 Indonesia: Government proposes 21 million hectares of plantations to meet 
climate targets


There are two realities in the forestry sector in Indonesia. In one, the 
forests continue to be destroyed, peatswamps are drained, forests are logged, 
burned and replaced by industrial tree plantations. Indigenous Peoples' and 
local communities' rights are bulldozed along with the forests. Meanwhile, in 
the other reality, trees are planted, forests are restored and greenhouse gas 
emissions will soon become a thing of the past. 
  Occasionally, these two realities collide. In December 2009, Cornelis, the 
Governor of West Kalimantan, was giving a speech about the government's One 
Man, One Tree campaign, but was repeatedly interrupted by the noise of logging 
trucks loaded with newly logged timber on the nearby Trans-Kalimantan highway. 
I'm making a speech about the tree-planting movement and a truck carrying 
piles of timber passes by, the Jakarta Globe reported him as saying. If we 
ask the drivers, I don't think they will have permits, he added. After four 
trucks had interrupted him, Cornelis asked the police to stop any more logging 
trucks for driving past. Just until he finished his speech.
  In September 2009, Indonesia's President, Susilo Bambang Yudhoyono, told a 
G-20 summit in the USA that Indonesia will change the status of our forests 
from that of a net emitter sector to a net sink sector by 2030. He also 
announced that Indonesia planned to cut its emissions by 26 per cent against 
business as usual by 2020. 

  Yudhoyono repeated the 26 per cent target during the climate negotiations in 
Copenhagen. During the talks Indonesia said that it was seriously committed to 
reducing carbon emissions by 26 percent by 2020, however, the President lied 
about his seriousness, Walhi's forest campaigner, Teguh Surya, told the 
Jakarta Post. 

  As Indonesia's forests burn, the government is looking forward to massive 
expansions in the oil palm and pulp and paper industries: the two industries 
directly and indirectly responsible for many of the fires. There are plans for 
20 million hectares of new oil palm plantations and 9 million hectares of new 
pulpwood plantations. And the Forestry Ministry plans to hand over 2.2 million 
hectares of forest to mining companies over the next ten years. Bad as all this 
is, things could soon get much worse. 

  On 6 January 2010, Zulkifli Hasan, Indonesia's Forestry Minister, revealed 
the government's cunning plan for meeting its emissions target: 21 million 
hectares of new forest. If the scenario described proceeds, if the planting 
proceeds, we can reach more than 26 percent, Hasan told journalists in 
Jakarta. An area of 500,000 hectares is to be planted each year, at a cost of 
US$269 million. 

  Of course, the 21 million hectares of new forest will not be forest at all. 
It will be plantations. That's 20 million hectares of oil palm plantations, 9 
million hectares of pulpwood plantations and 21 million hectares of carbon 
plantations. A total of 51 million hectares of proposed plantations. 

  Indonesia has an appalling record of corruption and fraud associated with 
plans to promote plantations. A report published recently by the Centre for 
International Forestry Research (CIFOR) looks in detail at the Indonesian 
government's Reforestation Fund, which started in 1989 under the Soeharto 
dictatorship. Much of the money went to companies with close ties to political 
elites. The companies cleared forest, lied about the area planted, invested 
little in the area and pocketed the cash. A 1999 audit by Ernst and Young found 
that more than US$5 billion was lost from the reforestation fund between 1993 
and 1998. The audit was not released publicly. 

  In addition to the money sloshing around for the proposed plantations, vast 
sums of money could pour into Indonesia through REDD schemes. According to a 
report by the Indonesian Forest Climate Alliance, Indonesia could receive 
US$4.5 billion a year if it were to reduce deforestation by 30 per cent. 
Christopher Barr, co-author of the CIFOR report, points out that the situation 
has improved since the fall of Soeharto in 1998. But without improved financial 
oversight, The problems that have plagued the Reforestation Fund over the last 
20 years are likely to reoccur, Barr told Reuters. The CIFOR report notes that 
During both the Soeharto and the post-Soeharto periods, weak financial 
management and inefficient administration of revenues by government 
institutions at all levels undermined effective use of the Reforestation Fund.

  The Indonesian government's enthusiasm for REDD provides another example of 
two realities existing in parallel. In the fake reality of REDD proponents, 
corruption will disappear. Palm oil and pulp and paper companies will be paid

Jakarta (ANTARA News) - All party factions in the House Bank Century Inquiry 
Committee have arrived at the conclusion that irregularities did occur in the 
bank`s fund flows, a committee member said. 

With regard to Bank Century fund flows, all the factions agree that 
irregularities have happened. So the score (of factions maintaining the fund 
flows were legally flawed and those considering them clean) is 9-0, Inquiry 
Committee member Hendrawan Supratikno, said at the parliament building here 
Wednesday.

He said the consensus about irregularities having taken place in the fund flows 
was reached after each of the factions made a deeper study of the relevant 
facts and verified two main findings of the investigative audit the State Audit 
Board (BPK) had conducted on Bank Century`s finances. 

According to the BPK audit findings, there were strong indications banking laws 
or regulations were violated and corruption had happened in Bank Century fund 
flows. 
These BPK audit findings were retraced and eventually confirmed by a Committee 
team, Hendrawan, a legislator from the Indonesian Democracy Party-Struggle 
(PDIP), said. 

Earlier, Hendrawan had told a Committee session, a PDIP team had discovered a 
number of strange things in Bank Century fund flows in five cities, namely 
Jakarta, Medan, Surabaya, Denpasar, and Makassar. 

Among the strange things were the existence of a Bank Century client whose name 
was not to be found in the bank`s database, an inordinate surge in fund 
withdrawals from the bank in the period following its receipt of a Bank 
Indonesia (BI) short-term financing facility (FPJP) and temporary (government) 
capital participation (PMS) funds.

Another oddity was the existence of a Bank Century account containing funds 
from unidentifiable sources. 

The PDIP faction in the House Inquiry Committee had concluded that its field 
findings constituted strong clues of banking law violations, money laundering, 
and corruption, he said.

