we had similar problems, but it's an Apache one.
Try closing it, *killing all the processes*, then restarting.
For us that was enough.

i did the same. but restarting apache every night is quite dirty way to
solve the problem. but for now this task will remain in the cron.

now, i tried to run PHP as CGI and this time it was OK.
I have made new debian package from the last 4.10 php5-mapscript and
upgraded. I will report if it helped.
