Yes, thats how i mean it.
Never realized that myself. My older DAC based on BB PCM63k had for sure
more audible clipping on overcompressed recordings. I often heard that
when my tweeters puked. I noticed it became less when i switched to the
Transporter. Since i used its build in volume since day 1 i may have
solved that problem once and for all even without knowing about it :)
Benchmark introduced some feature in its DAC2 that " includes 3.5 dB of
headroom above 0 dBFS" whatever that means. Maybe some DACs these days
have this build in or they use some pre-defined volume drop.

I just lately realized that my Transporters digital volume control
prevents the hard clipping of intersample overs when i use it at my
normal volume setting, mostly below -8dB. 
If i interpret my readings correctly a nearly clipped signal can create
peaks after analog conversation up to +6dB. When no care  is taken on
the DAC side you may have very hard clipping.
On the Transporter that means a fixed 100% volume may have more
downsides as using the internal volume control. I have not done any
testing, since i use my Transporter directly into my amps. Just wanted
to mention this as food for thought.

Even more funny  is how in "other forums"  some are very good in quoting
studies to proof things (often totaly out of context and wrongly
interpreted) and linking to pdfs of AES that have members on
hydrogenaudio and not over there ;)

It is even simpler here. The 24bit version is 44.1khz also. So simply
dither down the 24bit version to 16bit and compare again.

I think we had this here once. You have to comparethe 24bit version to
a 16bit file coming from this 24bit file. The 24bit version is slightly
different in loudness (afaik 0.2dB) and maybe treated a tiny bit
different no matter what you read how they were done. Besides that
hearing difference between 16 and 24bit is very unlikely with The
Beatles. Even after remastering the noisefloor should be way to high.