JAKARTA--Presiden Susilo Bambang Yudhoyono meminta agar pembangunan keadilan 
sosial selama periode pemerintahan lima tahun lalu perlu ditingkatkan pada 
periode 2009-2014. Kesimpulan itu diambil setelah presiden mengamati secara 
langsung proses pembangunan sosial di lapangan.
Pembangunan keadilan sosial tidaklah gampang, kata SBY saat mengunjungi Pusat 
Pelayanan Kesejahteraan Sosial (PPKS) Anak di Bambu Apus, Jaktim, Rabu (17/2). 
Menurut presiden, para abdi negara yang bekerja di bidang keadilan sosial juga 
harus memberikan peluang untuk memperlancar sistem itu. 

Dalam pembangunan keadilan sosial, presiden memandang pentingnya sinergi tugas 
dan tanggung jawab antara pemerintah pusat dan daerah. Alasannya, kepala daerah 
merupakan ujung tombak pembangunan, pemimpin paling depan yang berkaitan dengan 
masyarakat,

Sistem harus mengatur apa yang mesti dilakukan bupati dan wali kota di seluruh 
Indonesia dengan dukungan pemerintah pusat dan pemerintah provinsi, kata SBY. 
Segi-segi itu, ujarnya, harus diatur secara benar. 

Presiden menilai ada subjek dan golongan yang harus masuk dalam kebijakan 
khusus. Golongan tersebut adalah keluarga yang sangat miskin, penyandang cacat 
berat, golongan lanjut usia, dan anak.

Apa yang saya lihat, rasakan, dan amati, terutama ketika bertugas lima tahun 
yang lalu, kita perlu meningkatkan derajat dan kualitas keadilan sosial bagi 
seluruh rakyat indonesia, kata presiden. 

Presiden mengatakan, dirinya ingin pada masa pemerintahan ini bisa menata 
kembali sistem, undang-undang, kebijakan, dan program aksi untuk meningkatkan 
keadilan bagi rakyat. Oleh karenanya, tutur presiden, hal itu akan menjadi 
topik tunggal dalam sidang kabinet pada Kamis (18/2) karena mewujudkan keadilan 
sosial merupakan kewajiban pemerinath dan amanah konstitusi.

JAKARTA--Pengurus Besar Nahdlatul Ulama (PBNU) tak sepakat dengan rencana 
pemidanaan pelaku nikah siri.Sangat tidak logis kalau nikah siri dihukum, 
ketika perzinaan, free sex, dan kumpul kebo dianggap bagian dari
hak asasi manusia karena suka sama suka, kata Ketua PBNU Ahmad Bagdja di 
Jakarta, Rabu.

Dikatakannya, dalam Islam nikah siri sah secara legal syariat, sepanjang ada 
wali dan dua saksi, meski belum dinyatakan lengkap karena belum diumumkan dan 
diresepsikan. Karena Rasulullah juga memerintahkan akad nikah tersebut 
diumumkan dan diresepsikan (walimah), kata calon kuat ketua umum PBNU 
pengganti KH Hasyim Muzadi itu.


Sekalipun perintah itu hukumnya sunah, bukan wajib, kata Bagdja, perlu 
dilaksanakan guna menghindari salah faham sosial, gosip, fitnah, serta menjaga 
keamanan batin keturunan.  Kalau kesempurnaan itu akan diambil oleh aturan 
negara, kata Bagdja, cukup dengan memberlakukan kewajiban administratif, dan 
pelanggarnya cukup dikenai sanksi administratif, misalnya negara belum mengakui 
para pelaku nikah siri sebagai satu keluarga. Kalau pakai pidana, nantinya 
yang kawin siri dapat saja mengaku kumpul kebo kemudian bebas berdasarkan suka 
sama suka dan hak asasi. Aneh nggak? katanya.


Oleh karena itu, lanjut mantan ketua umum Pergerakan Mahasiswa Islam Indonesia 
(PMII) tersebut, masalah nikah siri sebaiknya dikembalikan kepada hak perdata, 
bukan pidana. Terkait alasan pemidanaan pelaku nikah siri demi menjaga hak 
perempuan, menghindarkannya menjadi korban, menurut Bagdja, penghormatan 
terhadap martabat wanita diukur menurut tingkat pertanggungjawaban laki-laki 
terhadap kehidupan perempuan. Di dalam free sex justru sama sekali tidak ada 
perlindungan, bahkan pelecehan, kata mantan anggota Dewan Pertimbangan Agung 
(DPA) tersebut.

JAKARTA--Dewan Dakwah Islamiyah Indonesia (DDII) meminta kepada Mahkamah 
Konstitusi (MK) agar  tetap mempertahankan UU No 1 tahun 1965 tentang 
Penyalahgunaan dan atau Penodaan Agama. Harapan itu disampaikan dalam sidang 
pleno uji materi UU tersebut di MK, Rabu (17/2).

Ketua Umum DDII, Syuhada Bahri, yang mewakili pihak terkait memaparkan, bahwa 
UU No 1 tahun 1965 tidak bertentangan dengan Undang-undang Dasar 1945. UU No 1 
tahun 1965 sejalan dengan UUD 1945 untuk menciptakan hidup yang damai, 
toleransi antaragama, dan saling menghargai,'' kata dia.

Syuhada menambahkan tidak pemeluk agama yang rela jika agamanya dinodai.''Bagi 
kami agama Islam adalah agama yang baik,'' tutur dia.

DDI tidak akan membiarkan jika ada orang yang memeluk Islam tetapi mengakui 
dirinya Tuhan selain Allah swt. DDII juga tidak akan membiarkan jika ada orang 
yang meragukan Alquran.

''Apa kita akan membiarkan hal itu atas nama kebebesan,'' kilah Syuhada. Ia pun 
mengatakan,  bahwa DDI tidak ingin Indonesia menjadi arena tinju tanpa wasit. 

Sejak Orde Lama dan Orde Baru, UU No 1 tahu 1965 sudah mendukung keberagaman 
beragama. Pada  Orde Reformasi juga mendukung penuh tapi tetap menjunjung 
kebebasan yang tidak berdasarkan syahwat hedonistik.

Consider this demographic projection for the UK, and ponder its implications 
for a moment: within five years, the majority of babies will be born to 
unmarried parents. 



However, before you put this down to yet another example of Western immorality, 
just remember that all these babies will have the same legal rights as those 
born to married couples. 

This trend is part of the wider decline of marriage as an institution. 
According to a recent study, the figures for people getting married in Britain 
is at its lowest ever since these statistics began to be compiled nearly 150 
years ago. 



