? Anyone going? A bunch of good bands 
are playing like Deathcab for Cutie, Fiver, Magnetic Fields, For Stars, Kyle 
from Fuck, Trackstar, Beulah, Bob Mould, The Loud Family, Alien Crime 
Syndicate, Man or Astroman, oh, and my band Earlimart is opening up for X. 
How rad is that?

Right.  For one, you're mostly talking about St. Paul.  I don't mean to be 
picky, but Minneapolis and St. Paul have completely different 
atmospheres.  For two, they don't build the ice castle every year.  In 
fact, they haven't come close to building a huge one in years.  And I 
really don't want everyone to think that all Minnesotans sit around and 
look at ice all winter.  I would completely disagree about the State Fair 
too.  It's disgusting and there are so many better things you could be 
doing on one of our ten thousand lakes or at a great concert.  Alright, 
here's my disclaimer: I'm feeling argumentative this evening.  Please don't 
take that personally, that's just how I feel.

yes minneapolis is splendid!  i've always mentioned this whenever someone
starts a thread about itbut now i can give some reasons why.
during the winter - during the winter there's all this fun stuff to do. 
there has never been a christmas like a minnesota christmas.  us fine
scandanavian folks enjoy the ice castle which iswell...pretty fucking
huge and costs millions of dollars to build each year.  they put these
beautiful pastel lights up against the ice and it gleams with a
rainbowesque glow.  i used to stand in the large crowd in awe at it wishing
i could go inside and pretending what it'd be like.  i'm such a dreamer :P 
we also have these ice sculpture contests near the capital (ok this stuff
is in st. paul technically but it's all the same ;)) where these sculpture
artists work on different figures and i think they're the only people in
all of minneapolis who hope that it doesn't get warm.  we also have these

yeah there's a portland, maine.  portland oregon is a metropolitan area as
you know i'm sure (i don't wanna sound condescending, sorry, i'm not trying
to be :P) and i think portland, maine is moderately large as well...but not
quite metropolitan size.  they're both kinda water cities tho so it doesn't
surprise me.  i dunno if either are really close to the shores or anything
but...they're in water states anyway ;)

All,

Indeed, there is a city in Maine called Portland.  No,
not the place with the TrailBlazers, and Modest Mouse
has never played there, but it does exist.  The first
time I realized this was when I looked at my driver's
license and it told me that I live there.  

Lobster Land is actually quite a nice lil' city, don't
let the fact that it is in Maine fool you.  In case
you happen to drive through it on your way to.
uh nowhere, here are my recommendations:

Music Store:  Russ has mentioned Newbury Comics,
always a reliable.  Bullmoose Music ain't too bad.

Movie Theater:  Oh boy, where do i start?  The
Nickelodian Cinema is $1.50 a seat all the time.  "The
Movies" is cozy and shows good indie films.  The
Keystone serves food during your movie, decent food.

Restaurant:  Portland has the most restaurants per
person in the U.S. with the only exception being San
Francisco.  Fresh Market Pasta is nice.  If you're
lookin' to get loaded, try Gritty McDuffs, an all
american watering hole.

Concerts:  I've kinda lived in Maine (when not here at
school) for a year and a half, and the only show I've
seen there was Moby.  There's really no reason for
bands to go to Portland, so they generally don't.  My
parents didn't move there for the indie scene.

Since most of you will never be in Maine, I apologize
for cluttering your inbox, but maybe one or two people
might be in the area and find this handy.. nope,
probably not.

Please get yr terms straight.  "Fair use" refers to the use of
copyrighted material in a manner which does not attempt to sabotage the
commercial viability of the original "owner" of the material.  The most
obvious example of this is the band Negativland, who create songs which
liberally sample commercial advertisements and commercial music without
permission.  The argument for "fair use" is that creating such sound
collages is in no way infringing upon the sales of the original
material.  For more information on this, refer to the Negativland
website, www.negativland.com - and while yr there, order some of their
music, as they are one of the most essential artists of the past two
decades.

