Same happens for me with my external USB 3.0 enclosure with kernel
3.0.0-12 in Oneiric. If i boot the PC with the enclosure attached and
on it is used by xhci as USB 3.0. After switching it off and on again or
after pulling the USB in and out is it only detected as a USB 2.0

Updated kernel to version 2.6.38-11.48. Error still exists.
Again checked all USB-ports. Thumbdrive gets only detected as USB2 device
(module ehci_hcd gets used instead of xhci_hcd).

There is a user reporting the USB3 issue got fixed in 2.6.37-rc5
(http://ubuntuforums.org/showthread.php?t=1642641). I checked both Lucid
kernels 2.6.37-12 and 2.6.38-1 and the error still occured.