In 2008, only 21.8 per thousand adult men of marriageable age actually took the 
vow. At 19.6, the figure for women was even lower. And the average age for men 
getting married for the first time was 32, and for women it was nearly 30. 

These figures reveal not so much disillusionment with the institution of 
marriage, as much as they do a widespread rejection of religion. 



Church marriages are still favoured by the middle classes, but more for the 
pomp and glamour of the wedding dress worn by the bride, and the finery sported 
by the guests. Indeed, attendance for church services has fallen steadily, and 
most Brits only go to church for weddings and funerals. 

A glance at the European table reveals that the belief in a god is generally 
quite low in all the major countries. 



Sweden, with only 23 per cent of the population believing in a deity, is the 
least observant, with the UK at 38 per cent. Germany and France are similarly 
atheistic or agnostic. Interestingly, Catholic countries seem to be more 
staunchly Christian, with Poles, Spaniards and Italians being among the most 
fervent of believers. 

Indeed, a lack of belief in a supreme being has long been the hallmark of 
Western intellectual thought since the Enlightenment of the 18th century. 



Hence, lawmakers have tried to separate religion form politics, few more so 
than the Founding Fathers of the United States. Both Thomas Jefferson and 
Benjamin Franklin were fiercely agnostic in their views. 



Scientists, too, have tended to question the belief system they were born into, 
as revealed by this quotation from Albert Einstein: Science has been charged 
with undermining morality, but the charge is unjust. A man's ethical behaviour 
should be based on sympathy, education and social ties and needs; no religious 
basis is necessary. Man would indeed be in a poor way if he had to be 
restrained by fear of punishment and hope of reward after death. 

Many have condemned modern Western civilization for its 'godless' ways, 
pointing to widespread cohabitation between men and women, men and men, and 
women and women. Alcoholism, nudity and drug-abuse are also frequently cited. 



All these lifestyle choices are mentioned in arguments over the superiority of 
Eastern religions and societies. Yet the firm belief in religion and an 
afterlife in our part of the world do not necessarily translate into better 
societies. 



In the Transparency International table for global perceptions of corruption 
for 2009, there is not a single Muslim country in the twenty most honest 
states. However, seven Muslim countries figure among the ten most corrupt 
states. 



Interestingly, Sweden, the most godless state in Europe, comes in at joint 
third with Singapore as the least corrupt country in the world. 

There is an argument that corruption is a function of poverty, and once 
societies have acquired a measure of economic well-being, they tend to become 
more honest and accountable. While there is some truth to this assertion, how 
to explain the fact that Saudi Arabia, one of the richest countries in the 
world, is listed as 63rd by TI? 



And Kuwait comes in at 68. Clearly, then, there is little direct linkage 
between religion and morality. 

Nevertheless, billions around the world continue to believe deeply in the faith 
they have grown up in. They derive comfort from following the belief system of 
their forefathers, and most of them have never felt the need to question it. 



Indeed, the poor obtain solace for their wretched condition with the promise of 
compensation in the afterlife. And the rich in our part of the world try and 
assuage their guilt by giving alms generously, thereby hoping to buy a place in 
heaven. If only they would pay their taxes with the same zeal, we might be able 
to make a better world in this life. 

In religiously inclined societies like Pakistan, we are fond of criticising 
Western materialism, while holding up our supposed spirituality as being 
superior. 



Even the millions of Muslims who have chosen to migrate to the West make the 
same assertion. However, I have not noticed any of these people denying

Manila. Seventeen million Asians have fallen into extreme poverty due to the 
global financial crisis, the Asian Development Bank and the United Nations said 
on Wednesday. 

And another 4 million could this year slip into the same situation due to the 
effects of the slump, officials from the two organizations said launching a 
joint report on poverty alleviation here. 

This is on top of the 900 million people in Asia who are already living in 
extreme poverty, defined as living on less than $1.25 a day. 

Asia had shown great progress in bringing people out of poverty in recent 
years, ADB vice president Ursula Schaefer-Preuss said. But gains are being 
reversed due to the economic crisis, she said. 

UN Under-Secretary General Noeleen Heyzer said that people in the export and 
tourism sectors in Asia had lost and were still losing their jobs due to the 
crisis, which swept across the globe in late 2008. 

Less foreign investment, aid and remittances from overseas workers were further 
hurting Asia's poor, Heyzer said. 

The report said more women, who form the majority of Asia's low-skilled and 
temporary workforce, than men had been forced back into extreme poverty due to 
the crisis. 

UN Assistant Secretary General Ajay Chhibber said the Asia-Pacific was doing 
quite well in areas such as infrastructure in achieving the UN's Millennium 
Development Goals that are aimed at bringing people out of poverty. 

But it lags woefully behind in social issues, he said. 

Even Latin America and Eastern Europe had better social protections than Asia 
such as pensions and unemployment insurance, Chhibber said. 

Only 2 percent to 3 percent of gross domestic product in Asia goes to such 
social protections, he said, adding that this figure should ideally be 4 
percent to 6 percent. 

This meant large numbers of Asians could fall back into poverty during the 
crisis or even during natural disasters, he said. 

The report said the could protect itself from future crises though regional 
cooperation. Regional cooperation would also be particularly valuable for the 
trade in food, and could include grain banks that are maintained in each 
country but readily accessible to others. 

Expanding Asian monetary and financial coordination would be particularly 
useful to reduce external shocks such as with the global financial crisis. 

Asian nations could consider diversifying their export markets to become less 
dependent on demand from the West, the joint report advised. 

By lowering trade barriers and creating more opportunity for the Asia-Pacific 
region to invest within itself, there can be a greater insulation against such 
crisis in the future.

  Washington-Former President Gen. (Retd) Pervez Musharraf, who resigned 
under pressure two years ago, has said that the experiment of democracy was not 
as successful in Pakistan as it should have been.

  Giving an interview to CNN, Former President said that if the condition 
of public can not be changed with democracy, then an analysis must be carried 
out to check the loopholes in democracy. 

  He also said that there is a difference between Taliban and local 
Pakhtoons; however he does not know much about unbiased Taliban. 

  While answering a question regarding becoming an ambassador or army 
chief, he replied that he wants to be an army chief because he is a warrior and 
is in love with the uniform. 

