 is free!!!)
  Anyways i am directed to meet the Asst commissioner of local customs
 department within 10 days of the receipt of the notice,the notice says if i
 cant convince them then case will be registered
  Have anyone ever heard of any such issues???please help me out...I really
 fear that i will be the very first martyr for the free software in INDIA

I requested for the Ubuntu 7.10 ,20 numbers of CDs on the first week of Feb
2008 at http://www.ubuntu.com/getubuntu . As i can know from the site , my
request for 20 CDs were approved and sent to the shipping company on
2008-02-05. And i received the show cause notice issued under sec 134 of the
C.A.62  from OFFICE OF THE ASST. COMMISSIONER OF CUSTOMS,POSTAL APPRAISING
DEPARTMENT,COCHIN -682035.And the offense is written as IMPORT OF GOODS BY
POST WITHOUT THE COVERAGE OF VALID IMPORT LICENSE CONTRAVENTION OF SEC.3 TO
THE FOREIGN TRADE(DEVELOPMENT AND REGULATION)ACT 92 - PROPOSED ACTION UNDER
THE CUSTOMS ACT.62 ISSUE OF SCN-REG.Hope Now you have enough details you
require.Please help me out sir...i am scared

  I dont think there is any restrictions on importing legal software in
 India. As a point in your favor you can show to the custom
 commissioner that lot of people in India have imported these cds and
 no where anyone in customs have raised an objection.Also, point them
 to the website which says that ubuntu is a legal free software and the
 cds are shipped by canonical for free distribution.
  You might have to pay some charges though.
  Btw, what is the quantity of cds you have asked for ?

I think they have the value of the package written over it, (0.88 Euros
for a 2-3 CD pack)... definitely less than 2000... though i'm still puzzled.

Thanks for the information. I will forward this to appropriate people
and have them look at this issue. Do not be afraid. Every ship-it comes
with an official declaration from Canonical/Ubuntu which states that
this is Free Software and the receiver is legally allowed to distribute
or make copies of the CDs. It also states that Canonical has already
paid the customs charges and the receiver need not pay anything, still
customs charge are asked because the Courier guy is made to pay during
the transaction.

Can you clarify whether you got the ship-it or its held up in the
customs office? If so, ask the customs officer to check the letter which
is attached to the shipit. We got around 600 CDs during foss.in and we
paid a customs of around 1500 INR. I hope I have the copy of the letter
from Canonical at home.

I'm sure this is nothing serious. Just let them know that the CDs are
distributed free world-wide. Point them out to Ubuntu's shipit site and I
think you will be good.

Now I know you are dealing with software for educational purposes and hence
you may have a tight budget, but here's a advise.
There are a lot of Open source vendors in the country (
http://www.opensourcedeal.com) . It might cost you to actually buy the CDs,
but apart from intelligent rationing (as against random distribution), you
will get the CDs/DVDs earlier , have a wider choice and will not run into
such petty conflicts.
