You should send a failure (you quoted the text that requires you to do so). The failure you should send is 500 (which is used for all situations where CSeq is l.e. a previously seen CSeq), officially called "Internal Server Error", but would be better called "Out of Sequence" (and which should be a 4xx error, but that's another matter).