  Talking about Pak-India tension, he said that this region is considered 
to be a nuclear flash-point on an international level; where as peace in this 
region is very important. 

  Answering to a question, he said, he can return into a politics. Every 
Pakistani - every patriotic Pakistani - feels it in his heart and I also do 
that at this moment Pakistan is not doing too well, he said in an interview.

  So, if I can contribute anything to the country and if the people of

  Musharraf stepped down in August 2008 as the ruling coalition began 
taking steps to impeach him.

  He had swept into power in a bloodless coup in 1999, and ruled for almost 
a decade before his party, Pakistan Muslim League-Q, was dealt a significant 
blow in parliamentary elections in 2008.

  Musharraf said he was not sure if he would create his own political party 
should he return to politics.

  I don't know as yet. One has to address all these issues. But one thing 
is sure: I believe very strongly in the military maxim, 'Never reinforce 
failure.' So I wouldn't like to reinforce failure.

  The former president said Pakistan has failed politically. Democracy in 
Pakistan has not really ever been very successful. And I mean 'successful' when 
we expect democratically-elected governments to perform for their country, that 
the country should be moving forward - progressing - and the welfare and 
well-being of the people (are) being addressed, he said.

  If that is not being done, I think we need to look into ourselves what 
is it lacking in the democratic political dispensation in Pakistan.-Online

Americans topping the chart, a survey has found.

Brazil comes second in the poll of more than 5,000 globe-trotting Britons. 

Spain is third while Australia - with its blonde, tanned surfers - was voted 
into fourth place. Italy is fifth, Sweden sixth and England seventh in the poll.

India - home to Bollywood beauties Aishwarya Rai Bachchan, Kareena Kapoor and 
Katrina Kaif, and heartthrob Salman Khan - is eighth. France follows at nine 
and Canada finishes off the top 10.

America has got a lot on offer and boasts of some of the sexiest people on the 
planet, a spokeswoman for www.OnePoll.com - which carried out the survey - was 
quoted by The Daily Telegraph as saying. 

The likes of Jessica Alba, Jennifer Aniston and Brad Pitt (all Hollywood 
actors) help America's image as a hot bed of good looking people. But with a 
population of more than 300 million, they do have an unfair advantage.

But in fairness, when you think of good looking countries, Sweden, Italy, 
France and Brazil all spring to mind before us lazy, pale Brits, the

Pakistani army confirms arrest of Taleban commander

ISLAMABAD: The Pakistani military confirmed on Wednesday that the Afghan 
Taleban's top military commander, Mullah Abdul Ghani Baradar, had been captured.

US and Pakistani officials who declined to be identified said on Tuesday 
Baradar had been captured in the Pakistani city of Karachi in a raid by 
Pakistani and US agents.

At the conclusion of detailed identification procedure, it has been confirmed 
that one of the persons arrested happens to be Mullah Baradar, the military 
said.

It declined to say where he had been caught or to give other details, citing 
security reasons.

The capture came as US forces spearhead one of NATO's biggest offensives 
against the Taleban in Afghanistan in an early test of US President Barack 
Obama's troop surge policy.

US officials and analysts said it was too soon to tell whether Pakistan's 
cooperation against Baradar would be extended to other top militants on the US 
hit list.

The arrest followed months of behind-the-scenes prodding by US officials who 
saw inaction by Islamabad as a major threat to their Afghan war strategy.

Pakistani Interior Minister Rehman Malik had on Tuesday declined to confirm 
Baradar's capture, saying a large number of people had fled operations by NATO 
forces in Afghanistan to Pakistan and many had been picked up.

He denied that there had been any joint operation by Pakistani and US agents.

Though nuclear-armed Pakistan is a US ally, anti-US sentiment runs high and 
many people have long been suspicious of the US-led campaign against militancy 
and oppose any US security operations in Pakistan.

A Pakistani intelligence official said security agents had been searching for 
Baradar in the southwestern city of Quetta, where the United States says a 
Taleban leadership council is based.

Sensing that he might be arrested, he somehow slipped out of Quetta and into 
Karachi, maybe in disguise. That's where we arrested him, about four days 
back, said the official, who declined to be identified.

He is with us and is being interrogated. Asked if the United States was 
involved in the questioning, he said: Yes of course. We have that sort of 
cooperation with them.

Baradar's arrest comes amid a a renewed drive for peace talks between the 
Afghan government and the Taleban.

Asked if the Taleban commander could help with any reconciliation process, the 
Pakistani agent said: It might lead to that eventually ... Anything is 
possible but so far we have not come to that. Pakistan is anxious to have a 
say in post-war Afghanistan in order to limit the influence of old rival India 
there.

Anger in Pakistan toward the United States has been exacerbated by attacks by 
pilotless US drone aircraft on militants in lawless enclaves along the Afghan 
border.

In the latest strike, a US drone fired a missile into the North Waziristan 
region on the Afghan border, killing at least three militants, Pakistani 
intelligence officials said.

The drone targeted a militant compound in the village of Tapi, about 15 km east 
of Miranshah, the main town in the region, which is a hotbed of Taleban and 
Al-Qaeda militants. It was the second attack on the village this week.

There was no information about the identity of those killed or of three men 
wounded in the strike, they said.

Pakistan objects to the drone strikes, saying they are a violation of its 
sovereignty and complicate its efforts against militancy.

The Pakistani army has made gains against militants battling the state over the 
past 10 months but it has ruled out a major offensive against Afghan Taleban 
factions on its soil, saying its forces are already stretched.

Changes to Indonesian Marriage Bill Possible

The Ministry of Religious Affairs on Tuesday said it would stand by its 
proposed draft bill on marriage, which includes controversial articles, but 
said it was open to reconsidering some points. 

The bill, which has been included in the House of Representatives' list of 
priority bills for this year, proposes a maximum fine of Rp 6 million ($648), 
or six months imprisonment, for marrying without either the proper documents or 
the presence of an authorized religious official. 

Under the bill, any state official found providing help to administer marriages 
could also face both a jail term and a hefty fine. 

Law No. 1/1974 on Marriage requires people to register their marriages with the 
appropriate civil registry office. 

However there are no penalties for violators. 

