This is a subject that is in the crack so to speak. If you do not address it in the spec, people are free to do what they want. This is why you gotta check the BSY bit more than once.

I am sure there is no such direct statement. However, there is also
no statement that says a device is allow to asynchronously set BSY=1
and there is nothing in the ATA tradition that indicates this sort of
activity is permitted. If permitted it would complete destroy the
concept of a state based interface and make host determination of
device status/state impossible.
