Hey Folks,
This thread has pretty much polarized into a theft/non-theft argument.
Unless somebody out there has something definitive or authoritative to add
(i.e., current legislation, legal precedent, etc.) other than personal
opinion, the thread is dead.

Not to debate your point, it is clearly theft, but your analogy doesn't
work.

Radio waves are not considered to be intruding onto your property
unless they cause interference to the operation of some other device

devices operation on your property. When interference is detected the

Hi
Can someone tell me if there are any laws regarding wireless
theft?
One of the apartment complexes near mine has free wireless
connections offered to their residents. Now, my computer happens to
catch that signal.
Now
Then there's the FCC statement on your own equipment saying the device
must not *generate* harmful interference. Using any appreciable amount of
bandwidth could be considered generating harmful interference. It doesn't
matter that their equipment is required to accept it, you're not allowed
to
(or
may not) open you up to legal troubles.
Then again, I could be wrong :)
Luck,

I don't see how inadvertently receiving *any* kind of signal could be
considered theft. Actually making use of that signal is a somewhat
different yet difficult issue. An Internet connection is being sent

Not to flame you, but W R O N G ! ! ! . . .
This would be no different than using a ham radio. If you broadcast the
message, even if you intended it to be received by a single recipient, you
still have no legal expectations that no one but the intended target will
listen and/or respond
if they don't lock it down, it's not your problem.

I don't think Congress has caught up with this yet. But from what

One of the things you should be looking at is Are you a member of their
organization (a resident??) If not then it is not for you to use. Example would be, a
group of homes get water piped or brought into there property. You in turn tap into
that pipe . lets say because it leaks