Masruchah, a commissioner of the National Commission on Violence Against Women 
(Komnas Perempuan), said she agreed with the banning of unregistered marriages 
but not with the proposed punishments. 

Considering the punishments, we should understand first that many of those who 
are tied in an unregistered marriage are from the low-income class, she said. 

If we applied imprisonment and fines, it won't be fair to them. For the 
wealthy people, it might seem like a light sanction but not to poor people. 

However, she said that for someone like Sheikh Puji, a central Java religious 
figure who married a 12-year-old girl, the proposed sanction is too light. 

Minister of Religious Affairs Suryadharma Ali said he was considering several 
different kinds of punishment instead of imprisonment. 

It is still a draft and open for revision, he said. We need more opinions, 
views and reasons that will be philosophical and sociological considerations. 

He said he expected the House to agree to the bill. 

However, if they don't agree, we will probably change the punishment into 
administrative punishment, such as oblige them to register, announce it to the 
public or pay a fine, he said. 

Suryadharma said those couples whose marriages were unregistered need not 
remarry. 

They only need to register, he said. Because if we claimed that their 
marriage is illegal, then if they have children, they are children of 
adultery. 

Last year, the alleged spiritual leader of terrorist group Jemaah Islamiyah, 
Abu Bakar Ba'asyir, told Antara that banning unregistered marriages was 
crucial. 

Ba'asyir claimed that those involved in an unregistered marriage wanted to keep 
it secret, which is against the tradition of Islam that marriages should be 
publicized widely. 

One who doesn't want their marriage out in the open is a coward. The state 
needs to immediately take action and stop this kind of marriage, Ba'asyir said

casino in Singapore, stole a mobile phone from an undergraduate at Changi 
Airport.

Paulus Djohar, 49, unemployed, was jailed for four weeks on Wednesday after 
pleading guilty to stealing a S$500 phone from Lim Tse Min at Terminal 1 on 
Tuesday.

A court heard that he came here from Malaysia last Tuesday with the intention 
of patronising the newly-opened casino at RWS. As he lost all his money 
gambling at the casino on Monday, the second day of its opening, he decided to 
steal from passengers at Changi Airport.

Early on Tuesday morning, Djohar was at the airport when he approached Lim, who 
was with a group sending a friend off.

One of them in the group saw his suspicious movements and alerted Lim, who 
discovered the phone gone from the side pocket of her backpack. She and the 
witness confronted Djohar.

Djohar, who said he regretted what he had done, could have been jailed for up

PT KA Keluhkan Aparat yang Tidak Membayar Karcis

Semarang, CyberNews. PT Kereta Api Daop IV Semarang mengeluhkan para aparat 
yang tidak mau membayar saat naik kereta api. Padahal PT KA telah memberikan 
dispensasi harga tiket pada aparat sebesar 50 persen yang menunjukkan Kartu 
Tanda Anggota (KTA). 

Namun faktanya sebagian besar dari mereka enggan membayar sepeserpun, dan 
memilih jadi penumpang gelap. Kalau penumpang liar dari warga sipil kami masih 
bisa mengatasi. Tapi kalau dari aparat atau non sipil kami kesulitan, kata 
Deputy Vice President PT KA Daop IV Semarang, Maqsud Amroh.
 
Menurut Maqsud, para aparat tersebut sering menggunakan jurus diam bila 
ditanyai oleh petugas soal tiket, dan justru mengajak petugas bertengkar. 
Padahal para petugas kereta api tak dibekali kemampuan bela diri yang memadai 
saat bertugas, tidak seperti aparat yang sudah terlatih. Karena tidak bisa 
menghadapi, akhirnya kondektur bosan, dan didiamkan saja, ujarnya. 

Diakui, selama ini pengontrolan karcis memang hanya bertumpu pada kondektur 
seorang. Sehingga sulit bagi kondektur untuk menghadapi para penumpang liar, 
terutama dari aparat. Belum lagi dengan keterbatasan tenaga, sehingga pihaknya 
tidak bisa melakukan pemeriksaan serentak (PS) setiap hari. 

Jumlah tenaga PS sekali kontrol pun hanya 2-3 orang. Ini semua bersumber dari 
ketidakmampuan kami menghadapi gerusan masyarakat, jelasnya. 

Mereka yang naik kereta tanpa karcis, lanjutnya, ingin mengorbankan PT KA 
dengan uang yang tidak seberapa. Sementara dampak yang ditimbulkan sangat 
terasa bagi PT KA yang saat ini sedang membenahi sarana dan prasarana. Kami 
sudah memberikan sanksi bagi mereka yang terlibat kasus penumpang gelap, 
ujarnya. 

Manajer Operasi Daop IV Heru Kuswanto mengatakan, sebenarnya para penumpang 
liar bukan berasal dari kalangan tidak mampu. Mereka justru orang-orang dengan 
pekerjaan tetap yang memang sengaja tidak mau membayar. Baru-baru ini kami 
berhasil mengenakan denda dua kali lipat dari harga tiket, untuk dua oknum 
polisi dari KA Argo Anggrek jurusan Surabaya- Jakarta. Ada juga 14 penumpang 
gelap KA Sindoro yang kami turunkan di Suradadi karena tak mau membayar, 

Pihaknya berharap agar pimpinan PT KA bisa berbicara dengan para pimpinan 
instansi terkait dimana para penumpang liar tersebut bekerja. Sehingga yang 
dibawah itu tidak gontok-gontokan, imbuhnya. 

Para aparat ini kadang tidak langsung naik dari Stasiun Tawang. Tapi mereka 
naik KA Tawang jaya dari Stasiun Poncol. Lalu mereka turun di Pekalongan, dan 
tahu-tahu sudah berada di kereta eksekutif. Jumlahnya para aparat ini sekali 
naik kadang bisa mencapai 100 orang. 

Padahal jumlah tim PS paling banyak 4-5 orang. Pernah seorang portir 
tergeletak karena dipukuli oleh aparat. Jujur kami tidka mampu mengatasi 
aparat, akunya. 

Heru mengakui, dilema para kondektur inilah yang akhirnya membuat mereka 
membiarkan para penumpang liar begitu saja. Di satu sisi mereka ingin 
menertibkan penumpang, tapi di satu sisi mereka tidak mampu menghadapi para 
aparat yang lenih mengandalkan kekuatan otot. 

