There are multiple questions here: 4.0 is in the temp directory, while it says 4.0, it is not considered stable. Users not in a production environment are encouraged to test it and post back any issues. How long until it becomes stable? When the issues blocking it are resolve according to the tracker, work will then shift towrds making sure inplace upgrades work and making it available for general availability. I don't think anyone will put a timeframe on it until it is simply a matter of testing builds once the tracker is cleared. As for the "document contains no data" issue, I don;t have that issue here.
