[OSM-Talk-ZA] ZA Local OSM Chapter?

Hi ZA OSMers,

As you may have read on talk@ this morning, the OSM Foundation is
apparently busy creating a policy for Local Chapters which will be able
to represent the OSM-F officially. See

So I was thinking that maybe we should try to found a South African
Local Chapter. It might in particular be useful to have an official
organisation for handling the various negotiations with government
bodies for the use of their data.

Apparently in South Africa you can form a "voluntary association" which
is recognised in common law, and then register with the government as a
non-profit organisation. Supposedly this is easier than creating a
Section 21 company. Does anyone have experience with such things?

Grant, would you have any objection to transferring the
openstreetmap.org.za domain to such a local chapter if it is created?

I'm all in!

It would be nice to approach government on behalf of OSM as a
voluntary association or the like. This will help especially with all
the rest of the government data that we'd like to access.

[OSM-Talk-ZA] Using data from GPSED website

Hi everyone

I was wondering, a website like gpsed makes all tracks available, everyone
can download the gpx tracks

please see link below for an example (I chose a random track someone drove)

I had a look to see if there was any copyright on the data and couldn't find
any.

Can anyone comment please, would it be ok to use the data for mapping out
roads in (South) Africa?

Best to contact the uploader and ask for permission.

It also helps to get the message out about OpenStreetMap.

Anyone here involved with Tracks4Africa? Their members have a virtual
goldmine of (South) African GPS tracks.

You can set the tracks to Public or Private

In the FAQ I found this

*What do the track statuses Private/Public mean and what do I need them for?

All tracks recorded online are saved on the server and are available for
review and management on www.gpsed.com . When you start a
Public track you automatically agree to share it with other users. The more
often you upload your positioning data to the server the more actual is your
position on a map for other users. If you do not want to share your track
with others please change it to Private.

would this qualify as public domain?

Hi Hein.

Thanks for the gpsed site. I hope it's like the
sportstracker.nokia.com , where I recently found many good mountain
bike routes. Some of them were recorded during special events (e.g.
races) for which landowners may have opened their properties / gates.
So blindly importing is out of the question. But I don't mind riding
these routes...

No, because it does not say that "other users" will have the right to
distribute what they download.

BUT on OSM-legal-talk many people have argued that facts cannot be
copyrighted. IMO gps tracks are facts, so we should be able to use
them for OSM. Let me cross post to legal-talk and see if the big legal
brains agree.

Ok Ivan from legal-talk says individual facts are free, but
collections are protected in most countries. So I think traces from
non-free sites can only be used to derive one segment at a time, e.g.
when OSM is missing a foot bridge.