Akhirnya ada yang mensiasati berapapun hasil tawar menawar mereka dengan 
penumpang dimasukkan dalam suplisi dan disetorkan semuanya pada stasiun. Tapi 
ada juga yang mengambil keuntungan dengan tidak menyetorkan semuanya, papar 
dia.

DALAM berbagai kesempatan, penulis mengemukakan beberapa aspek dari
pengembangan demokrasi di negeri kita. Segera timbul reaksi yang tajam dari
berbagai orang teman, yang melihat terlalu jauh menuntut komitmen NU untuk
membela demokrasi yang dinyatakan penulis. Mereka beranggapan, penulis
terlalu jauh mengkaitkan demokrasi kepada kemerdekaan. Seolah-olah, dalam
pandangan mereka, penulis menyatakan tiada kemerdekaan tanpa demokrasi dan
tiada demokrasi tanpa kemerdekaan. Padahal, kedua-duanya tidaklah sama dalam
pandangan mereka. Malaysia dan Singapura, dalam kenyataan telah merdeka
walaupun tidak menegakkan demokrasi sepenuhnya. Dengan kata lain, sebuah
Negara yang merdeka sudah dapat berdiri dengan efektif tanpa demokrasi, dan
tidak berarti kemerdekaan dan demokrasi itu merupakan dua sisi yang sama
dari sebuah mata uang yang satu.


Republik Rakyat Tiongkok (RRT) umpamanya jelas sudah merdeka tapi kalau
dinamakan demokratis tidak sepenuhnya. Hal itu benar, umpamanya kebebasan
berbicara, sebuah unsur multak bagi demokrasi, ternyata tidak banyak
terdapat di sana. Walaupun negara itu merdeka dan merupakan kekuatan besar
di bidang militer yang dapat mengimbangi kekuatan negara adikuasa seperti
Amerika Serikat. Walhasil, sebuah negara dapat saja merdeka, tapi tidak
demokratis, walaupun belum tentu selanjutnya yang terjadi: sebuah negara
dapat saja sangat demokatis namun tidak merdeka. Jelas, merdeka belum tentu
demokratis dan demokratis belum tentu merdeka. Itulah yang menjadi tanda
tanya besar bagi kita. Adakah antara keduanya terdapat hubungan kondisional,
yaitu yang satu baru hidup kalau yang lain ada? Pertanyaan ini diajukan
kepada penulis secara lisan sebagai reaksi beberapa orang pembaca, atas
ungkapan penulis yang menyatakan bahwa kemerdekaan yang harus bersandar
kepada demokrasi, walaupun dalam pandangan mereka demokrasilah yang
memerlukan kemerdekaan. Setidak-tidaknya kemerdekaan yang efektif dalam
praktek, walaupun secara teoritik belum dianggap merdeka, seperti halnya
Kanada dan Australia, yang menjadi negara dominion Inggris. Ratu Inggris
juga Ratu Kanada dan Ratu Australia, sehingga secara teoritik keduanya
tidaklah merdeka. Sedangkan banyak negara, tidaklah merdeka sepenuhnya,
seperti negara-negara tertentu di benua Afrika; yang dalam banyak hal masih
harus bergantung kepada negara luar untuk dapat hidup, karena sedikitnya
sumber-sumber mereka untuk dapat menghidupi seluruh rakyat.


Kemerdekaan negara-negara itu adalah sesuatu yang fiktif, karena mereka
sangat bergantung kepada pihak luar, untuk dapat tetap hidup dalam
pergaulan internasional. Mereka kehilangan kemerdekaan yang terwujud
secara formal, karena bergantung sepenuhnya kepada pihak lain. Kalau bantuan
ekonomi dan atau perlindungan militer dari luar itu dicabut, hilanglah
kemerdekaan itu. Kepulauan Sheycheles di Lautan India dan Vanuatu di Lautan
Pasifik dapat dikemukakan sebagai contoh akan tidak sebangunnya antara
kemerdekaan dan demokrasi. Tidak selamanya kehadiran yang satu menjadi
syarat bagi kehadiran yang lain, (Conditio Sine Qua Non), seolah-olah tidak
ada hubungan kondisional antara kedua-duanya, dan dengan demikian sebuah
negara dapat saja ada tanpa kemerdekaan atau merdeka tanpa ia terwujud/
hadir dalam kenyataan.

Jadi, dengan demikian dapat disimpulkan bahwa antara kemerdekaan politik dan
kebebasan demokrasi tidak terdapat hubungan kondisional. Contohnya adalah
Singapura dan Malaysia, yang tidak memberikan kebebasan berbicara dalam
soal-soal politik kepada warga negaranya. Kebebasan berbicara memang ada
tapi hanya dalam soal-soal teknis belaka, seperti kesalahan manajemen atau
kepengurusan administrative atas sebuah proyek publik oleh negara. Ini tentu
jauh beda disbanding dengan para mahasiswa Indonesia dan Muangthai pada saat
ini, yang dengan bebas mengkritik pemerintah semau mereka. Hal ini
mengundang komentar dari orang seperti Tun Dr Mahathir Mohammad, mantan
Perdana Menteri Malaysia, yang menyatakan, bahwa belum waktunya orang-orang
Malaysia mengenyam kebebasan berbicara seperti itu. Dengan kata lain, dia
menganggap belum waktunya kebebasan berbicara dan kemerdekaan berpikir
diutarakan, terbukti hal itu diterapkan Malaysia saat ini. Berbeda dengan
pandangan tersebut, Sir Winston S. Churchill menyatakan, bahwa pemerintahan
demokratis akan terlihat banyak cacat dan kekurangan tapi dia masih lebih
baik dari pemerintah manapun yang tidak demokratis. Entah mana yang benar,
antara kedua pandangan itu. Tetapi yang jelas Malaysia dan Singapura memilih
opsi pertama, sedangkan Muangthai dan Indonesia memilih opsi kedua.
Sejarahlah yang akan menentukan!

Sekarang kita sebagai bangsa berada di persimpangan jalan. Akankah kita
mengambil jalan pertama, yaitu memasung kembali kemerdekaan berbicara,
setelah kita rebut dengan pertumpahan darah cukup hebat pasca pemerintahan

Boleh jadi pengaruh dan penyerapan dari bahasa Arab ke dalam bahasa
Indonesia tak kalah banyak daripada sumbangan bahasa asing lain, terutama
bahasa Inggris. Kita melihat banyak sekali kosa kata kita yang merupakan
serapan dari -atau rakitan dengan bahan baku- bahasa Arab.



