Hopefully some of the building design folks will jump in since it has been a 
long time since I looked at NFPA 90A (regarding protection of wall penetrations 
by ducts).  Once upon a time, if penetrating a 1 hr wall (limited to horizontal 
wall penetrations and not vertical protection) as long as the duct was metal 
and did not have any openings within a few feet of the wall, a fire damper was 
NOT required in order to be considered protected.
