I went throught the patent process (US 6,897,423)  and you're right, it's a big deal. No one should commit to it unless they are sure it's necessary. I also think you're right about owning IP without a patent. The "first to invent" system in the US is unique and allows the common citizen to participate in developing innovations without the (seemingly limitless) resources of a large corporation. You only need documentation proving when you first had the idea and that you have shown "due diligence" in developing it.
 
Unfortunately, there are negotiations underway for a harmonization treaty. This means we may be conforming with the rest of the world in a "first to file" system which puts inventors in a race to the patent office.
 
Finally, if you want to establish some limited protection at the patent office, ask your attorney about a "provisional patent" application.
