If that logic wasn't broken, we would not see the early media IVR 
disconnections being reported.  I have also seen evidence of this logic being 
broken a long time ago while experimenting with cell phone voicemails.  But as 
I said in an earlier post, fixing that logic is not the solution we are looking 
for here.
