seens that kernel.org bugzilla is still down. Inded the bug was reported in the Kernel, and Joseph is right the problem is in the mainline kernel and not specific on ubuntu build, this bug is not even exclusive to Ubuntu, i had this same problem with Fedora starting from 15 (as they use kernel 3.0 renamed as 2.6.40) and the recently released version 16 that use kernel 3.1 and also with OpenSUSE 12.1 that use Kernel 3.1 as well.
Will report the bug to kernel.org as soon as possible.
