Re: [Videolib] Lifetime Streaming Rights
It would depend on the nature of Apple's contracts. Most distributors have rights for a limited time and thus can not legally sell an item beyond that term. Streaming to an entire system such as an institution is very different from home use. Some rights holders will permit lifetime streaming but most major studios foreign rights holders will not. I have had discussions with a few leading copyright lawyers and they are frankly stunned that anyone would sell rights beyond the term of a contract. It is not the same as buying a DVD, it is the same as broadcast and it is certainly well established that you can not sell broadcast rights beyond the term of a contract. If this were in fact legal it would be clearly defined in the contract with the rights holder. I would strongly advise anyone considering buying lifetime to check directly with the rights holder to see if this is in fact covered in the contract. Depression: Out of the Shadows One of our nursing instructors gave us this PBS DVD to add to collection. On the front of the DVD it states: For Promotional Use Only * Not for Broadcast. Our cataloger mentioned she had not seen this on a DVD before. I've watched it and looked on the website and cannot find any other words of caution/wisdom/insight. It is 2 hours long, not a promotional type of length. I am assuming the Not for Broadcast means no PPR. Is this correct? We are a little stymied by the For Promotional Use Only. Do we need to ask the instructor how she obtained it? Is it OK to add to our circulating collection? Thank you all for your collective wisdom in advance. There * is * case law that supports the use of promotional copies In 2011 the 9th Circuit ruled in Universal Music Group v. Augusto that promotional copies in essence transfer ownership, and thus are covered by the First Sale Doctrine (section 109, Copyright Act). Thus the DVD is a gift, that can be transferred, and is a legally acquired copy. Actually the music case involved a copy that only came in a label marked promotional use. I am assuming this DVD came with promotional use warning on the actual DVD. The case you mention specifically involved a label not an actual notice on the DVD itself ( which of course would be be impractical with music). I am also unclear if the item in question is even released on video. Obviously I don't know the nature of the promotional use writing. In general it appears either throughout a DVD or flashes every few minutes which would make it unsuitable for library use ( which of course is the point). A number of studios carefully mark screeners and aggressively go after anyone who sells them, but in general that involves a very detailed watermark allowing the rights holder to track each copy. Dear deg, I'm wondering if this was covered in the case but we put PROPERTY OF MILESTONE on each of our screeners with the idea that they are on loan from us and not *given* to the critic. (I assume others do this as well.) Since we rarely ask for them back, I don't know if this would hold up in court.
