have a certified Physical Therapist discuss the merits with you.  Granted,
it just might work, but I don't think so.  But the idea of an old TENS unit
might be the answer.

CMS has been developing new Case Management regulations over the last few
months in response to some of the changes in the Deficit Reduction Act.

Rumor has it they will be published as Interim Final Rules in the beginning of
August.

Word has been spreading, though nothing specific, that the new rules will
roll back all the progressive advances CMS allowed in Case Management and
Targeted Case Management that had been allowed for States to use to get folks
out of institutions since the Olmstead letters in 2000. In addition there
will be major changes in how Case Management will be paid for in HCBS
waivers.

If these rumors are accurate it appears CMS (maybe directed by OMB) will not
only be undercutting their own MFP initiative but also the whole New Freedom
Initiative and Olmstead initiatives.

What is ironic is that many in the community thought CMS was going to give
States more flexibility because getting and keeping folks out of institutions
needs intensive service coordination and Case Management and TCM are two ways
States can get help in paying for that service.

ACTION NEEDED:

1. Spread the word in your community that these rules are coming out and when
they are published we need a loud outcry from aging and disability advocates;
2. Contact your Medicaid Director and tell them you will support them in
their opposition to these new rules;
3. Contact Dennis Smith, HHS/CMS Medicaid Director by e-mailing his Executive
Assist

It sounds like 11,000miles is great on an 06. I have a Braun Conversion Dodge 
Grand Caravan 95 with 70,000miles, it's been a really good second hand vehicle.

AS MANY OF YOU KNOW I BOUGHT A MINI VAN LAST YEAR SO I COULD GET IT MODIFIED TO 
DRIVE. I WENT THRU VOC REHAB WHICH HAS BEEN BEEN VERY HELPFUL (WHEELCHAIR  
AGREE W/ YOU ABOUT DOING THE LEGWORK) . 

I TOOK MY VAN TO THE DEALER ON MAY 7 AND WAS TOLD 4/6 WEEKS. MONDAY WILL BE 12 
WEEKS.
MY VAN ALREADY HAD AN IMS CONVERSION. SO WHAT HAPPENED WAS IT SAT AT THE DEALER 
FOR A WEEK BEFORE IT WAS SENT TO HOUSTON. WAS TOLD BY PEOPLE IN HOUSTON IT WAS 
BEING TEST DRIVEN AND WOULD BE DELIVERED TO DEALER WEEK OF JULY 2. THEN WAS 
TOLD BY DEALER DUE TO FLOODING HOUSTON WAS HAVING TROUBLE GETTING IT OUT. I 
TALKED TO HOUSTON AND WAS TOLD MY VAN WAS READY JULY 2 BUT NEW EQUIPMENT CAME 
OUT SO THEY CHOSE TO UPGRADE IT ALL TO THE LATEST AND GREATEST. SOUNDS LIKE A 
LINE OF B.S. HUH? SO, VAN WAS SUPPOSE TO BE AT DEALER JULY 20. IT WAS STILL IN 
HOUSTON MONDAY AT 1PM SO MY APPT TO HAVE LOCKS INSTALLED TUESDAY - CANCELLED. 
THEY GOT VAN TUESDAY SO I GET UP AT 4:30 TO BE AT DEALER 75 MILES AWAY AT 8AM.  
I GOT THERE, GOT OUT OF CHAIR, WAITED 1 1/2 HRS TO BE TOLD TEY DIDN'T HAVE 
CORRECT EZ LOCKS. ALSO, MY DOOR WON'T OPEN AUTOMATICALLY AND VAN ISN'T 
KNEELING- ARRIVED FROM HOUSTON THAT WAY. THEY HAD NEW MODULE AND SAID THEY 
WOULD FIX IT THURSDAY. THEY REORDERED, GOT UP AT 5:30 TO BE THER BY 10AM 
YESTYERDAY. LOCKS CAME IN WHICH WAS A PLUS - GOT THAT INSTALLED. SR TECH TELLS 
ME IT'S NOT THE MODULE BUT A WIRE/WIRES WERE CUT IN HOUSTON. HE'S GOING TO 
TROUBLESHOOT AND OTHER TECH IS GOING INSTALL EZ LOCKS IN VAN. MY DAD AND I ARE 
LEAVING THE SERVICE AREA AND HE SAYS THERE'S YOUR DRIVER SEAT - WONDER WHERE 
THE PASSENGER SEAT IS. YES, YOU GUESSED IT, NO FREAKING SEAT! NO ONE KNOWS 
WHERE IT IS - WE ASSUME HOUSTON. WE GET BACK TO MOBILITY OFFICE AND A MAN PULLS 
UP IN A LEXUS AND WANTS HAND CONTROLS. I GO UP TO SERVICE TO SEE HOW THINGS ARE 
GOING AND THEY PULLED TECH OFF MY VAN TO INSTALL HAND CONTROLS ON THE LEXUS 
THAT WAS BOUGHT IN TULSA THAT MORNING! NO APPT - JUST HAD THE $$ SO THE SR TECH 
HAS TO QUIT TRYING TO GET MY DOOR TO WORK AND INSTALL MY EZ LOCKS.  I WAS THERE 
OVER 7 HRS.

