In my country, such terms don't have any legal basis. Youtube is free to prevent me from using its service if I violate their terms of service, but they can't technically. But violating their terms of service is not violating the law.

Thank you all for recommending jamendo. I didn't knew it yet and I love it! Especially because I ever dreamed of making a short film with some friends it's great so many available songs for this purpose; only few of the tracks on jamendo contain a no-derivative licence.
