It boils down to one simple thing....define the term within the body of
the standard !. 

As for NFPA's experts, I'm sure that the appellant will remind the board
of NFPA's own stipulation;  "Annex A is not part of the requirements of
this NFPA Document but is intended for informational purposes only." 

But don't lose hope, 2006 IBC 201.4 "Terms Not Defined" offers the
following; "Where terms are not defined through the methods authorized
by this section, such terms shall have ordinarily accepted meanings such
as the context implies", as a matter of fact NFPA-72 3.1 offers
something interestingly similar; "Where terms are not defined in this
chapter or within another chapter, they shall be defined using their
using their ordinarily accepted meanings within the context of which
they are used."

With that said we allow 90 seconds within the context of "immediate".
NFPA-72 is chocked full of 90 second requirements so its ordinarily
accepted.

If all else fails remember determinations are that of the ahj. ;-)

Hopefully since it sounds like this may end up in court, the "opinion"
of NFPA's "expert" and editor will hold some value. This is only one
definition of what "Immediate" is I'm sure that since the body of the
code calls for Immediate notice of the fire dept. that this is a very
conservative value for that amount of time. Webster's would not be so
lenient. Since the code says "Immediate" in the body, the battle will be
over what that means. I believe that by most people's understanding,
waiting 4 minutes would not be considered immediate.

Unfortunately being that its in the annex its not part of the standard
and thus unenforceable since it cannot be cited.  The good folks that
write the standards have to understand that municipal ahj's are not
bound to, nor can they rely on annexes, appendixes, commentary, etc for
enforcement. I'm not disputing the value of these materials merely
stating the regulatory aspects of them. Citations of annex, appendix or
commentary material cannot be relied upon to survive should a citation,
determination or ruling be appealed since the adoption clearly includes
the annex disclaimer.

explanatory material, numbered to correspond with the applicable text
paragraphs."

We need to make sure that this material gets into the code text
otherwise its merely opinion.
