The mozilla.org crypto FAQ has some clear, explicit answers to clear, 
explicit export questions.  Even though it's oriented at the free 
distribution of Netscape Communicator (and it's not, of course, Legal 
Advice), it's still worth reading:

Brief summary: A U.S. citizen can't electronically export any software that 
contains crypto code or that contains calls to crypto code ("hooks"), nor 
can a U.S. citizen re-export such software imported from abroad.
