That thing sticking up out of the water almost exactly dead center all  
of a sudden becomes what my eye wants to focus on with this framing. I  
think it would be stronger if that were cloned out.


Beyond that, yes, I like it more. I'm not sure about the perfect half  
top/half bottom water line, it seems a bit too symmetrical, but that's  
something you could diddle with.

I shot some stuff i'll post soon, and maybe that might tell.

chickens to trade?
I understand those who have already lost their homes to forclosure may
see no releaf.  My understanding is that the majority of the problems
are due to bad loans in California and Florida.  And a good case can
be made that these were people just plain foolish, overspending on
their housing.  I don't care about bailing them out, just not having a
2nd Great Depression.

It doesn't really work out to be that much different. With that kind

prints would take more time as that is gated by the speed of the  
printer.

images and getting rid of the few that didn't work and then
processing all the rest rather than 10-20 shots like you are doing.

But, I do agree that shooting raw and then a quick basic tweak in the

If sharpness is your primary criteria, remember that the K10D has a  
weaker antialiasing filter than the D200 which means a bit more detail  
snap to the images, straight out of the camera, with a slight

I don't know what you consider "minimal PP".

All of my exposures are captured in RAW format and processed in  
Lightroom, from all my cameras. I apply my own develop preset on  
import and do a little frame by frame tweaking, but I only rarely  
spend more than, say, two or three minutes in image processing on a  
given image. Once in a while I need to do something more drastic/ 
radical, or I try several different renderings with different ideas in  
mind for a given exposure, but it's a rarity.


I can typically take 200-300 exposures, import, sort, grade and pick  
10-20 out of that, produce finish prints and web renderings in about  
half an hour to an hour (if I have a deadline to push me... ). That's  
fairly minimal to me. :-)

Actually, you need to have the work registered to sue for Statutory
Damages today, otherwise all you'd receive is the equivalent to
'compensation for use', exactly what you'd get under the new law.

The gist of the law is it provides a statutory framework for
determining whether or not a work is orphaned and a legal test for
what level of diligence is required for determining this. If it truly
does require 'due diligence', it will be extremely difficult to

It is only a provision that you MAY wish to register your work. If you  
do not, you are still protected exactly as you are today. If you do  
register a work, then you are able to sue for damages as well as  
compensation for use.




Then that means I will NOT be protected EXACTLY as I am today, since 
TODAY, I CAN sue for damages ... and under the provisions of this act 
will NOT be able to sue for damages in the future unless I take the 
extra step of registering my works.

Pentax Sighting

I'm watching a docu-drama about the Challenger accident. As they do
with these things nowadays they have re-enactments of pivotal events.

In the scene where engineer Roger Boisjoly first records the evidence
of damaged booster rocked section seals a year before the accident,
the actor is using a ME Super with an AF-160 flash.

I'm bored, and thought I'd share.

Any image you want to protect from infringement has to be previously  
registered. If it's not registered, the infringer can claim immunity  
from damages because he "believed" it was an orphan work. That  
"belief" is all the defense he'll need under this act.


No, the infringer has to PROVE he has searched with due diligence  
BEFORE the work was used. Proof has to be in documented form.


And, BTW, once the infringer has invoked his "I honestly believed it  
was an orphan work" defense, not only can you not obtain damages,  
you won't even be allowed to stop him infringing you copyright.  
Under the law, he'll have a "fair use" right to continue using your  
work without giving you a red cent.


Again, not true. IF you have the work registered, you can collect  
damages. If not, your copyright by current standards forces the  
infringer to PAY YOU FOR THAT USE at a rate defined by current  
standards. If they continue to use it, they continue to pay you. If  
you ask them to stop, they MUST stop, and pay you for use up to that  
moment.


The part of the proposed law that is hard on artists and media  
creators is that it is up to the copyright holder to "discover" the  
unauthorized use before they can do anything about it. Methods of data  
basing or publishing your ownership of all your works are still being  
debated, allowing searches to be successful by some sort of matching  
description like the metadata and/or a checksum of the data contained  
in a predetermined sector of the primary subject of the image. Some  
sort of search engine would have to be put in place to crawl online  
for evidence of your property, as well as some way for users of your  
work to have to publish online that use even if it is not used online.


