Mike. Without seeing the page, all that really comes to mind is that the Flash file is on a higher z-index than the pop-up.
I am not sure what code you can / cannot change, so it is a bit hard to offer any solutions... Under Flash 9 the dialog overlays the Flash, Flash 10 the Flash disappears (a lot like a css display:none) I've looked at the page source and I'm not seeing how they're doing this.
