So, let me see if I understand this.
I am interested in the sentence (from this U. of texas document) that
it could be fair use to make a copy for the library's collection of
a work that is unattainable through normal channels.
Don Weinshank from Michigan sent us what could be a clarification
This is something I think a copyright attorney should address.
We should not be governed by common practice when we need to know
what the law says.

When I asked the list a few years ago about converting VHS to DVDs, I
was told it was illegal.
Does anyone have a definitive answer?

Given the complexity of the issue, I asked the Copyright Office here
at Michigan State University to comment. With their permission, I am
posting their reply so as to go into the mix for the discussion at
the next meeting.
Generally speaking there are a number of ways to look at these
As far as I know from experience in my library (Academic) conversion
and migration to an advanced format is certainly allowed. Our AV
library just completed a conversion project of VHS cassettes to DVDs.

There is also an exception for libraries to copy material for archival
purposes (section 107). I would recommend contacting counsel for your
institution.

There are much newer copywright laws and they are much more stringent.
As religious organizations I'd suggest caution here - I think we
shouldn't stretch things... be sure to get a written statement from a
copywright attorney, specifically addressing lending from a library.

The Fair Use Exception to the Copyright Law allows copying of each
tape one time to a different media.

A question for Don Weinshank and the group as a whole: The Copyright
law includes a dispensation for educational use of material. but
since it was written in the 70s, there's lots that it didn/'t
cover. I know that when I ran a University Circ department there
were lots of copies mandated
We convert them to MP3 files for storage on CD's or external hard drives.
$5 per tape. We then return the originals as well.
