Does this data not fall under fair use they being a public body? How can they
copyright it? I'm not an expert on copyright law btw :)
Can this information be obtained under the freedom of information act and used
for whatever?

is not really public domain. The OSM guidelines are clear about how to
deal with this. Approach the owner of the data and get permission to use
