It happend after I installed linux-image-generic-lts-raring and after that linux-headers-3.5.0-28-generic which tried to compile the fglrx . I had no such a problem with linux-image-generic-lts-quantal and kernel 3.5 headers are installed and everything was compiled ok. (and I'm using it now) I
