Are you sure it's not related to power outages? I am running the latest non-beta firmware and this happens on both of my Touches when the power goes out and comes back on. When the power goes out and the player is in an "Off" state, when the power comes back it ends up in an "On" state (which is usually Now Playing) and I have to turn it off.
