Do you really think that the Romans would have crucified someone for breaking Shabbat or eating non-kosher food? It seems to me that sedition would be the only charge worth making. Even in our modern government, it would be easier to get capital punishment for sedition and treason than it would if it was argued that somebody violated Shabbat.
