confirmed:
using nvidia driver, unity and ubnutu kernel (2.6.38-8) i can suspend, whereas 
if i switch to Nouveau driver and try to suspend, the system crashes.

i tried some stuff again, and it seems that what fixed the problem was not the 
different kernel but the nvidia driver i installed.
right now it seems the bug is related to Nouveau driver or to unity of both.
the weird thing though is that the bug repeated itself also after i stopped the 
x with 'service gdm stop'. 

i am currently investigating more.

Guess that means then that the fix came in with 2.6.38.5 stable or it really is 
in the difference between mainline and ubuntu kernels.
The 2.6.38.5 based ubuntu kernel should appear first in pre-proposed:

i have already tested that. problem exists also with natty-proposed
2.6.38-9.

Could you test with the ubuntu kernel from natty-proposed, which now 
corresponds to stable 2.6.38.4 (see bug 769042)?
Since you tested with stable 2.6.38.5 (from the ubuntu mainline ppa) while the 
Natty release kernel corresponds to 2.6.38.2 the bug might already be fixed 
there.

2.6.38.5 has only just begun the SRU process (see bug 775809)

update: the problem doesn't exist in the mainline kernel.
i installed different versions (eg. 2.6.38.5, 2.6.37, and 2.6.35.6) of the 
kernel from http://kernel.ubuntu.com/~kernel-ppa/mainline/, and in all of them 
i was able to suspend and resume flawlessly.
