Cottrell lawyer eyes ex-SEC, UA chiefs 07/17/03 MIKE PERRIN News staff writer Ronnie Cottrell's attorney intends to confront former Southeastern Conference Commissioner Roy Kramer, former University of Alabama President Andrew Sorensen and possibly current Tennessee football coach Phillip Fulmer for information in his effort to restore Cottrell's reputation. Asked if he would subpoena Fulmer in Cottrell and Ivy Williams' $60 million lawsuit, Thomas Gallion III of Birmingham said Wednesday, I'm going to try. I haven't made up my mind yet because I need some more information. The subpoena would be for a deposition, since state law bars compelling trial witnesses from traveling more than 100 miles to testify in civil lawsuits, Gallion said. Gallion would question Kramer and Sorensen, among others, as he attempts to gather information for the lawsuit. The suit alleges that Cottrell and Williams were tarnished by the NCAA investigation into Alabama's recruitment of Albert Means in Memphis. Because of the investigation and an ongoing federal grand jury probe in Memphis, Gallion said Cottrell and Williams are unable to get coaching jobs at any major college. Today in Tuscaloosa, Gallion and a team of attorneys representing the defendants in the suit will meet with Circuit Court Judge Steve Wilson for a status conference. Gallion said the judge would not rule on any motions in the case today, but he expected him to set a schedule for further discovery in the suit. Conspiracy claim: In the suit, Gallion has charged the NCAA with conspiring with Kramer, Gene Marsh, Marie Robbins, Tom Culpepper and several University of Tennessee boosters to ... go after the football program at the University of Alabama. The NCAA, its Committee on Infractions Chairman Thomas E. Yeager, investigator Richard A. TUSCALOOSA | Within the next 45 days, a Tuscaloosa County Circuit Court judge will hear arguments about whether to dismiss the $60 million lawsuit filed by two former University of Alabama football coaches against the NCAA and several other institutions. During a status conference today that lasted less than a half hour, Circuit Judge Steve Wilson set the time frame during which the first hearings in the Ronnie Cottrell and Ivy Williams suit will take place in Tuscaloosa. Nine attorneys appeared in court representing the seven defendants, while two showed up on the plaintiffs' side, including Tuscaloosa attorney Delaine Mountain. When asked whether the judge might dismiss the entire suit, Mountain said, I will be floored if he did. Mountain and Montgomery attorney Tommy Gallion continued their push for the NCAA and the other defendants to release documents pertaining to the suit, including telephone records, while the defense, including Tuscaloosa attorney James Jenkins, asked the judge to postpone the discovery period until after the requests for dismissals were heard to possibly save time and money. Cottrell filed the $60 million lawsuit in December against the NCAA and other institutions, including UA compliance officers. The lawsuit followed an NCAA investigation into UA football, which began in 2000 and left the program on five years of probation, including a two-year bowl ban and loss of 21 football scholarships, and, as the NCAA put it in 2002, staring down the barrel of the gun of the death penalty. Try Our Classifieds Just ask athletics director Mal Moore, who has not granted a release to transfer-minded offensive lineman Grant Dickey. We're in circumstances where I would not grant any of the players a release, Moore said in a telephone interview Wednesday. That's part of our situation right now. Since receiving its NCAA sanctions on Feb. 1, 2002, Alabama had not had a scholarship player ask for a transfer until this summer. Without a release, Dickey would have to pay his own way while sitting out the 2003-04 academic year. The Dickey family, which has not said publicly where Grant Dickey wants to transfer, did not return a phone message Wednesday. Reserve running back Nic Luke looks to be the next player to ask out. Luke has expressed an interest in transferring to Division II Tuskegee, where he would be immediately eligible if granted a release. I haven't had a chance to visit with him, but I will, said Moore, who received Luke's transfer request Wednesday morning. Meanwhile, the new Mike Shula football staff is still working to sort out the tangles left behind by the one and only re cruiting class signed by short-term coach Mike Price. A handful of the signees were academic risks and one was a professional baseball prospect, meaning the Crimson Tide has had to continue seeking out talent to fill the 18 initial scholarships it has available in August. By the terms of its NCAA sanctions, Alabama is limited to a total of 80 scholarships during each of the next two seasons, and can provide a maximum of 18 initial scholarships this fall and 19 next fall. The normal NCAA maximums are 85 scholarship players and a maximum of 25 initial scholarships per year. If we have 18 initials here in August, as it stands now, we'll be at 78 (total scholarships, including Dickey and Luke), said Alabama director of football operations Randy Ross. Alabama, like most other NCAA institutions, is operating at a few scholarship players less than the maximum. If you went around the SEC, the average is probably 80, 81, maybe 82, Ross said. The Crimson Tide has had a series of personnel losses and gains since National Signing Day last February, and more eligibility issues could affect incoming freshmen. Alabama signed 17 prospects on National Signing Day and added defensive entight end Keith Saunders of Hargrave Military Academy two weeks later. Then, after UA president Robert Witt fired Price for improper conduct in May, the personnel dominoes kept falling. Quarterback signee Cliff Davis of Eupora, Miss., was selected in the sixth round of Major League Baseball's amateur draft in June and signed with the Houston Astros. Eric Packer, a skill-position standout at Wilcox Central who could play several positions at the college level, signed with Southwest Mississippi Junior College when he did not qualify to participate at Alabama. Last Friday Alabama signed a pair of players in defensive end Wallace Gilberry of Baldwin County High and defensive back Eric Johnson of Saks High. Though the various transactions have technically squared up the Crimson Tide with 18 signees ready to enter school in August, more movement could be forthcoming. Skill athlete Chris Felder of Wilcox Central is likely to sign with a Mississippi junior college in the near future, freeing up another scholarship. The status of blue-chip fullback LeRon McClain is also in question. Tuscaloosa County High coach Robert Higginbo tham said McClain needs only to pass the state high school exit exam to be eligible. Tuscaloosa County linebacker Terrence Jones is waiting to hear back from the NCAA Clearinghouse. Coach Hig (Higginbotham) and my high school counselor both tell me that I have the GPA and the test score to be eligible, Jones told TiderInsider. But there's still nothing back from the Clearinghouse. If we end up without 18 initial signees in August, we can sign players in December who can count back on this class, that is if they enroll in January and they're qualified, Ross said. Prospects who sign during the Christmas period are allowed to count forward or backward. Alabama's roster shuffling is not out of the ordinary compared to other major college programs, but its scholarship limitations narrow the margin for making mistakes in recruiting. In a recent interview with the Register, Shula said he and his staff can't afford to make recruiting blunders in the next couple of years.
