Well there are a couple things here.

First, it doesn't matter if TMDA existed before the patent was issued.
When it comes to patents, it's basically the first one to file the
patent is the one who has the right to claim it. So if TMDA was first
and never filed, then they don't have a leg to stand on.

However, it looks like while zoemail's addresses LOOK like TMDA's keyed
addresses, the real story behind TMDA is challenge/response. Keyed
addresses are only a way to signal TMDA that certain mail does not have
to be challenged because it comes in already authenticated.

Zoemail does not use any challenge/response system, and is solely based
on the principle that outgoing mail to a new address for which a key
was never created will automatically create a new key for that one
address. If spam starts coming in from that key, then you know the
person/list/company you sent mail to then distributed your special
address and you can simply revoke that one and the rest of your mail is
unaffected.

So based on your options. I think #3 would be the closest choice.
