Film Annex or the library? I thought Film Annex was long gone. They mainly
put out stuff  the alleged was PD and to be fair a lot of it was until
GATT. I gather the quality was usually pretty bad.

Well beyond the issue of if the replacement copy can ever leave the
library premise this case offers extra fun. It is VERY likely that ORIGINAL
copy was NOT a legal copy even though the library probably did not know it.
Very little that Film Annex put out was legal. I think it was a case of
don't ask don't tell as to why they had so many rare films. If it was not
a legal copy to begin with than you obviously can't make a replacement copy.

I hope this is for a theater class. A burned copy of old  likely not good
quality VHS would be worse than nothing for film class

library may want to go beyond just checking the marketplace and try to contact

you should be able to replace your current copy (either with one you can 
purchase, or by making a copy).  If you transfer to a DVD, 108 states that the 
copy cannot be circulated to the public outside of the library. That, too, has 
been understood in different ways by different libraries, and you'll want to 
internally decide what that means for your library and how you will comply.
