It seems to me, though, that because there are multiple copyright
holders here (due to patches, contribution agreements, etc) - copyright
holders *other* than Linden Lab will likely seek to take action if the
Lab doesn't tell its fellow copyright holders what action it is taking
or doesn't take any soon.
That's the vibe I'm getting from all of this at the moment.
If it were me, I'd probably have shot off a C&D already, but I'm old and
tired and my copyrights get infringed many times a year, so perhaps I'm
less patient on the matter than some. After the first couple of hundred
infringements or so you tend to dispense with the notion that someone's
cashing-in on your work out of ignorance, or that they're planning to
comply but aren't quite there yet. Especially when someone else makes
more money from your own work than you are :)

the people in LL's legal team realize that selective or nonenforcement

You are probably thinking of trademark law. Copyright does not have
much of a concept of laches, because it has an express limitations period.
A court might not be sympathetic if you allowed infringement just to
increase the damages; such as waiting until a work you knew was
infringing hit public release to get more out of the lawsuit... but
other than that, you don't lose much by not enforcing a copyright promptly.