I'M SUPPOSE TO GET MY VAN TUESDAY - YEAH RIGHT! DOOR ISN'T WORKING AND WITH 
NO PASSENGER SEAT BECAUSE THEY ASSUME IT'S IN HOUSTON! OH, AND SR TECH IS ON

Speaking as a quad that has very limited sensation in the abdominal area, I do 
wonder if instead of a tens unit or one of those wing ding belly deflators that 
the FDA dismissed as useless, what if you used a crank magneto. I'm not sure 
how many milliamps a person can take without burning flesh, but if anything 
will get you doing situps, that machine should do it!
Lets be realistic, its not voltage, its amperage that causes that electrical 
shock that burns your tastebuds. I've heard people say they get relief with a 
tens unit but I've heard plasebos are pretty effective too. Whatever you do, 
good luck.

I think financial cutbacks are in the pipeline because of the tax cuts for all 
the poor rich folks and the ballooning of corporate welfare. I don't think an 
attack on MFP is imminent because it saves money. The fact is, if we all hired 
our own aides and paid for all the drugs that PLAN D FROM OUTER SPACE doesn't 
cover, the government would save tons of money as opposed to forcing people 
into nursing homes that cost a freakin fortune and are a primary souce of 
perscription drugs for people like rush limbaugh. 
I'm not saying close the nursing homes, there are too many folks dependant on 
them. I think if we eliminate an institution, we should begin with career 
politicians. Parties should be fined according to the foul balls they help get 
elected. Can anyone read the declaration of independance and not get the urge 
to overthrow the mess in Washington?

As you I had my batteries replaced and this morning I get in my chair and I
went to tilt in my chair and it started smoking and then flames and scared
the  out of me.

He put some wires where they were cut when I tilted and my chair caught
fire.

Lucky I wasn’t alone or I wouldn’t be telling this story, I would be burnt
up!

My chair tech is an idiot!

Yes he should and I should've known better because he had to ask me how to
get to the batteries and then wouldn't work on it in the same room where I
could watch.
He took it outside where it was around 95 that day and I told him to work
inside where it was cool but he insisted.
I don't know if the chair will work but it was put out with a big glass of
water so probably not.

Have you considered a lawsuit? These techs and the companies they work for 
charge the insurance companies and the government big bucks for what they do. 
You could have died or been severely injured. Raise some Hell man or this will 
just happen again to someone else and the outcome may not be so pretty.

[QUAD-L] VOC REHAB class action lawsuit?

Anybody know how we can file a class action lawsuit for all the 
problems we all have had with VOC. REHAB.? I have tape recordings of most of my 
meetings (to meet my inability to take notes due to my Difability). VocRehab 
furnished me a replacement standing wheelchair in 2000. Only to bring the old 
Levo they declared a LEMON back 9 months later. It was supposed to have been 
rebuilt with a 90 satisfaction guarantee, WHICH THEY WOULD'NT HONOR! I refused 
to accept this old chair back, but my counselor, his suprvisor, and a DME I had 
already written Voc. Rehab, that I didn't want to deal with. Which is written 
in their handbook as a right we are supposed to have, to decide who we want to 
furnish our equipment. Threatened me on recording that either I accept this old 
chair back or they would take both chairs and load tem in their pickup and 
leave me with nothing. It was a good thing I wasn't able to hold my pistol or 
that outcome would have been different.
When I was first injured in a rehab. hospital. Voc. Rehab. furnished an 
electric tilt and space chair. Voc. Rehab. informed my family they intended to 
put me in a nursing home 20 miles away. To be bussed each day for 1 hour of 
therapy. My mom decided to take me to their house to live, and when her husband 
told the counselor. The conselor told him if they took me away, he would take 
the new wheelchair out from under me. The conselor told Bob the REHAB., DME, 
NURSING HOME all scratch each others backs. So either we play their game or I 
lose that wheelchair. That was what happened and  Mom  Bob bought a manual 
chair for me to use.
Then 9 mnths later after moving to mom's Voc. Rehab. bought this old 
Levo in 1997. Fortunately one of my good friends dad was the supervisor over 
the Shawnee, OK. district. He conveniently owned a DME in a town over 60 miles 
away. That was how I ended up with this old Levo standing heelchair to begin 
with. Now most incredbly in 2004 I took Voc. Rehab. to a Fair Hearing (NOT). 
Fortunately I won that Hearing and Voc. Rehab was ordered to replace this old 
Levo. But they appealed that decision and it was overturned against me. I had 
to represent myself because none of the Federally funded agencies, that are 
supposed to help represent me would do so in a good way. They actually wanted 
me to let them load 7 years of boxes of files from every agency since my crash. 
So they could go through each box to find files dealing with the wheelchair. 
Obviously I knew better and didn't want those records to end up in the landfill 
dump. 
Their have been too many of us done this way, surely somebody will help 
all of us get a big settlement. To make up for the pain, torment, stress, and 
everything else. Especially the life I have missed out on during the past 10 
years. While trying to get services that have been promising repeatedly by Voc. 
Rehab. on recordings.
 Let's gather together and finally become a UNITED FORCE TO BE TAKEN 
SERIOUSLY!

