Title: Re: FW: Painted Wall Sundials Website

Hello Mario and all:

I certainly did not mean any harm to you or any other of the wonderful artists, sundial designers and photographers.  You guys are my heroes.  I can only hope to make sundials as nice as yours someday.  I admire your works so much, that’s why we made this webpage.  I would never do anything to offend you or the others and I would certainly accommodate you if I could and would do the things I should.   But since I can’t, I will ask Dave to shut down the website tomorrow.  Your friendship means more to me than the damn website.

I’m sorry if I upset anyone.  I was just trying to do something nice for my dialist friends and was trying to get people interested in them so that more would get built. That’s all.

Oh well, I tried….

John

Dear John,

we had some works together in the past, but I agree with Bill. In your page just posted there is a lot of original images taken from my personal Internet Site (Solis et Artis Opus) of mine sundials (made by me) and a lot of other images taken from the Internet Site of the Italian Gnomonical association (Gnomonica Italiana) some of them made by, some got the picture by be and some others put on the Site by others. I see thet there is a lot of pictures taken also from the web site of Aiello.

I don't know about Aiello, but about the first two web sites, where I'm webmaster too, I'm sure that you never asked me nothing.

Of course I may be pleased if you use my personal sundial as example of most beautiful dials, and also the ones not made by me but photographed by me (it means that I have a good look in choice), but nevertheless a simple request would be welcommed before.

Posting on a English web page images kept from Italian language web pages without write the link, the place where they comes or also the name of the authors is not correct in my opinion. People will go to your page, no care of ours. I'm not very happy for this.

To let you understand why I'm not so happy I will list the number of the photos in your page taken from the sites where I am webmaster.

Photos of sundials painted by me: 20, 21, 22, 23, 24, 85, 88, 118.

Photos made by me but not sundials painted by me: 87, 92, 93, 94, 95, 96, 99, 100, 101.

Photos not photographed by me but in the site ogf Gnomonica Italiana, mostly all the cited numbers plus: 78, 79, 80, 81, 82, 83, 84, 86, 89, 90, 91, 97, 98, 102, 103, 104, 105, 106, 107, 108, 109, 110, 111, 114, 117, 119, 120, 121, 122, 123, 124, 125.

You should take a minute of your time and put under all the photos the link to the website where they are in origin and the name of the author (if it is known)

Mario

I'm also sorry some photographers might get mifted that we did not mention their names. But in my opinion any photos I find googling on the internet are free game and I will copy them.  So sue me!  (not you Roger, I'm just venting.)  People shouldn't put photos on the internet and expect them to remain private.  At least I'm treating all photos and people equally by not giving any info on any of them.  So far, nobody has complained.

Well, this is your first complaint. I'd intended to take it up with you privately, but since you've gone out of your way to bring up the subject then rub our noses in it, I don't see why I should.

It is very easy to collect photos and throw them online without captions. It is also essentially uninformative. Yes, the work is in captioning, explaining, etc.

But mostly, pirating the work of others is not an acceptable practice. Your opinion on the rights to photographs is not in accordance with the law in the US nor, very likely, in most any civilized countries: what you've done is infringement of copyright.

The excuse that you believe that people placing material online are somehow expecting it to "remain private" is disingenuous. Any fool can see that the very intention of a person doing so is to make it public. You might as well claim that the authors of books, or movies, or music, shouldn't expect their work not to be pirated since it's clear they meant to keep it secret, and you're doing everybody a favor by copying it.

In my case -- the photograph of the beautiful dial at Cesi in Umbria on my page

   http://tinyurl.com/y7ow97

is my property (it's quite an excursion getting to that village, by the way, and I caught a horrific cold on it) and I am well within my rights to ask you to remove it from your page. Had you asked me beforehand by the way, I would have said sure, as I almost always do to requests of this kind.