Contoh paling mencolok adalah istilah-istilah yang digunakan untuk
lembaga-lembaga legislatif kita. Majelis Permusyawaratan Rakyat, misalnya,
berasal dari kata Arab majlis, musyawarah, dan raa'iyah. Dewan Perwakilan
Rakyat dari diiwaan, wakiil, dan ra'iyah. Dewan Perwakilan Daerah pun
demikian. Kata daerah diambil dari daairah.


Bahasa Arab juga banyak menyerap bahasa asing, namun galibnya terbatas pada
istilah-istilah baru yang tak ada di Arab. Misalnya, kata sijarah dari
cigarette, telefuun dari telephone, telefeziyuun dari television, dan
dimukrathiyah dari demokrasi. Kata-kata seperti itu mereka sebut mu'arrab,
yang diarabkan.


Berbeda dari kata-kata mu'arrab yang umumnya terbatas pada istilah-istilah
baru yang memang tidak ada dalam kamus Arab. Kata-kata Arab yang
diindonesiakan sering mengalami pergesaran dari makna aslinya atau sengaja
diberi muatan makna lain karena tidak tahu atau karena kepentingan tertentu.



Ada beberapa istilah yang diambil dari bahasa Arab itu yang kemudian rancu
atau dirancukan orang dengan istilah asli dari sononya. Istilah ulama yang
sudah mengindonesia dirancukan dengan 'ulamaa yang masih asli Arab. Di Arab,
kata 'ulamaa adalah bentuk jamak dari 'aalim/aliim, berasal dari
'alima-ya'lamu yang berarti mengetahui. 'Ilmu = pengetahuan dan
'aalim/'aliim = orang yang berpengetahuan. Jadi, 'ulamaa adalah orang-orang
yang berpengetahuan.


Karena itu, dalam bahasa Arab, orang-orang semacam Isaac Newton hingga
Habibie kita yang ahli pesawat terbang termasuk golongan 'ulamaa. Jadi,
bukan hanya tokoh-tokoh yang seperti para sahabat dan para mujtahid yang
bukan saja ahli dalam ilmu ke-Ilahi-an, tapi juga dalam amaliah. Meskipun,
lazimnya istilah 'ulamaa memang dimaksudkan untuk yang terakhir ini (dan
yang sejenis itu pada zaman ini, tampaknya, stock-nya sudah habis).


Setelah ditaklukkan (ini istilah Rendra) ke dalam bahasa Indonesia menjadi
ulama, bentuknya berubah tak lagi jamak, tapi mufrad, satu. Jadi, sebagai
orang Indonesia , Anda bisa dan sah, misalnya, mengatakan Seorang ulama
besar atau Wahai para ulama!. Ulama dalam bahasa Indonesia memang berarti
seorang yang ahli dalam pengetahuan agama Islam (lihat Kamus Besar Bahasa
Indonesia). Kita tahu, tidak semua amaliah orang yang ahli dalam sesuatu
bidang pengetahuan bersangkut-paut dengan pengetahuannya. Ada ahli hukum
yang tidak menghargai hukum, ada dokter hewan yang tidak pernah menyentuh
hewan, ada ahli jiwa yang sakit jiwa, dan sebagainya.


Demikian pula dengan ulama, ahli agama Islam, juga ada -kalau tidak banyak-
yang amaliahnya tidak atau kurang Islami. Apalagi, kita tahu sendiri,
pengetahuan agama di kita masih belum terlalu beranjak dari simbol-simbol
belaka (Majelis Ulama Indonesia saja masih lebih sibuk ngurusi label halal
dan logo kaset musik daripada ikut ngurusi koruptor serta tindakan arogansi,
misalnya. Padahal, korupsi jauh lebih menjijikkan daripada minyak babi dan
arogansi. Atau, takabur jauh lebih gawat akibatnya daripada logo kaset).


Yang berbeda dari istilah ulama adalah istilah kiai. Istilah kiai adalah
istilah budaya (Jawa), bukan terjemahan dari ulama. Orang Jawa mempunyai
kebiasaan menyebut kiai kepada apa atau siapa saja yang mereka hormati,
bahkan mereka keramatkan. Kiai Nagasasra dan Sabuk Inten adalah benda. Kiai
Slamet adalah hewan. Para pendiri NU yang umumnya dari Jawa menamakan
jam'iyah mereka dengan Nahdlatul Ulama. Saya kira, itu karena mereka tidak
menemukan padanan kata kiai, lalu mengambil yang agak mirip. Karena pada
waktu itu peran kiai -yang relatif cukup menguasai ajaran Nabi Muhammad SAW-
memang sejauh mungkin meniru peran para sahabat, tabi'iin, dan para
mujtahid, terutama di dalam ri'aayatul ummah, mengawani umat; melihat umat
dengan kacamata kasih saying. Menolong mereka yang perlu ditolong, mengajar
mereka yang tidak tahu, mengingatkan mereka yang lupa, dan seterusnya. Dan,
itu mereka lakukan tanpa pamrih, kecuali rida Allah.


Jadi, kiai -yang kemudian disinonimkan dengan ulama- adalah istilah yang
diberikan masyarakat atau menurut istilah Arief Budiman: produk masyarakat.
Dalam kehidupan bermasyarakat, istilah itu semakin meruwetkan ketika
kemudian masyarakat tidak lagi bisa memonopoli dalam memproduksi kiai.
Kata Arief Budiman, pemerintah juga bisa memproduksi kiai/ulama. Pers juga
bisa. Dan, saya menambahkan, ada kiai/ulama produk partai dan produk
sendiri. Yang terakhir itu cukup dengan modal -selain aksesori seperti
kopiah, serban, dan tasbih- punya sedikit kemampuan akting, punya hafalan
beberapa ayat dan satu-dua hadis, sukyur sedikit-sedikit bisa ndukun. []

A. Cikal Bakal dan Sejarahnya



1. Latar Belakang

Pondok Pesantren Assalafi Al Fithrah adalah lembaga pendidikan Islam yang
lahir, tumbuh dan berkembang di tengah-tengah masyarakat, yang salah satu
tujuannya adalah melestarikan dan mengembangkan akhlaqul karimah dan
nilai-nilai amaliah salafushsholeh.



