I expect that with time any fully legit newsletter will start to
receive complaints; if not because the recipient has forgotten, it
could be a recipient mistake, and it could easily be over-reaction to
extreme frustration and upset with the huge quantity of real bogus
spam; the newsletter just getting caught up in it.

There is however a real good way to overcome this problem. If the
newsletter sender would periodically include a note at the top of the
newsletter, or as a separate delivery, that the delivery list is now
erased and that an updated confirmed opt-in is required in order to
receive the benefit of future mailings.

Benefits to the publisher include:
-certainty of attentive readers, wanting to read the product;
-truthful numbers about the voluntary readership;
-no spam report problems; and therefore
-no connectivity/hosting problems due to reports sent upstream.

Downside to the publisher is loss of unrealistic readership volume and
revenue which is based upon delivery rather than readership.

There may be better answers; but this is the best I've come to
understand.

Obviously the spam problem is starting to incur more and more victims.
