What is the correct way to do when one takes pictures of people like the one below? Do you approach them after taking it, show it to them and ask them for permission to keep/publish it? How do photographers do in such situation? I've taken photos of people in Mexico, sometimes without them knowing it, and I really don't know whether it's fair/moral to publish them or not. A. You can publish any picture taken in a public place in an editorial context or gallery. You can't use it to promote a product or service without a model release. Sometimes I approach the subjects, tell them I've taken a photo and ask if they'd like me to send them a copy. This time I chose not to. I rarely ask for a model release on the spot, but I usually have one handy. The legalese in the release is frightening to most. However, if I think I have something of real value, I will ask for a release. I have secured a few, including one for the portrait of the African American man whose pic is on the opening page of the Pentax Gallery. It's generally easier to get a release if you make a print for the subject and deliver it to them in person.
