The current behavior is clear to us, but I can fully understand that
it isn't for other people, and a feature that turns on automatically
but has to be turned off elsewhere can be very frustrating.

I think that the OP's proposed UX makes sense. The notes layer could
be either "off" or "on" or "auto-on". Activating "add note" mode
switches "auto-on" if it isn't already "on", and canceling the "add
note" mode without havind added anything turns notes "off" if they
were "auto-on".
