Besides the 3.1.1 patchset, these kernels got:
1) Compilation using GCC 4.6 (both kernel and mods)
2) ASPM patch (see: [1])

thanks
I did equo world (should be upgrade) nothing needed to be done
kernel switch to sabayon-3.1 (didn't pull in anything else)
installed nvidia drivers
reboot still black screen
did equo libtest (reported system is healthy)
equo deptest pulled in
virtual/logger-0
kde-base/konsole-4.7.3
sys-kernel/linu

eselect opengl and kernel was the first items I checked opengl was set to
nvidia and kernel set to correct kernel
Because I had gui working again I checked via sulfur to make sure the
correct packages had been installed so just to give it one more go I
upgraded nvidia drivers hoping it would pull
The upgrade worked fine on my nVidia box.
I have noticed in the past that when I went to remove an old kernel
(such as removing the 3.0 kernel after installing the 3.1 kernel),
equo removed the modules for the new kernel as well.
Is there a certain procedure for removing an older kernel?

New kernels have to be installed using kernel-switcher (or you HAVE TO
install their external drivers manually).

New kernel works fine on my AMD64 laptop, with ATI card.
equo upgrade pulled all the needed packages and no issue on reboot.
I confirm that the kernel now handles correctly ASPM, as my CPU
temperature now is ~15° lower than the older kernel, without having to
explicitly pass pcie_aspm=force.

Your right using kernel-switcher done the trick
After looking at entropy I noticed
When I used equo and sulfur to install/upgrade nvidia drivers they installed
nvidia-drivers-285.05.09#3.0.0-sabayon~2.tbz2
The kernel-switcher installed
nvidia-drivers-285.05.09#3.1.0-sabayon~1.tbz2
Is now working
