Hi Martin,

if you use TCP never. If you use UDP it depends if you have an INVITE
client transaction, an INVITE server transaction, or a Non-INVITE client
transaction.

But I think your question is explained in detail in chapter 17
Transaction RFC 3261 and 200 OK for INVITE 13.2.2.4 2xx Responses same RFC.