Seiring dengan perkembangan ilmu pengetahuan dan teknologi dalam era
globalisasi dan informasi, serta guna memberikan landasan yang kuat dengan
didikan yang akhlaqul karimah, maka dalam hidup dan kehidupan ini,
pendidikan -khususnya agama Islam- dan tatanan hidup yang akhlaqul karimah
sangat diperlukan untuk membentengi dan melindungi diri, keluarga khususnya
anak - anak.



Anak sebagai generasi penerus, dalam perkembangannya sangat membutuhkan
pendidikan agama dan akhlaqul karimah sejak dini, guna melindungi diri dan
kehidupannya, agar tidak terseret dalam arus globalisasi dan informasi yang
menyesatkan.



Dalam rangka melindungi, membentengi dan memberikan tuntunan dan didikan
agama Islam dan tata laku akhlaqul karimah, maka pada tahun 1985, Romo
KH.Achmad Asrori El Ishaqy ra. merintis berdirinya Pondok Pesantren Assalafi
Al Fithrah, yang berlokasi di jalan Kedinding Lor 99 Surabaya.



2. Proses Berdirinya Dan Perkembangannya

Bangunan pondok bermula dari kediaman Hadhrotusy Syaikh KH. Achmad Asrori El
Ishaqy ra. dan mushola pada tahun 1985, dan diikuti dengan 3 santri senior
Pondok Pesantren Darul ‘Ubudiyah Jati Purwo Surabaya ( Ust. Zainal Arif,
Ust. Wahdi Alawy dan Ust. Khoiruddin ).



Pada tahun 1990 datanglah beberapa santri sekitar 3 - 4 santri (Abdul Manan,
Ramli, Utsman dan Zulfikar ), dengan kegiatan ‘ubudiyah dan mengaji secara
bandungan di mushola.



Dalam perkembangannya jumlah anak yang ingin mengaji dan mondok semakin
banyak ( 25 orang ), sehingga pada tahun 1994 Hadhrotusy Syaikh memutuskan
untuk mendirikan Pondok Pesantern dan mengatur pendidikan agama dan umum
secara klasikal.



Pondok Pesantren Asalafi Al Fithrah semakin berkembang dan dikenal di
masyarakat secara luas, sehingga banyak masyarakat yang memohon Hadhrotusy
Syaikh untuk menerima santri putri. Dengan dorongan dan desakan itulah
akhirnya pada tahun 2003 beliau membuka pendaftaran santri putri dan
terdaftarlah 77 santri putri. Sampai pada tahun 2007 tercatat jumlah santri
1999, menetap 999 santri dan tidak menetap 1000 santri.



B. Visi Pondok Pesantren Assalafi Al Fithrah



Menanamkan akhlaqul karimah atau budi pekerti yang mulia sejak dini sebagai
bekal hidup dan kehidupan putra-putri dalam melanjutkan perjuangan
salafushsholeh untuk melestarikan dan mengembangkan suri tauladan, bimbingan
dan tuntunan dalam perjuangan dan hidup serta kehidupan Baginda Habibillah
Rasulillah Muhammad SAW. yang penuh akhlaqul karimah.



C. Misi Pondok Pesantren Assalafi Al Fithrah



1. Menyelenggarakan pengajaran / pendidikan formal atau non formal yang
berorientasi pada kelestarian dan pengembangan suri teladan, bimbingan dan
tuntunan dalam perjuangan dan hidup, serta kehidupan Baginda Habibillah
Rasulillah Muhammad SAW. Yang penuh akhlaqul karimah.

2. Mempertahankan nilai-nilai salafush sholeh dan mengambil nilai-nilai
baru yang positif dan lebih maslahah dalam hidup dan kehidupan, beragama dan
bermasyarakat.

3. Membentuk pola pikir sntri yang kritis, logis, obyektif, yang
berlandaskan kejujuran dan akhlaqul karimah.

4. memberikan bekal keterampilan hidup, membangun jiwa santri yang
mempunyai semangat hidup tinggi dan mandiri serta mampu menghadapi tantangan
perubahan zaman.



Secara global Kegiatan-kegiatan yang ada pada Pondok Pesantren Assalafi Al
Fithrah ada tiga. *Pertama; *kegiatan yang bersifat Syiar*. Kedua; *
wadlifah.* Ketiga; *pendidikan.



1. Syi’ar

Meliputi minggu manaqib awal, pengajian ahad kedua, haul, majlis dzikir dan
maulidur Rasul SAW.



2. Wadlifah

Yaitu Kegiatan yang bersifat berangkat (Suatu kegiatan yang berkaitan
langsung dengan Allah SWT., Baginda Habibillah Rasulilah Muhammad SW.,
Sultonul Aulia’ Syaikh Abdul Qodir Al Jilany ra. dan Hadzratusy Syaikh KH.
Achmad Asrori Al Ishaqy ra. dan berguna untuk menanamkan dan melatih
tanggungjawab dan kejujuran hati kepda Allah SWT., Baginda Habibillah
Rasulilah Muhammad SW., Sultonul Aulia’ Syaikh Abdul Qodir Al Jilany ra. dan
Hadzratusy Syaikh KH. Achmad Asrori Al Ishaqy ra.). Dan kegiatan ini tidak
boleh dirubah oleh siapapun dan kapanpun, meliputi:

a. Jama’ah maktubah, Sholat sunah (Qobliyah dan ba’diyah, Isyraq, Dhuha,
Isti’adah, Tsubutil Iman, Hajat dan Tasbih).

b.Aurd-Aurod yang telah di Tuntunkan dan dibimbingkan.

c. Qiro’atul Qur’an Al Karim (dilakukan setelah tahlil subuh, diawali
dengan Al Fatihah 3 kali, membaca Al Qur’an dengan sendiri-sendiri satu juz
ditutup dengan kalamun dan do’a Al Qur’an.

d.Maulid (dilakukan : setiap malam jum at , diawali dengan AL Fatihah 3
kali , kemudian membaca Ya Robby , Inna Fatahna , Yaa Rosulallah , dengan
dipandu oleh pembaca ,
