Sure. Terminate their access. Or let your mail server be listed in RBL's. Your choice.
Most service providers have an Acceptable Use Policy that allows them to terminate users who engage in spam, and many companies have a code of conduct that allows them to terminate employees for doing this as well.
Nobody expects a sysadmin to know in advance about someone who intends to spam; spammers are sneaky and will represent themselves as legitimate users as much as possible. The reason for blocking port 25 except through your own server is so that you have a log which will allow you to take action once a complaint or other evidence comes to your attention. But you do have to take action about things that you do know about.