As far as costs for registering, what is being looked at are ways to  
register "collections" of works, like "All photographs of copyright  
holder in his/her titled collection 'My life from 1990 thru 2008' or  
'Joe Schmoe's images of nature as he sees it'" as one work, registered  
for a fee like $35. The perceived downside of any publication of your  
works in order to protect them puts them out there to more easily by  
harvested by infringers, though I imagine that low res. versions with  
visible heavy watermarks through the center would suffice to claim the  
work as yours yet make it unusable by someone wishing to infringe.  
Still a burden for the artist to collect everything and publish it for  
protection.


So you see, there are many ways to protect your work that are yet to  
be worked out, and I'm sure they will be. There is no finished take on  
the entities to be created by which you CAN register your works  
allowing you to collect damages for infringement, nor on the fees for  
such registration.


As I have posted elsewhere, I personally am tired of and amused by the  
artist's community running around online crying "The sky is falling"  
when few if any know what the sky is,  what color it is, or where it  
may fall, if at all. I have as yet to see any post that correctly  
states the truth as it is currently, including my own. But I think  
reading the legislation in situ, and as much published by both sides  
will give you a better sense than reacting to the bulk mail pleas for  
help to defeat a law that may in fact benefit creators of content art.


If you really want to be on the cutting edge of this legislation, hire  
a lawyer to advise you and keep you up to date on the process.

See, thats just it. For the most part, static images like a head shot
or a flower etc, are ok, in my opinion.

Its just the action, jumping shots that are less than stellar, and i
cannot figure out why.

I sent a few samples to Daev S. some from the D1H and some from the
D200, using same lenses and same subjects, same weather and settings.
I felt the action ones were very soft, Dave thought they all looked
ok, the D1 stuff had more saturation he thought, and thus looked
sharper.

I am trying the various modes in the D200, Vivid, custom etc, and am
trying to see id there is a difference using them,.

I shot some stuff i'll post soon, and maybe that might tell.

series of targets with red green and blue edges. Examine the results  
and evaluate whether there is any truth to this alleged red channel  
deficiency first.


Another friend is working with the D200 quite a lot ... He does  
graphically inspired abstracts with lots of highly colored  
subjects ... And I have seen no evidence of unsharpness in his  
captured images.

colour, would it not.

I'm just trying to find a work around, instead of trying the D300 or

Hi Frank,

I know I have been too quiet.  A lot has been going on to keep me busy - 
I have not even been shooting :-(


Let's see, the snakeskin would come into play quite readily.  Being that 
I have a small sample of them I can go traditional or not on these.


Trying out some film that may have gone through temperature extremes, I 
was shooting my back yard vista yesterday.  I had the 645n (165 print), 
the *ist D, and the 67 (100 slide) side by side shooting the scene.


Curious to see how the shots will turn out.

It was a joke, Bob. Didn't you read the part where I said, "Do I  
really need a smiley." Guess I did. It was a sarcastic response to  
the outcry over Godders alert regarding copyright laws. Sheesh. Think  
before you flame.

Having shot the last several games of my daughter's, I can relate to

He was still pretty darn competitve around two years ago, when I last
watched him - he was driving go-karts at a fundraiser at the San Jose
ChampCar race.  I'd met him a couple of times before that (as well as
seeing him in pit lane quite a few times).  The first time I got to
talk to him was a year or so after Michael Andretti started driving
for Newman/Haas racing - while he (PJN) generally didn't want to be
photographed at the races, he was happy to pose beside the car as
"Paul Newman, race car owner", rather than "Paul Newman, celebrity".
I also got to chat with him for a while at the St. Petersburg race
where Sebastien Bourdais made his debut, and got to see a twinkle
in those blue eyes when we talked about Sebastien's potential.

Sad to see him pass, but it wasn't really a surprise - he looked
pretty frail last year, and he wasn't at the IndyCar race last
month.  not only was he said to be resting at home - his family
had gathered to be with him.
