Recalled Sprinklers - Part 2

On May 30th, a Technical Update was issued on the question, "Does NFPA 25 
require
recalled sprinklers to be replaced?" The answer was no, NFPA 25 does not require
 recalled fire sprinklers to be replaced and that it is up to the building owner
 to maintain their system. So what would require the building owner to take some
 action?

A document that could require recalled sprinklers to be replaced is the fire 
codes
published by various organizations. For example, the International Fire Code 
(IFC),
2012 edition, address recalls of fire protection components in Section 901.10. 
This
says that any fire protection system component regulated by this code that is 
the
subject of a voluntary or mandatory recall under federal law shall be replaced 
with
approved, listed components in compliance with the referenced standards of this 
code. The fire code official shall be notified in writing by the building owner 
when the recalled component parts have been replaced.

The IFC commentary indicates that this section provides the fire code official 
with
a valuable tool for monitoring recalls. Under this provision, a code section can
 be cited that will allow the fire code official to enforce the recall. Product 
listings and compliance with reference standards is paramount in the 
effectiveness
of fire protection systems. Companies may be under an agreement with federal 
agencies
to "voluntarily" recall certain components or face legal action. While this is 
technically
voluntary, it in no way reduces the need for the recall. To the extent that the 
company's livelihood depends on the recall being performed properly, the action 
is not voluntary. This section allows the fire code official to compel the 
building
owner to comply with the recall and replace the component with one that is not 
subject
to suspicion.

Another document that addresses a recall is the 2012 edition of NFPA 1, Fire 
Code.
Section 13.1.7 says that all fire protection systems and devices shall be 
maintained
in a reliable operating condition and shall be replaced or repaired where 
defective
or recalled.

NFPA 25 would not require an inspector to identify a recalled fire protection 
components.
When a recalled product exists and is identified, it may be prudent for an 
inspector
to inform the owner of this by separate correspondence. Noting these items 
separately
shows due diligence and may ease concerns of liability for the inspecting 
contractor.