Russ is distributing material for free, some of which really is
copyrighted.  The Japanese EP, for example - just because it isn't
available commercially in America does not mean the copyright does not
still extend to it.  This would be a good time to point out that
importing a CD is illegal, period - even though almost any record store
will order imports for you, it is technically quite illegal.

I'm not some big advocate of copyright laws - I very much support
Negativland and their attempts to reform "fair use" laws.  However,
copying an entire commercially available song and distributing it for
free IS something I am against in principle.  In practice, yes, if these
are tracks which are nearly-impossible to buy, I don't have a problem
with it.  But it's a free world - if someone is enough of an idiot, and
has enough cash to spare, to pay $50 for a CD of rare Modest Mouse
tracks, I say let PT Barnum's Rule stand: There's a sucker born every
minute (and why not take their money?).

being a fellow new englander i love maine
and i know what youre talking about when you mention the backwoods
rednecks that arent really as bad as redneck rednecks. my small town in
new hamsphire is just like that. lots of inbreeding and whatnot but no
one is really downright violent or activist redneck. i like maine. its a
nice place to be. very scenic. plus they have fun park in saco. 
and a newbury comics in portland.

Slander I believe inherently involves spoken word.  That is what seperates
it from libel which demands written statements.  Either way the 
statements must be proven to be lies.  It is not enough for the person 
accused to say they are false.  Once Russ or any person is accused of the
crime of slander or libel the burden of proof is on the accuser.  Russ
would only have to show that it was reasonable for him to think his 
statements were true, and I think that the wankers e-mails show this quite
clearly.

Hello all - 
  I'm wondering the validity of this ebay guys statement that this is in fact 
"slander."  For one, how can any court of law charge someone with slandering a person 
who is himself engaging in an illegal activity.  Secondly, as far as I can remember, 
email and other forms of internet related items generally cannot be considered 
"slander" but then again, that was aways ago, and I'm sure in a different state.  It's 
sad that such a person can cause Russ to have to put up a password because I know I 
was looking forward to downloading the new San Fran shows (especially the second one, 
since I had tickets but ended up not being able to go). In fact, I had tickets to see 
the mouse three times twice in July in Seattle and once in October in sanfran, and i 
only got to see them once because of the missed show in sanfran and the damned doormen 
at the showbox or wherever the 21+ show was in Seattle, maybe the croc.
  anyhow, it sucks that the actions of one hurt the community as a whole.  in such 
cases, i think that "one" must be removed from the community.  Furthermore, how can he 
call himself a mouse fan and yet, when we call attention to the fact hes trying to 
profit off the mouse, and he doesnt back down.  which hick state was he from again?
  and, i guess I'll add my little plug because its been about 6 months since ive said 
anything, for those folks who are in the bay area, actually closer to san jose, and 
can get reception of KSCU 103.3 fm, I have a Northwest and Independent Rock show on 
fridays from 4-6p.  You can listen to it over the internet too by going to the KSCU 
site @ http://www.kscu103.com and clicking on the webradio.com link.  Also, my website 
has links, at http://www.geocities.com/kscugrendel.  ok, I'm done plugging it, I just 
need some more listeners who know Northwest music.  I always play the mouse and sunny 
day, and built to spill, and mxpx, and severna park, and a lot more, but generally 
people call up and request punk,. so my show has been degenerating into a punk show 
(not that i do not like punk, my show in its truest sense, though, is a celebration of 
Northwest music).  Ok, thats all.

way i see it, no one is really claiming ownership over these mp3s, are they?
they are somewhat readily available w/o too much hassle or haggling for
them...most sites are ratio-driven, you must give in order to get...not this
one in questionas long as i have been computer-active, which sadly has
only been about a year...mr russ has been about as neighborly and cool as
anyone could ever dream of, especially when i feel like the biggest leech
taking files that he had to do some work to obtain,code and post...

if he wants to try to keep things less shady in the "scene", so be it...i
think the least everyone could do is watch his back and learn from
this...next week it could be someone selling the getupkids show from t3000
or one of rosco's boots
