Dear friends on Videolib,

It is with great joy and a measure of sadness that I write to say farewell to 
my friends and colleagues.  On October 1st I completed twenty-nine years with 
Bullfrog Films, through four format shifts (from 16mm to VHS to DVD to 
streaming).  At the National Media Market in Baltimore I shared my news in 
person with attendees, and celebrated my retirement with cake and music in the 
Bullfrog Films suite.

Under a full moon, moving towards the Winter Solstice, I see my path to lay it 
all down.

Thanks to all of you who have worked with me and Bullfrog Films all these 
years.  I am grateful for your support and encouragement.  One of my favorite 
jokes (I’ll tell you another time) has a great punchline:  “Ist es nicht 
wunderbar dass wir doch zusammen gekommen sind!”

Isn’t it wonderful that we got together!

Thinking about attending the ALA Annual Conference, June 22-27 2017 in Chicago?

institution?
The ALA Video Round Table Program Committee (VRT) welcomes program proposals 
for ALA Annual on just about anything related to video and libraries! The term 
video includes moving picture media in all of its forms - DVDs, streaming, 
video tapes, video art, YouTube videos, animation, iPhone shot footage, etc.
Proposals are due August 31, 2016.

I know what I have already said (to our licensing agent to pass along to
the filmmaker).  But I am curious as to my professional colleagues' take
on these terms to stream an independent self-distributed documentary film.

I am not interested in launching a discussion on the cost of producing a
documentary film, etc.   I put this out only to address the licensing
terms.


The licensing agreement for the streaming rights are limited to in-class
viewing of the film by the professor teaching the film and their
students, or by faculty who are considering teaching the film in other
courses.

Technical Note: All uploads to the server must be performed in the 4x3
aspect ratio NOT wide-screen 16x9. Any ratio other than 4x3 will be
considered alteration of the film.
Rates:

2-year streaming = $259 for institutions that already have the DVD
$518 for institutions that do not have the DVD, and therefore need a DVD
to perform the secure upload.

Permanent classroom streaming rights are available at a flat fee of 4x
the institutional DVD rate, which is $1,036. For institutions that
already have the DVD, that is discounted to 3x the institutional rate,
which is $777.00.

Use of the film for online and long-distance teaching requires an
additional $100 fee for the 2-year rate; if permanent classroom streaming
rights are purchased it is a one-time $100 fee.


To show my hand, I have recommended that we walk away and not license the
video.

Some of you have probably already heard that I have accepted a new position,

served on the NMM Board of Directors. Jessica will bring new energy and fresh 
ideas and the Market will continue to flourish with her leadership.

At UT the Faculty and Graduate students (because they teach a lot of classes) 
can check 3 videos out for 3 days.  Staff at the checkout desk can make 
exceptions based on the circumstances.

Undergraduates have a 3 hour in building only check out.

General Description
The University of Tennessee Libraries invites applications for Digital Services 
and Access Librarian for Special Collections.  We are seeking a creative, 
outgoing professional with the potential for publication and leadership.  This 
position is in the Special Collections department, a service-oriented team that 
provides access to rare and unique primary materials in support of the research 
community.  Special Collections includes 7,000 linear feet of manuscripts, 
60,000 rare books and the University Archives with particular strengths in 
Tennesseana, Southeastern Native American tribes, the Civil War, and the Smoky 
Mountains. (http://www.lib.utk.edu/special/)  This position works closely with 
the Head of Special Collections and the University Archivist to acquire, 
process, organize, digitize and provide access to the collection.

The Digital Services and Access Librarian assists with identifying and 
developing innovative means for providing discovery, access, and description of 
manuscript and rare book materials in Special Collections, with an emphasis on 
digital resources.  S/He has responsibility for oversight of processing and 
preservation of rare books, ephemera, prints, maps, and manuscript collections, 
including the creation of EAD-encoded finding aids.  This position works 
closely with faculty and staff in Special Collections, Digital Library 
Initiatives, Systems, Cataloging and Research Services to explore new models of 
access, improve digital platforms, manage complex workflows, develop policy, 
implement digitization projects, and advise on cataloging and metadata issues.

The Digital Services and Access Librarian promotes the use of Special 
Collections materials through development of online research tools, creation of 
virtual exhibits, coordination of remote reference services, and engagement 
with Humanities faculty.  He/she coordinates Rights and Reproductions services 
for Special Collections with an awareness of copyright issues and Scholarly 
Communication trends.He/she works with the Department Head and Assessment 
Librarian to monitor and assess use statistics of department’s digital 
resources. Library faculty must meet University requirements for promotion and 
tenure, which includes research and service components.

Required Qualifications
Master’s degree from an ALA accredited program.  Knowledge of current issues 
and trends in archival practices.  Demonstrated knowledge of the principles, 
practices, and techniques of manuscript processing and archival descriptive 
standards such as Encoded Archival Description (EAD).  Working knowledge of one 
or more metadata standards such as MODS, METS, and XML/XSL.  Evidence of strong

I attended today's webinar from the Center for Intellectual Property, featuring 
Brandon Butler speaking on the UCLA v. AIME case.

These are hastily transcribed notes from the session.

DO NOT SHOOT the messenger!  (or the Piano Player!)

I missed the first few minutes, and came in as Butler was explaining that in 
addition to Sovereign Immunity there is the concept of Qualified Immunity.  
That is, IF the agent (media/library worker, etc) was acting in good faith, 
s/he cannot be hit with statutory damages in such a case.

UCLA is basing their argument on several key talking points:

PPR / Section 110 / Fair Use

The Ambrose DVDs were sold with PPR

Butler said the judge is sympathetic to UCLA

In regard to Reasonable portions arguments: sometimes the reasonable amount 
is all... (meaning the entire work)

Butler walked through the 4 Fair Use factors

The fact that someone will sell you something does not mean you have to buy it
In the case Butler was referring to PPR that is sometimes added to the purchase 
of a video (But as we all know, is not needed for face-to-face teaching)  
But I think he was inferring that just because a vendor sells streaming rights 
does not mean that you have to buy them in order to stream.

In answer to questions about duplicating the entire work in order to stream 
Butler replied that PPR refers to the content not the format of that content.
And went on to say that you don't have to use the copy they provided to 
exercise your PPR rights.

In response to a question about the anti-circumvention portion of the DMCA 
Butler replied that UCLA has a license from Ambrose allowing them to access the 
films on the DVDs, so the anti-circumvention was not violated, as they had 
licensed access to the content.   Purchase is the right to access.

An expansive reading of Section 110(1)

As to transformative use, this is almost an exact quote:
If the judge decides your use is transformative, you win.

Butler said using films in a way other than the way the maker of the content 
intended in transformative.

Therefore, using entertainment content (feature films) is transformative if 
used for education.  He referenced a course that viewed representation of 
African American men in film, during which the class viewed numerous feature 
films. Butler specifically mentioned Birth of a Nation (editorial note:  
Which is public domain, so never mind)

Take comfort in Fair Use, your educational right.