I thought my day was in the dumper. Daaayum Mark! You win! I'm glad your ok. My 
day was almost nice compared to yours. Everyone else sues. Now that we have the 
ADA, we can consult with incompetant nincompoops till we are blue in the face 
and for our troubles we get..nothing. 
Bet if you weren't disabled you could sue that moron. Nicole is getting ripped 
off in Texas. You both should have lawyers kicking in doors. Your both examples 
of willful neglect and malpractice by certified professionals that you probably 
cant take to court because of the provisions in the ADA to negotiate untill 
hell freezes over. At which time, if you win, you'll get the work done.

As you I had my batteries replaced and this morning I get in my chair and I 
went to tilt in my chair and it started smoking and then flames and scared the 
 out of me.
He put some wires where they were cut when I tilted and my chair caught fire.
Lucky I wasn’t alone or I wouldn’t be telling this story, I would be burnt up!
My chair tech is an idiot!

BEING TEST DRIVEN AND WOULD BE DELIVERED TO DEALER WEEK OF JULY 2. THEN WAS 
TOLD BY DEALER DUE TO FLOODING HOUSTON WAS HAVING TROUBLE GETTING IT OUT. I 
TALKED TO HOUSTON AND WAS TOLD MY VAN WAS READY JULY 2 BUT NEW EQUIPMENT CAME 
OUT SO THEY CHOSE TO UPGRADE IT ALL TO THE LATEST AND GREATEST. SOUNDS LIKE A 
LINE OF B.S. HUH? SO, VAN WAS SUPPOSE TO BE AT DEALER JULY 20. IT WAS STILL IN 
HOUSTON MONDAY AT 1PM SO MY APPT TO HAVE LOCKS INSTALLED TUESDAY - CANCELLED. 
THEY GOT VAN TUESDAY SO I GET UP AT 4:30 TO BE AT DEALER 75 MILES AWAY AT 8AM.  
I GOT THERE, GOT OUT OF CHAIR, WAITED 1 1/2 HRS TO BE TOLD TEY DIDN'T HAVE 
CORRECT EZ LOCKS. ALSO, MY DOOR WON'T OPEN AUTOMATICALLY AND VAN ISN'T 
KNEELING- ARRIVED FROM HOUSTON THAT WAY. THEY HAD NEW MODULE AND SAID THEY 
WOULD FIX IT THURSDAY. THEY REORDERED, GOT
 UP AT 5:30 TO BE THER BY 10AM YESTYERDAY. LOCKS CAME IN WHICH WAS A PLUS - GOT 
THAT INSTALLED. SR TECH TELLS ME IT'S NOT THE MODULE BUT A WIRE/WIRES WERE CUT 
IN HOUSTON. HE'S GOING TO TROUBLESHOOT AND OTHER TECH IS GOING INSTALL EZ LOCKS 
IN VAN. MY DAD AND I ARE LEAVING THE SERVICE AREA AND HE SAYS THERE'S YOUR 
DRIVER SEAT - WONDER WHERE THE PASSENGER SEAT IS. YES, YOU GUESSED IT, NO 
FREAKING SEAT! NO ONE KNOWS WHERE IT IS - WE ASSUME HOUSTON. WE GET BACK TO 
MOBILITY OFFICE AND A MAN PULLS UP IN A LEXUS AND WANTS HAND CONTROLS. I GO UP 
TO SERVICE TO SEE HOW THINGS ARE GOING AND THEY PULLED TECH OFF MY VAN TO 
INSTALL HAND CONTROLS ON THE LEXUS THAT WAS BOUGHT IN TULSA THAT MORNING! NO 
APPT - JUST HAD THE $$ SO THE SR TECH HAS TO QUIT TRYING TO GET MY DOOR TO WORK 
AND INSTALL MY EZ LOCKS.  I WAS THERE OVER 7 HRS.
 
I'M SUPPOSE TO GET MY VAN TUESDAY - YEAH RIGHT! DOOR ISN'T WORKING AND WITH 
NO PASSENGER SEAT BECAUSE THEY ASSUME IT'S IN HOUSTON! OH, AND SR TECH IS ON 
VACATION NEXT WEEK.
 
WHEELCHAIR, WHAT DO YOU KNOW ABOUT CARLOS/IDS/FREEDOM WHEELS IN HOUSTON?
 
ANY ADVICE FOLKS BUT RIGHT NOW I WANT TO CHOKE SOMEONE!

I don't know if the chair  will work but it was put out with a big glass of

Are the batteries okay? I would call the dealer that sent the  tech out and 
demand new batteries. If he had to do this while you couldn't see,  he 
obviously had no idea what he was doing or repairing them. If the  batteries 
are the 
same ones, I'd be afraid to sit in the chair, especially  alone.
